THE LAST THING, AILES AND THE BOYZ AT FOX WOULD HAVE WANTED, IS A FEW FEMALE ATTORNEYS, CRAWLING UP THEIR ASSES, ON SEXUAL HARASSMENT CHARGES! LOL! I THINK WE NEED A BRIEF UPDATE, ON WHAT CONSTITUTES A "HOSTILE WORK ENVIRONMENT" SO THAT OTHERS, WHO ARE NOT AS WELL TRAINED IN THE LAW, OR WORK IN A PLACE, THAT DOESN'T TRAIN THEIR STAFF ABOUT SUCH HOT TOPIC ISSUES, LIKE FOX SHOULD HAVE, THEIR ATTORNEYS, SHOULD HAVE BEEN ON THAT ONE, BUT, I WILL BRIEFLY GO THROUGH SOME OF THE ELEMENTARY TRAINING, THAT MEN INPARTICULARLY SHOULD WE AWARE OF, BUT WOMEN, CAN ALSO, SEXUALLY HARASS TOO, AS WE HAVE SEEN TEACHERS, GO AFTER THEIR MALE STUDENTS, AS YOUNG AS JUNIOR HIGH! SO HERE WE GO, AND THIS IS OFF THE TOP OF MY HEAD, SO THE CREAM ALWAYS, RISES TO THE TOP, AND IT IS PROBABLY THE STUFF THAT SEEMED TO MAKE THE MOST SENSE TO ME, AT THE TIME!

The Standard of Review, to Prove a Case of Sexual Harassment, is that there was a "Hostile Work Environment" and that may Differ From Person to Person!  You Take Your Victims as You Find Them, What is "Hostile" to One, Might Not Be "Hostile" To Another . . . The "Eggshell Theory" of Torts, it is the Luck or Unluck of the Draw--You are Playing Russian Roulette!

By way of example . . . when I was an assistant attorney general, over three statewide programs, also dealing a lot with domestic violence, reporting laws for physicians, I happened to come in contact with a doctor, who was a spokesperson for the Utah Medical Association, before, I later, became general counsel for the UMA, but, often, both of us, had to testify before, various, legislative committees, on domestic violence and related issues.  As me and this doctor, ran into each other, more and more, he started to get more and more friendly, wanted hugs, and there were times, he called me, and said that his wife, had Lupus, or something like that, and that he would need a wife, after his wife died, to help him raise his 10 children!  I just kind of blew him off, having four children of my own, and having, not one ounce of attraction for this doctor, not really even listening to him, as he rambled, when he called, every once in awhile.  Now, I supervised, 13 staff members, and three of them were in charge of constituent services, and handled the majority of the calls to the Utah Attorney Generals Office, redirecting them to various government agencies, that would or could best serve their needs, but they also took personal calls for me, and I was generally, never in the office for one reason or another, so they may have gotten, more than an ear full, from the doc, that I was unaware of.  But, I remember, not giving any heed, to this man, never was attracted, never would be, and, male attention was something, I had never lacked in life!

But, I remember, one of my employees, saying to me, JoAnn, you would not recognize, sexual harassment, if it was standing right in front of your face! referring to this doctor, who later ended up, not only president of the UMA doctors association, and the AMA,  or American Medical Association, so a big shot, but, not my type!  Now, obviously, the woman, taking this man's phone call, was bothered by what he was either saying about me, or making reference to, or the fact that he was getting, somewhat, carried away, but, as a female attorney, much like Fox's, Greta Van Susteren or Laura Ingraham, there is much less, likelihood, given the level of education, and power to do something, even against powerful men, that, say, a female anchor with a communications degree or broadcasting degree, would not have, and might be, much more vulnerable, and generally, with an uneven level of power, that makes, the other women, more vulnerable, that an attorney.  What would be threatening to, an underling, would not have the same impact, on someone like me.  I don't think, I gave another thought, to her, statement, and just basically, while not, flattered in the slightest, kind of laughed, that, he would be presumptuous enough, to think, he could pull some stunt, off like that, and that was the end of it.  So, when there is power for power, without supervisory positions, over someone, the level of what would constitute would be much harder to prove; however, if someone had the power over your job, position, promotions, or salary, such as a partner in a law firm, making demands on a new female attorney, who, would or might be under the control of a senior partner!

There is Much Less Sympathy, When the Male or Female, Is Not Under the Control of a Superior, and Then Scream Foul, or Sexual Harassment, When, there was No Power Exerted Over a Subordinate! or They Have the Latitude and Mobility, to Freely Move About Their Profession with Ease!

One of the areas, that attorneys, juries, judges, or administrative hearing officers, might look at, is the level of "supervision" or the "uneven" power between the two involved parties, whether male or female, because both sexes can be sexually harassed, pressured, experience a "hostile working environment."  Anytime, someone of power, a general, a staff sergeant, a supervisor, a principle, a director, someone of substantial power, over the other person, and these allegations, or charges are brought, it is much more likely to be the case, if there is an uneven, playing field, and the more uneven, the power, the more likely, there is the potential, to have the opportunity, availability, and potential, to have the power, to commit, or be involved in pressuring someone, or putting undue influence on them, to create a hostile work environment.  Although, that type of work environment, can be created by equals, or even inferiors, especially, in fields, professions, trades, where there is a predominance of one sex, over another, just due to the amount of support, one might get, from fellow workers for harassing, say a female boss, with all the men, in support or agreement, with the harasser, such as in a police or fire department, or in my case, in the legal field, where all female attorneys, in southern Utah, had been either trashed by the judges, or felt uncomfortable with almost all males in the local bar, or where, only the big boys, get the murder cases, not the females who are relegated to kiddie court!

In large, departments with options and mobility, if there is a complaint, of someone, within the department, harassing, or creating an environment that is not conducive to a healthy work atmosphere, and it is easy to get transferred, or to just be put in a different location from this person, and there were ample options, to avoid the abuser, then, it may be wise, to just realize that, there are personality conflicts, that can come into play, and for every one's sake, it my do you well to move, even if it is somewhat, uncomfortable, takes you out, of your friends and coworkers' circle, there may be some expectation, that, is preferable to the alternative of upsetting the whole office dynamics, or disrupting important business and work, ethics, being just easier to make a change, even while being the one harassed!  Now, when sexual harassment, happens, it is imperative that the person, being harassed, make it clear and known to the person, creating the negative work experience, that they don't appreciate, their advances, or the extra attention, or being singled out, and being treated either better or worse, because, while getting privileges, from a boss or superior, may at first seem, innocent, believe me, it will later come with strings, and just taking up, an offer, even without harassment, can create a "hostile work environment" just knowing there are favors, gifts, allowances, and corners cut, for someone over all the others, who may later take it out on the singled out person.

