Every couple of days, I check in with my daughter, Greta Secrist Hyland, a former employee of the Forest Service, the Utah Division of Natural Resources, with a master's degree in Natural Resource Management, living in St. George, only about an hour from the Bundy Ranch, and applying for law school, following in her mother's footsteps, to be found at http://www.thesouthwestjournal.wordpress.com/2014/04/01/free-grazing-breaking-clive-bundys-stand-against-the government, for a more reasoned and rational approach, than the off the top of my head dialogue with nobody, but myself and a few videos and talk show hosts and guests to draw from, but Greta keeps me informed, so I can scream and get pissed off, not hard, and write a blog I didn't intend to write.  However, it does dovetail with some of the things I actually wanted to write about, so here we go, stream of conscienceless writing . . . a collective array of thoughts that have been rattling around in this brain, and come together in this beautiful mind of mine, my playground, to offer either a learning experience, an argument, or just something to make you think.

Now, Greta, told me that Cliven Bundy, rancher, I guess, not a citizen of the United State, because he doesn't accept or recognize it, but rides into the sunset, majestically, into the Nevada sunset, under the flag that would be recognized, worldwide, as the flag of the United States of America, is just not the one, you want teaching you about the United States Constitution!  I think that would be a logical conclusion to draw, even for the slowest of minds, because it doesn't make sense, to listen to this guys, who is barely conversant.  But I do understand where he was coming from, fighting against the 200 jack-booted thugs, that entered his property, without, a warrant, I am guessing, even though there was a court order, but that had been served months earlier, so the BLM and federal officers were unlawfully on his property.  So, respect the enforcement of forcing law enforcement officers, to actually abide by the law, the Supreme Law of the Land, the United States Constitution . . . maybe that is why they didn't think they needed a warrant, Clive doesn't believe in the United States, so he forfeits his rights under the Constitution?  So, as far as being accepted as a legal scholar of the U.S. Constitution, or the state of Nevada Constitution, hell no!

Wild Haired, Constitutional Law Professor, Jody Armour, From the University of Southern California, Defends Bundy, with Cheek v. U.S.A. Case

I have my own Cheek et al v. Garrett et al, civil rights case, therefore, my ears perked up when the professor, mentioned the name, but he said, that the holding or the ruling of the court in that U.S. Supreme Court case, basically said, that if anyone had a good faith belief that they were not violating the law, or did not recognize the law, in this case, an internal revenue case, tax payer issue, that there might be an argument there.  This case has some similarities, because if I heard the professor, who may or may not have run into wild ass constitutionalists, who refuse the recognize, the authority of Congress to tax, I would understand, but I guess you could call these types of people, who hate the 15th, 16th, and 17th amendments, believing that they were passed illegally, or unconstitutionally; therefore, you could say they are conscious objectors to paying federal income taxes . . . so kind of right there with Bundy.

However, as in all law cases, that appear to be precedent setting cases, one has to look at and compare or distinguish the case, to your own case . . . so, this differs in and of the fact that Bundy's father, who previously owned the ranch and cattle, paid the grazing fees, or the lease for those rights to graze his cattle on BLM land that can be leased from anyone.  But went the BLM listed the desert tortoise on the endangered species list, Clive, in 1993, just decided to stop paying for the leasing rights; therefore, forfeiting the right to graze, leaving him in violation of the law for the last 20 years!  But I do agree with the professor, in and of the fact that he said, this case may have been more about the government losing the trust of the American people, losing credibility by way of using force, brute force, if you will to intimidate, threaten, terrorize and gain compliance with the laws, while breaking more laws than the offender.

Breaking Point--Patriot Act--Have to Protect You From Your Freedom and Rights!

We have a long string of offenses to civil liberties, threats to the economy, and down right unconstitutional actions for the break down of what, the majority of Americans, have come to know as America, have fought for, taken oaths to preserve, protect and defend, and are willing to have their own blood shed, or shed the blood of their fellow Americans, namely those working for the government agencies, who are operating under a totally different value system than the federal agents, don't even know what the Patriot Act is, they just know, this is not America, and we fucking don't like it . . .  that is precisely why the militia from several states showed up, to back down the feds from terrorizing the Bundy family, good, bad or ugly, that is not the way America operates, even when laws have been broken!

USC law professor, Jody Armour, brought up the Rodney King trial, that the American people sat and waited with baited breath, to see 4 law enforcement officers, caught on tape, beating the hell out of King, be punished for their abusive actions . . . didn't happen, acquitted, really?  We all know that was a brutal beating that should have gotten the officers, like citizens, jail, fines, suspensions, or whatever, to see that justice was served.  Well, the reaction of the community was total fury, riots, looting, and unlawful behavior in protest for the injustice in the case . . . the United States Constitution forces the government to abide by the Bill of Rights, while the governed have to follow the laws of their state legislatures and Congress.  

