Officers Who Hid Behind the "Shattered Shield" Became Enforcers For the Drug Cartel, New Orleans, 1980's
DANGER ON THE STREETS, NO ONE STANDING WATCH!
You know, it is interesting to me, to watch some of these old time cases, stories and episodes, because, almost without exception, the cops, follow constitutional guidelines, from serving warrants, to obtaining evidence, through search and seizures, which is refreshing and notable, reminding me what we have lost with the Patriot Act, giving cops the right, almost, to go into a person's home, his or her castle, without a warrant, opening the door to corruption, planting evidence against a person a cop doesn't like, or whom is a witness to a case, or whatever, it is a license to steal, to go in and take what you want, and it gives too much temptation to law enforcement, if you can call them that, any more, seeing, my 93 year old neighbor, who sits on her front porch, for hours on end, watched, my house, in Parowan, Utah, because that is all she can look at, straight across the street from her arm chair, but she told me, while I was in court, or on the road, or in Montana, cops came in my house at least 6 times without me knowing, without warrants, without any reason, and on the sly! I went from a 5,000 square foot home, that was illegally, unconstitutionally and unlawfully, outright criminally taken by judges, prosecutors and cops, going to a 3,000 square foot home, leaving me, with a big home, alone, and while I was remodeling my Parowan, home, after getting my St. George home stolen, I would sleep up in the upstairs bedroom, on several occasions, I would go to get in my purse, that I generally hung on a kitchen chair at night, only to find that my flash drives containing all my cases, briefs, notes, and emails, of import, were missing, and then several days later the same device would show up again. Or, when I would go to get in my truck, in the morning, I would notice that, the dead bolt, to my back door, was not, in the hole . . . at my other home, I had DVD's of evidence taken, my law office, French doors, not in their bolted position on the floor, in the wood!
My $56.7 million lawsuit, against Iron County, for corruption, running deep and fast, the most corrupt county in the country at the time I filed suit, or maybe because the national news got a hold of my lawsuit, could read the amount of license that was taken by cops, like three narcotics task force members, breaking in my clients, house, fucking planting 51 pieces of felony evidence against him, with us catching three cops, McIntyre, Fritz and Lee on tape recorder, hidden in the chandelier! Those charges could have locked my innocent client, who was friends with some one the county attorney had issues with, who was studying to be a private investigators, and helping several of the locals with their cases, and therefore, guilty of associations! During the trial, one of the cops told my client in jail, that, his biggest crime, was being the boyfriend of Haylee Cheeks! So, to get Shane Clark's full cooperation, with cops and prosecutors, trying to get at her and another plaintiff in the civil rights suit, Travis Braun, they were leaning hard on someone who did nothing wrong, but now was facing charges that would ruin his life! This type of brute force, is nothing more than criminal acts, committed by the police officers! And the county attorney, not me, the civil rights attorney, should have charged the fuckers with the crimes of forceful entry, breaking and entering, trespass, etc., just like they would ANY other citizen, if not throwing the spaghetti bowl at the wall, and seeing what sticks!
Don't Shatter the Innocence and Trust We the People Have or Should Have in LAW ENFORCEMENT!
Ninety-eight percent of the American people, and rightfully so, believe in and expect to have their civil and constitutional rights not only respected, but protected by LAW ENFORCEMENT that is getting to be an oxymoron, these days, meaning the exact opposite of what that suggests, just like that bull shit, PATRIOT ACT, I refer to as the UNPATRIOT ACT! The Bill of Rights, and other constitutional and statutory protections, are one of the main reasons for a government and law enforcement, with sheriffs being the oldest paid law enforcement officers, paid to protect, people's property and homes, while they were away and could not do so themselves, thus today we still see remnants of this in sheriffs being the legal entity to handle executions on property, or dealing with property issues, it is historical! To have a well ordered society, there has to be a set of laws, that both the governed and the government, agree to as a bottom denominator of rules of engagement, to live by peacefully. When one side or the other, of that equation, deviates, either citizens or cops, leave the expected, laws and rules of society, there is trouble! There are differences between terrorists and citizens, and those rights, protections, privileges, attach, with citizens, when interfacing with cops!