A List of Commonly Know Events or Comments That Can Be The Start of an Unhealthy Work Environment, Leading to a "Hostile" Encounter

Back in 1994, when I was first hired as an assistant attorney general, staff attorney for the Utah Prosecution Council, we were required, to take a training, on what, sexual harassment looked like, what it constituted, what the signs were that it was taking place, and what to do about it; however, that was a fucking long time ago, but, I do remember a few things, and I will see, if, after 23 years of practicing law, working first with government, colleges and universities, later, in private practice, etc., I have had enough experience, that I might be able to just drag thoughts and ideas out from my experiences:

• sexual comments on dress, body parts, movement, reading contact, or accidental or even purposeful touching, that could or couldn't be considered, creating an unwelcome contact or environment, or taking everything in a sexual context, more like locker room talk
• gatherings of either male or females, at a water cooler, or in an office, and seeing a co-worker, go by, turning and making facial comments, rolling eyes, or raising eyebrows, or whispering, or even loud comments that, would indicate, that the group is talking about, this person
• anytime you have a high concentrated number of men, in a system, and the first women, comes on board or starts to crash their previously, male bastion, and who may even be better than the males, setting a new standard of excellence, the fangs, claws, jaws, come out, putting pressure on the one female, to get out, now, not giving them time to root into the system . . . this happened to me, in the criminal justice system, going from government, protected, ivy tower work, dealing with cops, prosecutors and judges, more in a training, legislative, and representative capacity, to getting down, and dirty in the trenches, in the heated battle of criminal law defense and civil rights, against some of the same people, I had trained, 15 to 20 years earlier, and believe me, it was hostile, with no other female, that I ever saw, most driven out by the boyz clubz, right off the bat, not having dealt with someone like me, who had a resume and history, of taking to the systems, now facing off against them, in court, in the jails, and out on the streets, often turning a criminal defense into a civil rights case, when situations and matters got out of hand!  The big push back, putting the hands and cuffs on, law enforcement, forcing them to abide by the Constitutional rights and protections, they took an oath to do, and they did not like, me doing what they do to every one else!  The transition, from being treated, like an attorney, to going to pussy!  I first noticed and increasing disdain for me, in the jails, and some of it, I believe was related to an obvious, but, controlled attraction, to one of my clients, who ended up being a plaintiff in a civil rights case--the guy was a local football hero, and was going to play for the Nebraska Cornhuskers, but, for some reason, had a class that he failed to either pass, or didn't take, stopping him from going, but, the man was a physical specimen for sure, handsome, fit, good looking as hell, and you had to be blind, not to see that . . . I was expecting some meth-ed out, skinny, druggie type, with greasy hair, and sickly, and this beautiful, buff man, walks into the lawyer's booth at the jail, and we hit it off, right off the bat, even being, 30 years different in age, bound by the case, liberty, justice and rights!  We used to tell stories and talk the case for hours, and we would both, laugh until we were sick!  The jail central, monitors, started to notice, the weekly visits, and the $56.7 million case, and they started to put pressure on me: (1) they started to ask for my driver's license, all the sudden, like they were looking for warrants, and pissed they didn't find any, generally, all I had to show was my Utah State Bar Association card; (2) they had to have put listening devices in the lawyer's booth, that should have been completely confidential, but, now appeared to be something to be used, to gain information, and both me and my client, would notice that stuff we talked about, had immediate ramifications, in the jail population, like moving this guy, to another jail, who had just been ordered to spend the next 4 months in this jail; (3) then on a very hot case, all the sudden, I was being denied, even access to the lawyer's booth at all, and was put in the family booths, like any other citizen, and suppose to carry on confidential conversations about cases, that involved, police framing and setting my client up . . . I had been, up to that point winning, almost all my motions and was getting my clients, either off, or substantially hitting, the system, and getting like 45 year prison, sentences down to three year probation, etc., so the "hostilities" started to amp up, and (4) is was denied access to my clients, some facing murder wraps, with me as second chair, now ready to take on a capital murder case, trying to tell my client, who had originally wanted me to defend him, that now, 10 months later, I could, and to withdraw his plea agreement, they refused me and him, both our 6th amendment rights, by denying me contact, which I had always had, but the plea deal had been reached, another case where I thought the cops, killed my client's wife, then, pressured him, drugged out and drunk, to confess, or so they claimed to the murder, with all the evidence pointing to the cops! (5) blocking access and representation, was just the beginning, then it escalated, to blocking me from making it to court, to see him, at sentencing, waking to find, two of my tires on my truck with nails in them, and my client, being moved from 23 on the docket list to 1 or 2nd, so, that they could get him sentenced and out of the courtroom, before, I could get my truck tires fixed and take care of business in the Washington County Courthouse and cases; (6) then, it went to packing courtrooms with cops, undercover, plain clothed, and denying the public, or friends of the defendants to attend court, violating more rights, from 4th, 5th, 6th and 14th, in this court process; (6) finally, the conflict, because, like a good little girl, I didn't back down, the harassing and "hostile work environment" turned to danger on the streets, with incindiary devices, being  placed on my tires, making one blow when I hit freeway speeds of 80 miles per hour, my truck tires were loosened, engines fucked with, transmission, oil filter, and on and on, attempting to kill me through an accident; (7) cops started to break in my house at night, taking key pieces of evidence, and stealing computer flash or travel drives out of my purse, then putting them back, a few days later, containing, intellectual property, and case notes and briefs; and finally, (8) an all out assault, on my character, going after everything from my life to my bar license, bribing clients, to bringing in cops approved, doubles, in the form of non-attorney sisters, to chasing me for the last 4 years, not remaining in Utah, but spreading to the whole fucking nation, going to my cell phones, to computers, following me, 24/7, on planes, trains, buses, and shuttles, creating a hostile work environment even on my fucking computer!  I am a trailblazer, and beat the living shit out the system, the players, the cops, prosecutors, judges, and whoever, gets in my way, taking on a system from top to bottom . . . and they look at me, my blog, as creating a hostile work environment, for them!  LOL!  I love turning the victim, into the perp!  not new, not creative, no novel, they do this in RAPE cases, domestic violence, sexual assault and often in sexual harassment cases!  Case in point, daily turning off the spell check on my blog!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!  In four short years, due to a hostile work environment, hostile family, a very Republican state and counties, I have gone from a thriving law practice, listed as #2 in the nation, to being reported as dead, having my car blown up, and non-stop surveillance, chasing, intimidation, and harassment, going from a $1.4 million home, $700 million worth of cases, lined up and waiting, a national image and reputation, down to homeless and a backpack, to my name, explain that one!
• I had a secretary at the AG's office, who was a very attractive, middle aged woman, who was very busty, and my boss, her boss too, always had his eyeballs glued right at her boobs, never looking at her face, while he talked to her, and, this was making her very, very uncomfortable . . . I don't think, he intended to make her feel bad, or thought he was creating an intentional "hostile work environment" but, I would more put it in the category of a clueless male, who was not, even trying to look, but somehow, subconsciously, always, rested his eyes, right on her chest area, never ever looking her in the eyes!  Finally, she came to me, and asked me what she should do, and I said, next time he does this to you, look straight at his crotch, area, and address him!  She did this, and it worked, made the point, and made the obvious, while silent, statement, that, his glare was making her as uncomfortable, as her staring at his dick!  She got it, and that was the end, but, this small, thoughtless, staring was creating for her, a "hostile work environment" and, being someone, without that endowment in that area, I personally could not relate, but, I do know, it would piss me off, and being the feminist, I am, I would have done it a long time ago, but again, he was an attorney, and so was I, and she was a secretary!
• dirty jokes, off handed sexually charged comments, assigning machinery, as male or female, or making reference to parts of some machine, equipment, or tool, and giving it, a sexual play on the instrument, can make people feel uncomfortable, and the comments are not welcome, and make others feel, bad about going into that room, say a printing press, or a mail room, or an area, that is heavily laden with the members of the opposite sex, who are not offended, because it doesn't refer to a male body, or it can go in the converse of that, too, the other day, while I was in line, to get food at the Poverello Center, there was a piece of chicken, like the only one left, and the person serving, looked at me, and I looked at him, and the chicken, seriously, looked like a male penis, and, he asked me if, I wanted that piece and I laughed and said, no, that looks a little risque for me!  We both laughed . . . now, that may have been offensive to someone, but, we were not in a working environment, nor was I a supervisor over him, and, there was no doubt, what it looked like, and rather than, embarrassing him, which, it did not, but it could have some guys, we laughed, knowing fully well, what part of the male anatomy, that piece of chicken looked like.  Males, tend to be a bit, less sensitive than females are, and they only have one part of the body, to be talked about and referred to, so, they tend to roll with things a bit better, and very importantly, it was, a volunteer position, and so, there was not much risk of something, becoming a habit!
• this situation, was very uncalled for, and not appreciated . . . sometimes, women, who have learned to get places with their bodies or have been successful, can come onto, a male, making him feel uncomfortable, as in a scenario, between three attorneys, me, my boyfriend, the partner, or boss, of his private practice, who hired my attorney friend, because he wanted to go out with me.  Me and him, were sitting in his office one day, and my ex-friend, came in, with a see through, low cut blouse or the buttons, loose, revealing her breasts, and she, sat on the floor, pulling her legs over her head, acting like she was doing some type of yoga exercise or something, he and I were sitting up, having a lawyer's discussion, when she came in and started doing this sexual exercise, to the shock of both me and him, being so inappropriate and unwelcome.  Eventually, he fired her, but, it was not, him, doing the sexual harassing, she wanted him, was going through a divorce, was afraid that I would be richer than she was, and so she started using what had always worked for her in the past with other male attorneys, using sex to lure them, into a relationship, or way from other female attorneys, as she had done in law firms of the past.  Well, this attorney, had some sense about him, saw her for the skank she was being, and ended up firing her.  But, had she been a full partner, and their law practices very involved, women, can create just as "hostile work environment" for the male, who is not digging what she is forcing him to deal with each day!
• now, there are people, who, we see about town, or every once in a while, who make us feel uncomfortable, and create a "hostile" environment, but that is not the same thing, because we are not dependent on them for a job, or for our pay, or for a promotion, or have to deal with them, every fucking day!  I had one such dude, who was just a simple, man, a dishwasher, type, not educated, but, every time I saw him, is was like, why don't you run away with me, go to Vegas and marry me, or why don't you come on over to my house, cook me up a good meal and we will, you know.  This went on for three fucking years, off and on, and I only saw him, once or twice a year, but just seeing him, made me, pissed, because he never failed to put pressure on me, and I had absolutely no interest in him, didn't want to be mean, but eventually, I had to . . . I told him, that what he was doing was sexually harassing me, and I didn't like it, and if he didn't stop it, I was going to have to call the cops or something . . . now, he will not even say, hi!  But, I prefer that!  Both guys and gals, don't push a relationship, sexual in nature, if, this person, never, ever, responds, or moves in that direction, give it a break and let it die!  I hated his attention in that area, but I liked him, as a person!
• sex, does not belong in the work place!  Sometimes rejecting someone's sexual advances can, then in turn, create a "hostile work environment" when they pout around, get pissy when you come  in the room, or start making disrespectful comments around others, or during staff meetings, pressuring you, through social media, or generally, distancing or isolating you from the rest of the office, through trash talking and negative comments
• while we might think that, adding a little sex to our work to avoid boredom, or to spice our lives up a bit, or to make people feel were are liberated and can deal with sex and work at the same time, there is likely to be some repercussions that might come back to bite us in the ass, later, or when, the fun and games are over, or when a wife or husband is contacted, or when someone has a change of heart, and the two people have to see each other daily, things can get very messy!