There is always a balance of power in all phases of the Constitution, from the three branches of government, to cops and sheriffs, one elected and answers to the citizens, but also has to enforce the law!  It also protects law enforcement from civil rights and section 1983 civil suits for acting under color of law, and violating federal statutory and constitutional rights of citizens, in state official capacities too.  Militias, under the second amendment, not the National Guard, but the state constitutions, authority founded in the 2nd amendment, to keep a free state, necessary for a free state!

Young Liberty Candidates--Right Way to Rehabilitate the Old Republican Congressional Guard, that has Violated Their Constituents Rights for Voting for the Patriot Act!

As a young high school student, I almost joined the John Birch Society, with the general guidelines of teaching people about the U.S. Constitution, supporting candidates and legislation that does the same thing, rating them and such.  In the 1950's, with the 1933 agenda, promoting a socialist or communist form of government, with rights, and changes, that are not consistent with the agreed principles and concepts of the U.S. Constitution, nor the state constitutions, the John Birch Society was sorely attacked, an organizational assassination if you will, with progressives and proponents, not true to their oaths of office, much like the RINO's of today, Republicans in Name Only, voted for legislation and laws, that don't reflect the common core of the average American beliefs, such as the following examples . . . with the John Birch Society having a liberty index to rate the elected officials in Congress on their propensity to vote for American ideals, not just Republican ideas, but the nuts and bolts of what this country is about!

Yesterday, when I intended to hike up Rattlesnake Canyon, Missoula, Montana, I saw a great picnic table, with a bunch of sunshine, under the amazing big skies, of Big Sky Country, and took the time to read the New American . . . with a motto of that freedom shall not perish, put out by the John Birch Society, with an article that caught my attention, Liberty Candidates and the GOP civil war . . . just a brief history with me and this magazine; I have never closely aligned myself with either political party, and the U.S. Constitution, a compromise even further prohibits me from siding with one party or the other, for I am both and neither, all at the same time, but fall right were the Constitution or my interpretation of the document falls, or supporting, while criticizing U.S. Supreme Court cases, so that is where I stand, so . . .

Friend Found Whole Stack of Articles From the New American--Assumed They Were Mine!

I had a friend who worked at the now, debunked Franklin-Covey Store in St. George, Utah store, and one day, before it was closed, she found about an inch of articles from the New American Magazine, I had no idea the magazine existed, nor had I heard much of the John Birch Society, since I was in high school, and had not idea it had any connection to anything at the time I read the articles, but, I will honestly say, that I took those articles, about 40 or 50 that the copier had left, and my friend gave me, and there was not one word I disagreed with . . . and that was before reactivating my law license after my alleged terminal brain injury, or poisoning, that was just coming to light at that time, long before I sued the government, or went to the U.S. Supreme Court, so, a pretty unbiased view of the articles.

I had been asked to come to a dinner, sponsored by the Republican Party in St. George, who had asked me to do a constitutional analysis of ObamaCare, Immigration and several other issues, hot topic issues, which is did, and the one on ObamaCare, ended up being the basis for the Utah Attorney General, Mark Shurtleff, whom I sent a copy to, as former assistant attorney generals together, so he could keep up, and he got the other 5 attorneys generals, who eventually got the other 25 or so, who challenged the constitutionality of the Affordable Care Act, the technical name for ObamaCare, but at that dinner, the guest speaker, was Tew Bliss, the regional director of the John Birch Society, and he happened to hold up a copy of the New America Magazine!  

They sat, you are most yourself, when you return to the state you were in high school, free of spousal, child, and parental influence, and I had gone full circle, back to what I knew in high school!  Amazing.  I am also a member of the Daughters of the Utah Pioneers, and was invited to become, with 4 forefathers, fighting in the Revolutionary War, to run the Constitutional Committee for the Daughters of the American Revolution, so I am, who I am!  And I will have to say, I wish, the Daughter of the American Revolution would do more, they have the came charter or call to action, as the John Birch Society, to teach people about the U.S. Constitution and the history behind it!  So Ladies, get off your asses and get busy, be more than just scholarships, collecting pins, and having speakers!

Not All Are Fading--The Beautiful Face of the Old America is Coming in the Shining Faces of These New Guardians of Freedom!

The Republican Civil War is a wide-ranging, balance-of-power struggle involving outside groups trying tot take over the Republican Party's agenda during this critical year.  New faces on the horizon: Justin Amash, Lee Bright, Randy Brogdon, Milton Wolf, Greg Brannon, Matt Bevin, Chris McDaniel, and Ben Sasse.  I am going to just copy some of the quotes from the article, that I fucking love, support, and hold heartily get behind . . . 

Republican congressman elected since the 2010 Tea Party wave have been far less likely to fell  attached to party leaders and to look to them for support.  In the case of some congressmen, they even seem to relish snubbing party leaders on issues where they differ.

Organizations such as FreedomWorks, the Senate Conservatives Fund, and Club for Growth will likely determine in 2014 if establishment Republican officeholders that push attacks on the Bill of Rights will be able to continue to drive the GO ideological agenda nationally.

Regarding warrantless surveillance of Americans' phones--an activity explicitly prohibited by the Fourth Amendment to the U.S. Constitution--Lindsey Graham told Fox News he was glad it was happening.