Cops can lie in furtherance of criminal investigations; however, they cannot lie, and commit CRIMES THEMSELVES, they are officers of the courts, of the law, and to serve and protect . . . we cannot, have a decent society, that has no rules, laws in the heads of judges, justice on the streets with cops being judge, jury and executioners, skipping, due process and equal protection, pressuring legally trained prosecutors, the gatekeepers to justice, to either prosecute or decline to prosecute based on the training of law enforcement, a rudimentary at best, understanding of the laws, with no law school training, or criminal procedure understanding! Judges, likewise are not the hired guns for the prosecution, nor is the state crime lab, entitled to lie or prosecutors or to doctor evidence in their favor! IT JUST DOEESN'T WORK THAT WAY IN AMERICA!
SHATTERED SHIELDS ARE BADGES OF DISHONOR
In this particular, FBI FILES, the scene is set in New Orleans, at the beginning of the war on drugs, when cocaine was king and the streets, were flush with case from drug cartels and just before drug interdiction efforts started. Believe it or not with the turf battles and drug dealers, and war lords of the drug cartels, started, to protect themselves from, other dealers and those in the drug trade, they turned to law enforcement to protect them! LOL! However, in the Big Easy, the cops, were also, protecting dealers from the very citizens, they were sworn to protect, and eventually, the cops, turned predatory, and started to steal from the drug dealers, much like dirty cops in New York and Chicago, paid to protect store owners, taking money under the table, or let the citizens store owners protect themselves, without the aid and assistance of law enforcement, who extracted high prices for their services, and were brutally cruel when they didn't get their expected pay out, as they started to do with the drug dealers, being even more predatory and deadly, than the dealers, cartels, themselves, as we will see in this FBI sting op, with a drug dealers, being ruffed up by two city cops, Davis and Williams, extorting $10,000 to protect him, and in payment for services already rendered! The dealer, turned confidential informant, and started working with the feds, to take down the ring of dirty cops! And this was on the eve of the city, just hiring a new, police chief, from outside the city, not connected, nor influenced by locals, being brought in from Washington, D.C., with a very symbolic name, Richard Pennington . . . eventually there were about 60 police officers, fired, tried, and convicted, on corruption, sending, I believe about 7 or 8 to prison, with the ring leader, Davis, originally being charged with murder and given the death penalty, later commuted to life in prison . . . is it worth it?
Mind you, from what I have seen, and witnessed, not only from dealings with the FBI, or having watched, their show, that, what was bad, will only get worse, with the feds, creating a scenario, that, may have involved, 2 dirty cops, but working with the CI, and bringing in an undercover, alleged, big time drug dealers, pushing the circle of drugs to be protected, thus, engaging the original targets of the investigation, expanding, it to the point, that, due to heavy drug trafficking, or alleged, trafficking and shipments, often using fake cash and drugs, with undercover agents, delivering the shipment, taking a dirty circle of cops, to the extreme, with supply and demand, came more cops, making them dirty as they helped with these larger and more lucrative deals, casting a wide net, and being fishers of men and cops, catching probably more than, had originally been involved, but, seeing who else in the department was prone to corruption, and there were PLENTY OF TAKERS! The cops, who endured, the heat of the New Orleans, summer, watching the drug transactions and transfers, sat in their old time squad cars, later, demanding, a van with air conditioning, later, the cops allegedly watching the warehouse and drugs, got board, so they hired prostitutes, and their charges, went up and up, with the feds, providing the van, fully loaded with surveillance, eavesdropping equipment and highly technical, audio devices, catching even the sex acts on tape! LOL! If there is smoke the feds, will fuel the fire, until there is no question of your involvement, going for the full Monty, until you are left naked, gutted and bludgeoned, as they did, with even these sophisticated cops, who should have known, better, but, trusted the undercover, king pin drug lord, shocked and betrayed when he smiled, gotcha, smile, your on candid camera! LOL! The rings of dirty cops just kept growing! and so did the charges!
CITIZEN TEEN VS. DRUG DEALER, COPS GUARDING THE DEALERS!
In one incident, a teen, buying drugs from the protected dealer, gets into an altercation with the dealer, over price and quality, and the cops, Williams and Davis, nearly beat the teen to death, who happened to be living with his aunt, who saw the cop beating her nephew, and she decided to press charges, sick and tired of the cops, she filed a complaint against them, so, what did the cops do, they hired a hit man, and within days, the aunt was murdered. All this was caught on tape, but the dirty cops, used, police codes, that were unfamiliar to the feds, and they could not decipher the code name for murder, or hit, and it was not until the woman was dead, that they realized, what the code words meant, and they were sick, that this brave woman, who SHOULD HAVE BEEN THE ONE PROTECTED BY THE COPS, WAS ACTUALLY THE VICTIM OF THE COPS, AND THE COPS SHOULD HAVE GONE AFTER THE DRUG DEALER, NOT HER NEPHEW! But, they got it all on tape, and were able to get Davis on murder, for hiring the hit man, to kill the women who turned in the complaint against him and his partner!