One thing, cops, investigators, criminologists, task forces, dealing with highly sophisticated criminal enterprises, need to do, is find an insider, who, is willing to serve as a confidential informant, willing to help, due to disenfranchisement from the larger group, who doesn't necessarily need to penetrate the mob, or gang, but who is already someone, who once was insider the enterprise or syndicate, who may disapprove of the activities, murders, or actions of the gang, who, already knows the players, the patterns, the motives, the war zones and targets, the enemies, perceived or real, who can help map out the organization, that is generally, always, bound by secrecy of the group, with the potential of death, for revealing the secrets of the group, who is able, to identify, even in disguise the members of the group, their tactics, goals and mission, then, expose them to the authorities.  These secret societies, clans, organizations, mobs, work with inner circles of people most close to them, that can be trusted, and who bond, as partners in crime, with the group, all equally, liable to do down, if there is one chink in their inpenetrable armor, or fence, created to protect, the members of the criminal enterprise.

There was one member of the Weather Underground, who was less committed to the groups activities, bank robberies, and murders, responsible for the deaths of three police officer, in three separate shoot outs, with gang members, being trapped, by cops, but coming out shooting, with semi-automatic assault weapons, out-powering the cops, single action, pistols.  The cops, raided one of the residents of the members involved, where the ring leader, was alleged, to have been in hiding, and they found a cache of wigs, fake I.D.'s, guns, explosives, hit lists, of people and places to be either killed or bombed, and all kinds of evidence against the members and their leaders, generally an alpha male or in some cases, a female, with other members of the mob, just following their orders and plans, ideological ideas, and radicalizations!  In this case, one such member, was Tyrone Rison, and I have a nephew, Tyrone Southwick, who would fill the bill on this one, sweet, and would not be down, with all this shit, but would know the inner workings, not as participant, but a a silent, younger observer, but definitely someone, who, would not be morally, down with  this stuff, especially, against other family members, or associates.  He is just not made the same as his mother, brothers and sister, defused by different parenting through extended family members, but the name was very significant to me . . . here is how all the aliases were obtained.

Checks, Addresses, Phone Numbers, Claims of Lost I.D. By Gang Members!

With the Weather Underground, they had a friend, or associate, who worked in a children's clothing store, who would record all the names, addresses, phone numbers, off patrons of the store, then sell them to the gang, who would in turn, take the information, to the DMV, claiming that, their, ID was stolen, or they lost their driver license, and they would promptly issued a new one!  Shelley was given access to my social security number, driver license, and ID, card, through my father, who took over as power of attorney, while I thought I was dying, and he simply, passed that to Shelley, who I caught with copies, but the fraud went further than this, two cops, stopped me on the streets of St. George after, I left, Logan, and  Shelley, who told me that my license had been suspended, and Shelley was the one, that asked to have my driving privileges, stopped . . . by what authority?  I had not been driving for a year, so, why? because was in the process of stealing my identity, not only as a person, but trying to take my attorney status as well, and that is why, when I reactivated my law license in 2009, my father went ape shit, because, Shelley had been the heir apparent, to take my place when I died, which is COMPLETELY ILLEGAL! 

But in addition to that, when I got my driving privileges back, at that same time, but after, all the shit in St. George, was going on, I went to get my license, renewed, plus my ID, and the dude at the DMV, pulled up my old ones, and said, that it is clear that, this is her, but the manager, a female, probably on the pay roll, of the mob, denied me, and said, I would have to get a new number, and start, from scratch!  I had a nearly perfect driving record, two forms of picture ID on their system, and I am the one who needs to get a new number . . . this pattern, has happened, with money cards, they steal, forcing me to be the one to get the new number, connecting them to my passed, and making me get the new card, like I am the imposter, that just happened with my phone, and happened with my cases, legislation, water compact, and blog, Shelley's IP number, or portal, is listed above mine, making it look like the clone is me, and I am the copy cat, or Shelley!  But, the insider, is the one, who knows the history, the patterns, the enterprise, either through observation, or in my case, being the victim, and watching the activities and patterns, and believe, me they do the same thing over and over and over again, why fix what you have gotten away with, but on the other hand, it creates, just the type of evidence cops and prosecutors need, to charge gangs, mobs, syndicates, with RICO type violations, for organized criminal activities, etc.

