LEGALIZED THE UNITED STATES CONSTITUTION!
Historical Day for the Judicial Branch, Working in Concert with Washington State, Executive, Attorney Generals, Branch, as, the United States Attorney Generals Office, Should Do, not Fire, a Woman, Yates, Brave, True to Her Job, and Refuse to Defend an Order, of the President, in Defending an Unconstitutional Order, Violating Everything from the First Amendment, Establishment Clause, to, Over-reaching by the Executive Branch and the Order Banning Muslims!
THE PLAIN LANGUAGE OF THE CONSTITUTION
A brief, note on the conditions that, existed, at the time the Constitutional Convention was called, with 13 established, states, with the seeds of this nation, the Union of states, starting, with a dispute, between two states, over a trade issue . . . with, the original, founding fathers of these individual states, looking to create, a more rigorous government to preside over the states, looking basically, at a central government, to raise revenue, regulate commerce, or enforce treaties, in this new national government. These brilliant men, looking at the problems, issues, lose of powers and rights, as colonies, under, King George of England, and his, absolute abuse of power, as a monarch, who took the very most precious, legislative, judicial, powers, and putting all power in the monarchy, and his, legions of armies, who, could rape, pillage, and even murder, house in the subjects houses, and eat of the labors of their hands, and, in this new, country, wanting to above those pitfalls, distributing the authority, between, the legislative, executive and judicial, branches was a bold, original attempt to create an energetic central government at the same time that sovereignty of the people was preserved.
ISSUE: CAN A FEDERAL JUDGE, PUT A RESTRAINING ORDER, ON THE EXECUTIVE BRANCH OF THE GOVERNMENT, EXECUTIVE ORDER BASED ON A CHALLENGE BY A STATE, WITH CITIZENS, BUSINESSES, STUDENTS, PROFESSORS, FAMILIES, TRAVELERS, LIFESTYLES, ETC., BEING INJURED BY THE BAN?
- PREAMBLE: (1) a more perfect union; (2) to establish justice; (3) insure domestic tranquility; (4) to provide for a common defense; (5) to promote general welfare; (6) to secure LIBERTY to ourselves and our posterity; (7) we do ordain and establish this Constitution for the United State of America.
- LEGISLATIVE BRANCH; ARTICLE I, SECTION 8: provide for the common defense and general welfare of the United States (national security issues, appear to fall, in the legislative branch, pulling the executive order, out of the president's hands, not being within, his express powers, duties, and responsibilities, or overreaching by the President!)
- Subsection (4): to establish a uniform rule of naturalization
- Subsection (9) the migration and importation of such persons as any of the states now existing shall think proper to admit shall not be prohibited by Congress prior to 1880
- EXECUTIVE BRANCH: Article II, Section 8, " I do solemnly swear (or affirm) that I will faithfully execute the office of the President of the United States, and will to the best of my ability preserve, protect and defend the Constitution of the United States."
- FULL FAITH AND CREDIT: ARTICLE IV, SECTION I; Full faith and credit shall be given in each state to the public acts, records and judicial proceedings of every other state. And the Congress may by general laws prescribe the manner on which such acts, records, and procedures shall be provided, and the effect thereof. (that would suggest to me, that, both the state of Washington, through their challenge to the executive order and the travel ban on Muslims, prevailing today, can, be a nationwide stay, applying to all states, to stay the ban on those with visas, green cards, work permits, student visas, etc.)
- Section 2. The citizens of each state shall be entitled to all the privileges and immunities of citizens in the several states.
- Section 4. The United States shall guarantee to every state in this Union a Republican form of government, and shall protect each of them against invasion, and shall protect each of them against invasion; and in application of legislative, or executive (when the legislature cannot convene) against domestic violence.
- SUPREMACY OF THE CONSTITUTION: ARTICLE VI. SECTION 2. This Constitution, and the laws of the United States shall be made in pursuance thereof: and all treaties made, or which shall be made, under the authority of the United States, shall be "the supreme law of the land"; and judges in every state shall be bound thereby, anything on the Constitution or laws of any STATE to the contrary notwithstanding.
- Section 3. The senators and representatives before mentioned, and members of the several states legislatures, and all executive and judicial officers, both of the United States and of the several states, shall be bound by oath or affirmation, to support this Constitution to any officers or public trust under the United States.
- FIRST AMENDMENT: Congress shall make no laws respecting an established religion, or prohibiting the free exercise thereof; or abridge the freedom of speech or of the press, of the right to the people to peacefully assemble, and to petition the government for a redress of grievances.
- FIFTH AMENDMENT: . . . NOR DEPRIVED OF LIFE, LIBERTY, OR PROPERTY, WITHOUT DUE PROCESS OF LAW . . . (a travel ban on Muslims, curtails, those people's liberty of motion, even when, they have a legal right to do so!)
- EIGHTH AMENDMENT: Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishment inflicted.
- NINTH AMENDMENT: The enumeration on the Constitution, of certain rights, shall not be constrained to deny or disparage others retained by the people. (states can expand rights to their citizens, beyond, those, listed in the Constitution, as in sanctuary cities!)
- TENTH AMENDMENT: The powers NOT delegated to the United States by the Constitution, nor prohibited by it to the STATES, are preserved to the STATES respectively, or to the people.
- FOURTEENTH AMENDMENT: . . . no STATE shall make or enforce ANY law which shall abridge the privileges or immunities of citizens of the United States; nor shall ANY STATE DEPRIVE ANY PERSON OF LIFE, LIBERTY, OR PROPERTY, WITHOUT DUE PROCESS OF LAW; NOR DENY TO ANY PERSON WITHIN THE JURISDICTION THE EQUAL PROTECTION OF THE LAW!
- SECTION 3. Treason against United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. . . .
LOOKS TO ME, LIKE JUDGE JAMES L. ROBART, OF THE U.S. WESTERN DISTRICT OF THE WASHINGTON DISTRICT . . . CALLED IT, STRAIGHT UP, ROCK SOLID, RIGHT ON, STOPPING AN UNCONSTITUTIONAL EXECUTIVE ORDER, UNHOLDING THE CHALLENGE OF THE STATE OF WASHINGTON, ATTORNEY GENERAL, TO BLOCK, PRESIDENT TRUMP'S, ORDER, THAT WAS FOUND TO BE DOING "IRREPRABLE HARM" TO WASHINTON STATE, GIVING THEM STANDING, ABLE TO DEMONSTRATE, INJURY!
SLAM DUNK, JUDGE! YAHOO! THE JUDICIAL BRANCH, IS ONLY TO SIT IN "GOOD BEHAVIOR" AND WHAT A BOLD, GREAT, AND WONDEROUS, STATEMENT, DOING A COURT'S JOB, DEALING WITH CONSTITUTIONAL ISSUES, FEDERAL QUESTIONS, AND POSSIBLE CONFLICTS BETWEEN STATES, SETTING A NATIONAL PRECEDENCE . . . BALANCING THE EXECUTIVE AND REPUBLICAN CONTROLLED, GOP REGIME, WHO SEES LITTLE REASON, TO STOP THIS INSANITY, ALSO, BEING OATH TAKERS! IT APPEARS, THAT THE STATES, COURTS, CITIZENS, ARE GOING TO HAVE TO KEEP A CHECK AND BALANCE ON THIS ADMINISTRATION!