This is just not an example of the way a WELL ORDERED SOCIETY WORKS! My interests are not to sue cops, but to educate them, and teach them how it is suppose to be. Many post 9/11 hirees, while having taken the oath of officers acting under color of law, don't even remember, that they took an oath of preserving, defending and protecting the Constitution, and when they get down and dirty in the department, learning the nuts and bolts of law enforcement, many are just taught, Patriot Act, shit, and they are not protected, immune, nor defended, without following well established laws, and policies. If they follow, the laws that all have to have roots in the Constitution, or they are void, plus do what the department policy was in a particular situation, they will be protected, and immune from prosecution! if they do not, and follow, law that is applicable to terrorists, with definitions that, don't fit the citizen, in anyway, shape or form, they are just looking for trouble! The Patriot Act has only been around for 16 years, do you seriously think, you are going to overcome, the United States Constitution, that has been around, true, tried and tested, for fucking 230 years? Get serious, and ask each of the officers charged, for murder, what the first thing, they were GLAD they had, when arrested? the U.S. CONSTITUTIONAL RIGHTS, the same ones they DENIED THE DEAD!!!!!!!
ONE BAD APPLE CAN SPOIL THE WHOLE BUSHEL!
When I graduated from law school, in 1993, and took an oath as an office of the court, and member of the Utah State Bar, getting a job, with the Utah Prosecution Council, in the Criminal Enforcement Division of the Utah Attorney Generals Office, and as an assistant attorney general, I was paid, a mere $32,000 per year. I had to repay, $500 per month, and that was a diversion, on my law school loans! I am still paying on those loans, out of social security, of jack shit, since, being, brutally, forced by law enforcement, prosecutors and judges, out of the state of Utah, and chased, since the day, I was sworn into the United States Supreme Court Bar . . . I have never, compromised, thought, I needed incentives to do my job, and my daughter, just out of the Navy, worked for IBM, making as much money as her lawyer mother! She had no degree, so this, we need more money, or we need an incentive, or we don't make enough, therefore, we are entitled to make money on the side, or get paid to do our fucking job, taking drugs off the streets, is pure bull shit to me! Hell, the city attorneys, got paid more than we did, in fact the attorney general, did a study and had to go to the legislature and ask that our salaries be brought in range of city prosecutors, who were making more! That is the proper route, to take when going after more money for cops, not stealing property, taking money from bad actors, the mob, or feeling a sense of entitlement, that we deserve more!
The money is not for nothing and the chicks are not free, and you are not entitled, afforded the right, to operate outside the law, to get more money, you switch jobs! or fight the city council, tax payers, or legislators like everyone else, to get a raise! No one is indispensable, when the 5 officers were shot in Dallas, Texas, a month or so ago, Chief, David Brown, who also cleaned house, and fired, 70 officers, before this happened, told the Black Lives Matters, protesters the officers were protecting, just doing their jobs, to stop, protesting, and fill out an application, for the now vacant 5 openings . . . within a week, there were over I believe, like 5,000 applications! with people seeing and knowing, exactly what they are getting into! There is a lot of respect, credibility, and trust that goes with wearing the badge, and hopefully a badge of honor, with officer put in the halls of fame, not badges of disgrace and put in the halls of shame! The job, I brag about most, is not, the one I was paid the most for, but the one connected with law enforcement! There are plenty of perks, power and privileges, that go with being cops, attorneys, judges, and sometimes, in fact, most of the time, we are in that area of practice, at least I was, for the power, not the money! As, I travelled around the state of Utah, training, educating, teaching, writing, for the attorney generals office, it was almost like, people would roll out the red carpet for you! I didn't need that, but, there was a lot of respect, and along with that, was the responsibility to conduct myself in that office, in a trust worthy and dignified manner, doing all I could to further the interests of justice and honor for the law, and all that it can do for good, to hold that sacred place, and keep it in good standing for the people I SERVED, and I have always, seen my license as, a LICENSE to SERVE!