LAW ENFORCEMENT, ENTITIES, NEED TO KEEP ORGANIZATIONAL CHARTS, THE WAY THEY DO ON THE MOB, ON TERRORISTS, AND EVEN THOSE WITHIN THEIR OWN AGENCIES, INVOLVED IN RICO ACTIVITIES OF ORGANIZED CRIME!

In the case of the female, insurance fraud and murder, syndicate, with about 17 murders under their belt, and making a very good profit on their victims, who included, even the most cherished member of their families, husbands, children, aunts and uncles, friends, etc., with members of the women's murder club, they even got a year's premiums paid for bringing people into the fold, and getting them signed up, with insurance salesmen, who traveled door to door, peddling their wares.  So, these women, got all their friends, and family signed up and then go their premiums paid, then, profited from the murders of the insured!  But, in cracking this organization of women, in the early, 1900's in Liverpool, England, observers and informants, noticed that there was a master-mind, who was sophisticated enough in those days, to know, the rates, measures and ins and outs of the insurance industry, keeping copious notes, to mark and monitor the money and deaths, assets, etc., and the women, were making a killing.  There were about 4 main, movers, and 7 other women, who were less critical players and later were killed themselves, but a sister team, were the leaders, with the oldest being the alpha leader, and younger sister, joining in, with other women, being minor players, but all sharing in the proceeds, once someone was poisoned and insurance proceeds were meted out.  I believe it was, someone's husband, whom the authorities, finally, suspected, and he was found to have large quantities of arsenic, in his system, leading, the other deaths to be thought of as possible murders.

The really smart thing the women did, was living in the cities, the squalor and filth of the industrial revolution, with rats, people, and all living with daily diseases, when, the women poisoned a victim, they made sure there was some tale, tale, sign, of health and hygiene issue, so the doctors and cops didn't think anything other than the deplorable conditions in the city, were responsible for the deaths.  But, once, insurance adjusters, law enforcement and parliament, discovered the insurance scam, perpetrated and inflicting death for profit, they totally revamped the insurance laws and industry, being horrified at what these women were able to accomplish and do so, on the deaths of 17 innocent people, those closest to the women, and even reliant on them for their care, like the 12 year old daughter that was murdered too!  These women, saw the greater gain, as getting their hands on the money, and they would do anything it took to get it.  They just insured all, and then killed everyone off one by one!  Together the women, formed a predator pack, with a pack mentality, known to be, that what, one may not do alone, when in a group, they get more brazen, brave and vicious, not likely to have done on their own . . . although the other two famous serial killers, did act alone.  These were women with money, and their main goal was to make MORE MONEY!

Greed Becomes a MONSTER in and of Itself, Hard to Keep the Lid On!

One of the things that makes crime, committed in a pack, is the fact that the whole group shares guilty, and the power of the group, becomes stronger than the sum total of the individual parts, is that, I didn't do this myself, therefore, the guilt of the acts against the victim, are minimized by the amount of people, willing and involved in committing the violence, the lies, the thefts, the deceptions and the fraud!  In my case, I would be hard pressed to find, anyone, who, in these close knit Mormon families, communities, criminal justice system, states, who, was not both willing to join the group, but also, to participate, seeing, that all would benefit, rather than one family, seeing and buying the bull shit, of the greatest amount of good for the greatest amount of people, an easy argument to sell, in light of the economic meltdown, that happened, right around the same time as this fraud was perpetrated, against me with a shit load of money, at stake, a presidential election to buy, real estate and construction, as means of laundering money, and a ton of credibility and notoriety for the Mormons and Mitt!  A little Mormon girl, saved the financial planners, wealth managers, big time donors and generally, Republicans from the big bad, wolf, the SEC!  They have found, that one of the worst things about AMERICAN GREED, is the fact that the more money you get, the more you want!  It becomes a game, of monopoly, where, you don't stop at this case, or this music CD, or at houses, furniture, you move to blogs, new music, and new legal avenues to get, more and more, with total avarice, greed, gluttony, and consumerism, buying, power, elitism, even appearing to be generous, being seen as a pillar of society, finding it easy to spend someone else's money, rather than make your own!  Shelley, Brett and Kay, my father, all would, find it part of the game, to let you make the money, them steal it, and them spend it, even represent themselves as the earners . . . that turns these people on, with psychopaths, the pleasure, is even more, knowing, that it causes, their victims the ultimate pain!

People, don't understand, the Bernie Madoff's of the world, gaining the trust of people, who have no qualms of taking millions, retirements, 401(k), benefits of others, long worked for and earned, they just don't get it, but that is all part of the game to them, the bigger the better, and they have no remorse, have no empathy for their victims, but they do for themselves, if they get caught, that is it, and as for stealing, more and more, building more and more houses, driving many cars, and taking credit for the work, hard work of others, is a turn on to these people, they are not wired like you and me, they don't think like us, they don't play by the same rules, if they have any morals or ethics at all, it is only within their organization, with the sole intent of defrauding more and more people, for their personal gain and pleasure!  These sociopaths, become marketing geniuses, whether, marketing themselves, or the products they steal, or even the services, of those they imitate, not for the person, who did all the work, but for themselves, in order to steal more!  They make a game out of joining the fuck, JoAnn, club, even promising parties, celebrations, increased booty, adding bounties, and rewards for lies, fraudulence, and the furtherance of this criminal enterprise, seeing even death, as just part of the expropriations, or the war, they have self-declared, self-promote and self-approve, with money, worth the risks, making statements, of their goals, their political and religious positions to justify their actions, to similarly thinking individuals, who are easily swayed, easy to join the pack, and equally easily, able to share the guilt, with other members, with money, gain, and advance in this ideological and philosophical war, of their own, making!

WHAT IS EVERYONES SHARED QUILT, IS NO ONE'S GUILT!  MANY HANDS, MANY MINDS, MANY LIES, MAKE FOR EASY WORK, EASY EXCUSES, AND EASY, PARTICIPATION . . . WELL, EVERYONE ELSE IS DOING IT, SO?  WHY NOT!

• Robert Mercer--all of these people have connections, to Trump's largest political campaign donor, who has hand selected Trump's entire management team now!  Trump talks about Hillary, being beholden to her donors on Wall Street.  Hillary, may take donations, and most of these Wall Street types are smart enough to know of her background, and believe they will get the truth from her, went wanting to know about Washington, foreign affairs, which both have a huge ass, affect on what happens on the market, on investment and loaning enticements, for business, they are leery of unpredictable politicians, who are unstable who could have an impact on the market, which then, has an impact on the world economy . . . I would think, I would want the most reliable source of information too, and money is no object for these WS members, this should be an indication, of not who will control Hillary, who is not going to be controlled by fucking anyone, and they are not calling the shots in Hillary's campaign, they have nothing to do with it!  Not only is Mercer, giving money, there appear to be strings attached to those donations, giving the worst and most disconcerting dark visions of what, unlimited donations, can do, like CONTROL, a potential president of the U.S.!

Case in point, I needed to just spell check, the word, decrepit, and of course, my SPELL CHECK is CONSTANTLY BLOCKED BY THE FUCKING GOP, MORMON RUN, NSA!  So something that is so easy, so convenient, so nice to work with, as a blogger, is denied to me, and has been for the last, few years, with an irregular, nicety, of something available to FUCKING EVERYONE, but me!  Another case in point, the slightest, easiest, most, common, tool of operating our lives, like a phone! is even denied to me . . . yesterday, after a month of not using one, because WHY, these same men, want to fucking KILL ME, so I ditched my phone and my computer, and this is not the first time, violating, all my rights to privacy, to free speech, EVEN WITH MY OWN CHILDREN!  I bought a very simple, Walmart, Straight Talk phone, the ones I like best and the service I find most user friendly, dying to talk to my kids, to see, if my son, got his new home, see how my daughter's new book is doing on Amazon, The Question of LaHash, I wanted to check on my rock star son's, new CD, the Ditch and the Delta, what it is called and did he get it out, survive his summer semester at the University of Utah, I wanted to see how my oldest daughter's new home is working out, and her new job!  I wrote a general email, to tell my kids what my new phone number is, so either I could call them or them call me, long overdue conversations, because of fucking MEN, WHO ARE SO INSECURE, THEY WANT ME DEAD, WANT OTHER WOMEN, AS MY KIDS MOTHER, WANT, TO TAKE CREDIT FOR MY KIDS, MY WORK, MY BLOG, BECAUSE THEY HAVE ALREADY, STOLEN ALL OF THEM!

So, after a month of no contact, not because of something I am doing, but, because I am trying to PROTECT MY CHILDREN, from these motherfuckers, trying to kill me, and I don't want them or their children, at risk, much like I had to do upon leaving Utah, when they wanted to kill me, I refrain from contacting my kids, and I HATE DOING IT, but, it is a necessity when you are dealing with KILLERS, who got their feelings hurt, who are butt hurt, who have a personal vendetta against me? which is shitty in and of itself, I have every fucking right, if you as a male are a shit head, whether married or not, to leave your sorry ass, if I want to, and there in lies the rub, that I CAN LEAVE THEM, THAT I HAVE THE FREEDOM TO LEAVE THEM, THAT I CAN TAKE CARE OF MYSELF, AND I DON'T FUCKING NEED THEM . . . I bought a phone, a simple, easy thing, had, as I always do, have the techs at the electronic center, set up my phone, in two seconds, like they do, in two seconds, rather than me, wading through the fucking instructions and having to do it myself.  She did it with no sweat, in literally, seconds, and told me, it can take anywhere from 10 seconds to activate, to hours, so, don't be alarmed if it takes a while but it should not!  Happy, that I eluded, capture and torture by MPD, safely, out of the city for right now, and beating the shuttle driver, for the CSKT transportation, who must be an undercover cop, judged on his actions, he refused to drop me off, one light, down, the highway, which all 4 of the other, drivers have done for years, making me walk, very rapidly along a highway, without sidewalks at times, to catch the city bus, within, minutes, saving me, $23 cab fees, to the hotel, where the driver, going that way, anyway, not even asking them to pull of the street, just a brief stop, while I tuck and roll, without stopping traffic, or anything . . . NO, are you going up Reserve, NO! which he did, and I beat him, catching the bus, with minutes, to spare, ran into Walmart, got a phone, with literally, a minute to spare, and made it to my hotel, in remarkable time, having purchased a phone too, getting it set up, I am the efficiency queen!  LOL!  But, with the hard parts done, the simple stuff, a given to most people, is a disaster, ALWAYS!

Sorry guys, I could not help eavesdropping in on your conversation, and to my surprise, you were discussing the elections, not girls, football, or something like hiking--just curious what your age talks about, and what guys talk about when they are not with gals, and I was pleasantly surprised to hear you talking about the elections, debating, defending, challenging, some staying out of the fray, others, refusing to comment, maybe for lack of having a valid argument, or without, a good reason for their positions, if they had a position at all.  There were two guys, who started to get into it, and I believe, one was either in law school, or already an attorney, but the one did defer to the man of letters, who promptly admitted that he didn't know the answers, and another guy, saying, don't get me in this debate!  I think they all had a somewhat negative view of the future, America, and that may be a Millenial, Bernie Sanders, regret that their candidate didn't make the finals, or they were listening to the negative views from Trump, but putting their hope in Hillary, who they clearly said, was most qualified, had the abilities to be president, and, while they didn't trust her in some things, they did trust her to run the government, which, I thought was a very mature, more sophisticated, level of thinking, they left the bar, still caught up in the debate, or at least the two most engaged . . . you will get out of this election what you put into it!  You brought me joy, vote your conscience, but have a god damned too reason, for why you are voting for a particular candidate, whether, national or local, your vote matters, so be educated and somewhat up to speed on the issues and the person's plans.  I can be persuaded, but, I refuse to change my mind on any issue, if you do not have a solid, viable, and logical reason or argument!

I swear a lot, and you, reader, knows this to be true, mainly, because I didn't swear, until I reached the ripe old age of 28, and then it felt like having an orgasm, after years of pent up frustration!  I am not offended by the language of these guys, nor by me, especially with a good excuse, that people who swear, release and can deal with 75% more stress than people who don't swear, and because I taught, high school, and these kids were hard core, for sure, had terrible home lives, were either raising themselves or being raised by a young sister or brother, without parents, and barely making it from day to day.  At the beginning of the school year, I had a list of rules, and one was not to swear . . . one kids, said, then I can't talk!  LOL!  Swearing is much more acceptable, today, and the college age crowd, do it with ease and with comfort.  I have always related to the university crowd, and got a kick out of the reasoning behind, voting for Hillary, but I will admit, that I watched an interview between, Rubin, of Rubin Reports, and Roseanne Barr, comedian, or so she used to be, now she is very serious, and very political, but she swore almost every other word, even while saying some really good stuff and promoting her new movie, where I believe she is president, or she is running, right positions on many things, but, seriously, too much swearing and I thought, do I sound like that?  If so, I am sorry, and I will try to do better, there are just times, when, I am venting, sitting like I am at the Break Cafe', thinking, that nobody but me, knows what I am writing!  LOL!  Then all of the sudden, I realize that the world is reading this blog!  Then I get a bit embarrassed by my language, realizing that youngsters could easily, be reading this blog and I hope they are, therefore, I will try to tone it down, after seeing Rosanne, giving me a mirror of myself!  We do owe to our kids and young people to be an example of restraint, and decorum, so, I will try, and that is all I can promise!

One of the best things, I did, back in the 2008 elections, was to watch these CNN specials on the presidential candidates, going back to their early years, to childhood, to their school and college years, and what, elements, historical events, and sparked in a young person's mind, in order to drive them to put themselves, under a microscope to be dissected, and displayed, fileted if you will, for the public, in order to SERVE THEM?  When all is said and done, whomever, wins, they can thank, all the bumps, bangs, cuts and scratches, along the road to the White House, for making them, better people, more in touch, with the lives of the people of this country, their dreams, fears, and then, thank the others, who through debate, challenge, and defense, had to crystalize their positions, to withstand the scrutiny of other hopefuls, going through the same thing.  Even a billionaire, and a political queen, involved in politics, since she was 18, has had to learn, bend, grow, study, prepare and sharpen her debating skills, not unlike she had to do in Congress, but so much more exposed, criticized and publically, held to every word, she says, learning, evolving, as the Donald has had to do too . . . running a company, no matter how large and successful, is not like running for office, with competing special interests, dealing with the other branches of the government, who have control over your destiny as a leader, holding and controlling the budgets, the allocations and even the vote, that can either stop or promote your plans . . . unlike none other to prepare our president!

In Britain, I think, they said, that, from the start to finish of their election for prime minister, it took a mere 28 days, and a very limited amount of money, where in the last month, both candidates have raised, somewhere between $50 to $90 million for their campaigns, and one side of me, thought, why don't we take all that money and put it to better use, but then, as I thought about it, this long protracted, race for the top position in the land, puts the candidates, through the refiners fire, pushing them to the limits, and we all know that, diamonds, are just like coal or something like that, that are put under tremendous pressure, to create this precious gem, much like the pressure the people, the media, and the opponent, put on the one who wins, to make them a better leader all the way around, and then, I decided, no, the money could not be spent in any better way!  We all benefit from, even the dark money, that comes into politics, because, we may sharpen our own skills, in fighting some lame ass position, some rich dude is funding.  The process is amazing, and when it all comes out in the wash, we are cleansed, purified and refined by the two year, bloody, battering experience!  I love it, but I am a fighter!

"MOVING TARGETS"; RACIAL ASSASSINATIONS

This case hits, close to home, due to the fact that it happened, in Salt Lake City, Utah, and it must have happened, when I was out of commission, dying, because, I don't remember the case or hearing about in in the news, but, two young, interracial couples, dating and hanging out for the first time, in Liberty Park, Salt Lake City, Utah, just laughing and joking around, innocent, high school, type fun, with attractions of the opposite sex, two white girls and two black boys, who all knew each other from high school.  It was dark, and all the sudden, one of the boys, fell to his knees, making everyone thing he was playing some sort of game, until one of the girls got grazed in the arm, by a bullet, blazing through the night.  The other black youth, didn't run, he stooped over his friend, to aid him in his dying moments, while the girls both ran for cover and help, with the second boy, being gunned down also, with shots ringing and coming from nearby bushes.  The boys were pronounced dead on the scene and the girls were brought to the police department to answer questions about the shootings.

As the tale of horror, unfolded, it left the detectives, and later, FBI agents, wondering if these hits were racially driven, and who the perpetrator could be?  There appeared to be no witnesses, but the girls, but it was dark, and therefore, no one really saw the, assumed, man, shooting the boys, like target practice, deadly with each shot.  But the more the police heard, the more, they for sure thought that it was about race, and white with blacks, that brought out the crazy in this shooter.  About, three months went by with little to go on, other than to talk to the father, who was member of a biker club or gang, and who was not happy that his daughter was dating a black, but he had an alibi, and all his witnesses, panned out, and he was quickly dismissed as a suspect.  So the cops had no leads, and the FBI was just as stuck, until, it was discovered that there was a prostitute, part time student, who came forward and reported that, back at about the time of the murders, she was picked up by some, southern accent, speaking guy, who had a tattoo, of an American Eagle and on the other arm, and the Grim Reaper, on the other.  The dude, took the young woman, to he motel room where she saw, rifles and weapons, and he joked, about killing some black that walked in is line of sight, but the girl, disgusted and shocked, talked him out of killing the man.  But, he had a red Camera, with special tires, and a very unique paint job, both in and out of the car.  The feds traced the hot car back to this guy named, Joseph Paul Franklin, with several aliases, he used, one of which was James Clayton Vaugh, one of his aliases.  Come to find out, there were similar murders, hits, if you will, in Cincinnati, and somewhere else, unsolved also.

FBI BUILDING THE CASE

Just as suspected, this man was associated with the KKK and the American Nazis, he bragged to the prostitute, about the killing in Salt Lake City, and spoke in clear and plain racist, bigoted, hate speech, against anyone who was black, he was particularly, upset with any racial mixing, between, black men and white women.  The college student prostitute, had also had him, drop her off at her apartment, where, her roommate who was an artist, see what I mean, was able, to draw a composite sketch of the man, between the recollections of both girls.  Once, they were able to get the picture of the guy and his, name, they matched his fingerprints, his real name with the criminal database, which then pulled up a picture of the guy, and it looked almost identical to the picture the roommate of the prostitute had drawn, but they still didn't know where the car was, or the license plate of the car was, to trace where he was at the current time.  The girl was able to tell the cops where the dude had taken her, when they got together, the Sandman Inn, which I am well familiar with.  Now, here comes the really amazing part, that, lends credibility, that in each case, I deal with or watch, there is some amazing, random connection, bringing forth a key piece of evidence, in a very bizarre fashion, as is the case, here.

Okay, so as we all know, when we register at most motels, the manager, usually, has the person put down the make and model of their car, if not their license plate also, as did this 81 year old owner of the Sandman Inn.  Now, as so many people do, especially if they have something to hide, they will use, not only an alias for their name, but, they will give false information, on their vehicle, as did this Joseph.  Now, here is the cool part, this old dude, every night after most of the rooms were rented for the night, would go out into the parking lot and compare, the license plate, that was registered at check in, with the car sitting in the parking lot, and this was because, he said, it never failed, that someone would take a pillow or case, and in this case, the guy left without paying for two nights room rent, so when he found, out while gathering information on all his customers, or patrons, he happened to write down on the receipt, the right state, license plate information, and had recorded it in the margins of the registration and he had that all filed away, so they were able to put a state, driver license, and whatever, together, starting to give some direction in the case!  I think that is amazing, but, it happens all the time, some person, even as old as the guy was, comes up with the killer connection between the car, the driver, and the place he was at, which placed him in Salt Lake City, the night of the murders!

A NATIONWIDE MANHUNT, TWO ESCAPES, TWO MIRACULOUS CONNECTIONS THAT REVEAL WHERE THE MAN IS!

So, the man is caught, and the feds are holding him in some room, waiting to be booked in some small town, and he escapes, even getting back his keys and car, makes a run, and they lose his trail.  I lost the trails, last night for a fucking 10 hours, in the morning, when I resurfaced, I noticed, the trails picked up again, and I was listening to the radio station, the TRIAL!  LOL!  In my particular case, just the opposite side is helped with God Intel, letting you know, that I have either been framed, or there are bogus charges, or their are bull shit, Bush, Patriot Act, fuckers after me with no rhyme or reason to their motives and totally unconstitutional in their pursuit!  So the guy is lost again.  What happens next, is the guy is at another motel, and he has committed crimes in like 8 states, but there is some disturbance, a fight or something at the motel, he is just staying at, and some guy, is particularly obnoxious, pissed about all the noise, the cops and the disturbance in the parking lot, and when he complains, the cops, take his name, and notice it is the man, the authorities are looking for, and not only that, but the car and the license plates, matching the warrant for his arrest, is parked right there too!  So, again, he is capture and put in jail this time, and again, he escapes!

The way this man, made his way across the country, and paid for his killing spreREes, by donating blood or plasma, as a hit man for the KKK, seeing himself as a self-proclaimed, assassin for the Klan, killing any black man, especially what was seen with a white woman!  And as luck would have it for the cops, and the victims, they sought justice for, the FBI had put pictures of his unique tattoos, on his APB or all points bulletin, to help facilitate the capture of the fugitive.  So, the plasma doc, or tech, drawing his blood, noticed the two very bizarre and telling tattoos, and called the cops, who immediately came and picked him up.  This time, they made sure he didn't escape, and he finally, admitted to al the murders, copped to the two in Salt Lake City, Utah, but never would admit to the ones in Cincinnati, Ohio, for some odd reason.  But, the trial took 5 days, and the prosecutors, U.S. attorney generals, did not charge Joseph with murder, because all they had was a circumstantial case, so they charged him with violating the federal statutory and constitutional rights of the victims, and it only took the jury, like 15 minutes to convict the man, to 99 years, for civil rights violations, and I can't remember, if that was eventually changed to the death sentence, when he admitted, 17 years later, that he had killed some other blacks, around the country!  BLACK LIVES MATTER!

Sometimes the civil rights charges, are tougher and longer, than murder charges!  I know, I used both, U.S.C, or United States Code, Title 42, Section, 1983, the most traditional civil rights charges, but, if I remember correctly, on the Cheek case, I also, charged for a Section, like 238 for conspiracy, and shizam, you didn't have to show much of a connection to prove, there was a conspiracy, and that made the punishment and charges even more wicked, which is what the fucking cops and prosecutors should be charging, their buddies and buddettes with, who have violated, almost every civil and constitutional right I have, including up and to, attempted homicide!  For the life of me, I don't know what they are waiting for?  Fuck, I guess for me to die, to protect the criminals and perps!  Shit!  Anyway, some amazing evidence used to break the case, open, coming in very strange ways . . . God Hates INJUSTICE . . . the waters of justice, tend to flow towards the TRUTH!

REVELATORY EVIDENCE OF WHITE POWER, DISCRIMINATION, PREJUDICE, WHITE SUPREMACISTS, AS CLIENTS, FAMILY, COPS, AND THE AFFECTS THAT HAD ON, THIS DOUBLE TROUBLE I AM HAVING . . . I AM TIRED, SO I AM JUST GOING TO BULLET THE PROBLEMS AFTER WATCHING THIS CASE!

• Shelley, older sister, aka, claiming to be me, using my attorney status, going way back to the time I was poisoned, in 2000, if not before, after I killed asset forfeiture, and Bush was in office, with nightmare Cheney, and the new found power tools in the Patriot Act that were intended for terrorist, now all the sudden being, reversed and being applied to U.S. citizens, calling people homegrown terrorists, enemy combatants, subversives, enemies of the state!  But, Shelley was beaten up by a black football player in college and had to drop out of college for a semester, and while she never talked to me about this incident, I did hear my parents, claiming to not be prejudice, but I the same breath, saying, what will the neighbors think?  I am not sure what her teachings to her children were, but, I know, that both her kids and mine, messed around with the Straight Edge Gang, with white power ideas, and very prejudice and potentially violent.  My sons were young, and once I talked to them once seeing, swastikas on their hands, in pen, I told them what they meant, and that I prefer they not get involved with gangs, and for what I saw, they dropped the whole idea, but I can't vouch for Shelley's sons, Jesse and Isaac?  I do know that Jesse, got way into studying and collecting, WWII paraphilia, loved the history, and so?  I do believe that Jesse's death was staged, and feel strongly seeing what Shelley had done, that, Jesse could be an assassin and he would not surprise me, if he were very prejudice, that would fit, in fact, in the true crime episode, the killer, originally looked like my oldest son, Chris to some extent, blonde, longer, curly hair, thin, but at some point, when the assassin was on the run, he changed his entire look, and he looked just like a thinner version of Jesse!  I remember, Jesse once saying, that of all the people on earth, he would love to put, Chris's face on a huge ass tattoo on his belly?  Very bizarre . . . I think, Shelley took my place, Jesse took Chris's, and Isaac took, Elliot's, and we were all framed, to protect the guilty and hurt the innocents!  Did Jesse get credit for Chris's electronic music, like Isaac got credit for Elliot's heavy metal and rock? and Shelley, got to be ME?  The magic and illegal activity of the CIA Make a Wish Foundation!
• Austin Cross . . . Allan Rex Bess, aka, Frank of Interpol, I look at the very symbolic nature of the two names this killer went by: Joseph Paul Franklin, or Frank Lying!  Paul was the name of the U.S. attorney, who had to be deep in this shit, for it all to fly, because I went against him in my case, representing one of the plaintiffs, in the $56.7 million Iron County Corruption case, and I know for a fact that, Iron County Attorney, Scott Garrett, and Narcotics Task Force head, Officer McIntyre, both worked closely with Paul Kohler, and is would be hard for him to side with the right team, after I beat his ass, and went above his head, on a case, he knew there was not evidence to prove anything, plus, the charges, against, WHITE POWER, Travis Braun, who had a tat on his elbow that said, just that, and also one of the plaintiffs in the hot case, that all cops are familiar with, a huge ass civil rights case, largest in the nation besides my one against the state of Utah!  But, Allan, aka, Frank, to be referred to as Frank, was to take Allan's place, while Shelley took mine, and this little coupe would be all in the family, a total switch, with Frank one of the most prejudice people I have EVER MET!  Frank is German, and he hated President Obama, with a passion, I have rarely seen in anyone before, so much so, that I was shocked, and dismayed by his blatant racism, and disrespect and I expressed my disgust, in one of the most vicous and putrid attacks, on a very not deserving President, in fact, I thought I had gone back, 50 years, with one of Hitler and his SS men, so a big ass contributor to the exchange!
• all the Cheek family were racists, white power people and hated, Tristan Lameroeaux, and they got pissed when, I started to represent Tristan, and he told me that Haylee Cheek used to yell, white power, racist things, through the vents at the Iron County Jail, and I didn't learn that, until, after both Haylee and Tristan were in the Utah State Prison!  Tristan was marked for a gang hit by Aryan Nation gangs, and they were contacting me for representation, Tristan was stabbed 13 times, while in the gang unit, that he warned me about, and I tried to get him into protective custody, in the prison . . . I think he is in the witness protection program!

(2) IN A VERY SIMILAR SITUATION, IN A SECOND CASE, ALL THE PLAYERS, FROM THE COPS TO THE PROSECUTORS, TO THE JUDGE, I BELIEVE, AND I DON'T KNOW THE FACTS, WAS NOT ON THE JURY, BUT, A MAN, WITH A DOMESTIC, AS I RECALL, WITHOUT STOPPING WRITING, TO CHECK, GAMBLES ON HIS FREEDOM, HAVING SERVED 19 MONTHS, FOR ALLEGEDLY, ASSAULTING A PUBLIC SERVANT AND THREATENING TO KILL POLICE OFFICERS, COULD HAVE WALKED FREE, WITH TIME SERVED, CONSIDERED, BUT, HE REFUSED THE PLEA BARGIN, WENT TO TRIAL, WAS CONVICTED, AND THE JUDGE SENTENCED HIM, TO 40 YEARS IN PRISON!? WHAT THE FUCK? IT IS NOT A CRIME, TO DEMAND YOUR RIGHTS, NOR IS IN A CRIME, OR A NEGATIVE THING, TO REJECT A PLEA BARGAIN, AND PEOPLE, WHO EXERCISE THEIR 4TH, 5TH, AND 6TH AMENDMENT RIGHTS, TO GO TO TRIAL, SHOULD NOT BE PUNISHED, AND IN THIS CASE, AND I AM NOT STANDING IN JUDGEMENT OF THE JUDGE, BUT, IF YOU WERE WILLING TO ACCEPT A PLEA BARGAIN, PRESENTED BY THE PROSECUTOR, FOR TIME SERVED, AND LET THE MAN, WALK THE DAY HE TOOK THE DEAL, IT SEEMS, LIKE CRUEL AND UNUSUAL PUNISHMENT, AND UNDER THE UTAH CONSTITUTION THAT i AM MOST FAMILIAR WITH, IT APPEARS THAT UNUSUAL RIGOR WAS USED AGAINST A MAN, WHO JUST WANTED HIS DAY IN COURT? HE WAS NOT JUST PUNISHED, HE WAS BLUDGEONED TO DEATH, 40 FUCKING YEARS? THE GOAL OF THE CRIMINAL JUSTICE SYSTEM, IS REHABILITATION, AND THAT, INCLUDES, SEEING THAT JUSTICE IS SERVED, NOT PUNISHMENT METED OUT, FOR SIMPLY NOT AGREEING THAT, YOU DID ANYTHING WRONG! I HAD A SIMPLE DOMESTIC, WHERE THE HUSBAND, REFUSED TO TAKE A PLEA BARGAIN, BECAUSE, THAT WOULD PUT IT ON THE RECORD, THAT HE DID WHAT HE KNEW HE DID NOT DO--HIS WIFE, HAD KICKED A GLASS END TABLE, TRYING TO INFLICT INJURY ON HERSELF, SO IT LOOKED LIKE HE DID IT, BECAUSE, SHE WAS SUFFERING FROM POST PARDUM, DEPRESSION AFTER GIVING BIRTH TWO MONTHS EARLIER, AND SHE WAS FLIPPING OUT, THREATENING TO KILL HERSELF AND THE BABY TOO! PROSECUTORS OFFERED HIM A PLEA BARGAIN, OF 4 YEARS? FIRST OF ALL: (1) HE DIDN'T DO IT, THE ABUSE, SHE DID; (2) SHE HAD NO MORE THAN A SMALL CUT TO HER FOREHEAD, SELF-INFLICTED, SMEARED BLOOD ALL OVER HER FACE, AND RAN TO CALL THE COPS AT A NEIGHBORS; (3) HE HAD TAKEN ALL THE FIREARMS OUT OF THE HOUSE, THAT WERE UNDER THE MATRESS, SO HIS SUICIDAL WIFE, WOULD NOT HARM HERSELF, AND WHEN THE WIFE CALLED, SHE TOLD THE COPS HE WAS ARMED AND DANGEROUS! (4) WHEN HE CAME OUT OF THE HOUSE, AS THE COPS DEMANDED, HE WAS CARRYING HIS TWO MONTH OLD BABY IN HIS ARMS, WHEN THE COPS, DEMANDED THE BABY BE GIVEN TO THEM, THEY ARRESTED HIM, AND THEN BEAT THE SHIT OUT OF MY CLIENTS, TAKING 18 STAPLES, TO PUT HIS SCALP BACK TOGETHER, WITH PICTURES OF THE COPS, SMILING WHILE THEY BEAT THE HELL OUT OF AN INNOCENT MAN, WHO JUST TRIED TO PROTECT, HIS FAMILY, FROM HIS WIFE'S TEMPORARY INSANITY! (5) BECAUSE HE REFUSED THE PLEA BARGAIN, WHICH WAS WAY HIGH, FOR WHAT HAPPENED, AND ON TOP OF THAT, HE HAD CIVIL RIGHTS ISSUES WITH THE COPS, SO HE WOULD NOT TAKE THE DEAL, AND HE WANTED HIS DAY IN COURT, TO PRESENT HIS SIDE OF THE STORY, AND FACE HIS ACCUSERS! HIS RIGHTS, ALL! (6) BECAUSE, HE CAUSED THE PROSECUTOR AND THE JUDGE, A DAY IN COURT, THEY WOULD TAKE HIM IN, DURING JURY BREAKS, AND THEY WOULD WATCH, AS THE COURT BALIFFS OR SHERIFFS, ON DUTY, BEAT THE SHIT OUT OF HIM AGAIN, TO GET HIM TO TAKE THE DEAL--THEH WIFE'S FATHER WAS VERY POLITICALLY CONNECTED, AND HE WANTED TO USE THE CASE, TO MAKE A STATEMENT AGAINST GUNS! (7) WE WAS CONVICTED, RIGHT OR WRONG, AND GOT SENTENCED TO 8 YEARS IN PRISON, FOR WHAT, COULD HAVE BEEN DOCTORED WITH A BUTTERFLY BANDAID! NOW, THERE IS NO EXCUSE FOR ABUSE, BY HUSBANDS, WIVES, OR COPS! BUT THE MOST INNOCENT, OF ALL WAS THE HUSBAND, BEING THE KING OF HIS CASTLE, THIS WAS HIS FIRST BABY, HE LOVED HIS WIFE, AND SHE HAD TWO OTHER KIDS, FROM A PERVIOUS MARRIAGE HE WAS TRYING TO PROTECT, FROM SEEING THEM FIGHT, WHEN HE CARRIED HER INTO THE BEDROOM WHERE THE INCIDENT HAPPENED! (9) AS HE DID HIS TIME, HE CONTINUED TO DEMAND HIS RIGHTS, HE WAS PUNISHED BY THE GUARDS, AND MOCKED, THROWN IN A RACE RIOT, AT PLEASANT VALLEY PRISON, TRAMPED ON, WAS PICKED UP BY THEH GUARDS, AND LITERALLY THROWN, AGAINST THE WALL, WHEN THE GUARD, WAS ASKED BY NURSES TO HELP GET THE INMATE ON THE GURNEY, HE SAID, I WILL SHOW YOU, HOW WE TREAT GUYS LIKE THIS, MEANGING, SOMEONE WHO IS SEEN AS A PAIN IN THE ASS TO THE SYSTEM, REFUSED TO PLEA TO WHAT HE DIDN'T DO, AND THE ABUSE, CONTINUED, UNTIL HE WAS A PARAPOLIGIC, IN A WHEEL CHAIR! SENTINCING, SHOULD NOT BE SO EXTREME, LIKE GOING FROM 19 MONTHS, TIME SERVED, BEING WILLING TO SET THE MAN FREE, THEN LEAPING FROM ONE EXTREME, OT THE TOTAL OTHER END OF THE SPECTRUM, TO 40 FUCKING YEARS! IT SOUNDS, LIKE THE MAN, THREATENED, THE OFFICERS . . . ASSAULT CAN BE JUST A VERBAL THREAT, AND HE SAID HE WOULD KILL THE COPS! NONE OF THIS IS GOOD, BUT, 40 YEARS? IT IS TO SEE THAT FROM A TO Z, JUSTICE IS SERVED, WHETEHR THROUGH RESPECTING CONSTITUTIOAL RIGHTS, TO FOLLOWING POLICE POLICIES AND PROCEEDURES, TO THE PROSECUTOR, EITHER PROSECUTING WITH JUSTICE IN MIND, OR DECLINING PROSECUTION, IF THERE IS NOT SUFFIENT EVDIENCE TO PROVE BEYOND A REASONABLE DOUBT THAT A CRIME WAS COMMITTED. I HAVE SEEN VINDICTIVE AND MALICOUS PROSECUTION, USED, WHEN SOMEONE WILL NOT TAKE A PLEA OR MAKE STATEMENTS THAT ARE NOT TRUE, BECAUSE, THEY ARE HONEST! I FIND, THAT WHEN EVERYONE, DOES THEIR JOB, OPENLY, IN SUNSHINE AND TRANPARENTLY, DOING THE BEST HUMANS CAN DO, UNDER THE MONETARY AND TIME CONSTRAINTS, EVERYONE FELLS GOOD, EVEN A DEFENDANT CONVICTED, KNOWING THAT SYSTEM WORKED, AND THEY GOT THE BEST SHOT THEY COULD GET! EVEN LOSING, IF THEIR SIDE OF THE STORY OR INCIDENT WAS TOLD, PUTTING FAITH IN THEIR ATTORNEY AND THE JURY, THEY CAN ACCEPT WHAT HAPPENS TO THEM! PUNISHMENT IS NOT THE GOAL, A TOTAL WIN RECORD IS NOT THE GOAL, SEEING THAT JUSTICE IS DONE TO THE BEST OF OUR CAPACITY, IS THE GOAL, FOLLOWED BY A JUST SENTENCE, AND PROTECTION, WHILE SERVING TIME OR SET FREE, IF SUFFICIENT TIME IS SERVED!
