I.D. Network . . . White Woman Swapped For Black Woman Who Worked in the World Trade Center and Her Fiance' Who Died in the Plane Crashes on 9/11

Back when I only had a theory, that someone had stolen my identity, I turned on the T.V. one night, not being much of a T.V. watcher, and saw my first I.D. Network or Investigative Discovery.  At that time, I had not worked, having been told, back in 2000 that I had a terminal brain disease, with no cure, and would be dead by 2002 . . . by this time, it was about 2007, so I had outlived my diagnosis, and was not dead, but really was not quite alive either, having just waited to die, for the last 7 years.  But, this program came on, and showed, who this white woman, who had never been involved in the 9/11 crisis at all, had somehow, stolen the story of this black woman, who not only worked in the towers and was present the day they went down, but she was also engaged, and her fiance' had been killed in the crash, or the aftermath of the world trade tower incident.  This other white woman, had become so known for this tragic story of the black lady, that she had become, literally a spokesperson for all the victims of the tragedy.  The white chick, had been introduced to President Bush, she hung out with Mayor Giuliani, and had become a well known speaker and person, who attended many of the ceremonies, fund raisers, and funerals of the other victims, all the while faking, that it was she, who had suffered from the incident, and that it was her who lost the fiance' and so forth.  

This fabricated lie, and who's instigation, continued for about 5 years, until, one day the black lady heard this white woman telling her story, and took it to authorities, who later, arrested the woman, and brought her to justice for the lies . . . this is much the same as has happened to me, but I have known, all along, or had a suspicion, that they was happening, starting with an older neighbor of my sister's, who just kept calling me, Shelley, and Shelley, me!  I thought that was strange, since, Shelley and this woman had been neighbors for some time.  Next, Shelley, tried to have me arrested, or did have me arrested, for going to the restroom at the local elementary school, even with approval of the secretary, who had given permission to use the public school restrooms, on at least 5 other occasions.  Shelley seemed to be tight and in cahoots with the cops, who would always call her, if they stopped me on the street, or they seemed to be doing her bidding, and at this time, they arrested me and took me to jail, in Cache County, if I remember, for allegedly trespassing at the school, going to the restroom.  Shelley, due to my pending death, had access to my bank account, and would not pay the bail, saying, along with my parents, that they were going to leave me in jail for life!  I was like, ah, that is impossible, this is going to the bathroom with permission . . . that didn't seem to matter.  Finally some guy Shelley was dating, John Schuster, bailed me out, shocked at what was going on, and Shelley went ape shit!

This was just the beginning.  And readers who have followed this story, know, that next was a identity theft of my son's band, God's Revolver, Hard Rock Band of 2008, and as I got back into the practice of law, realizing that I was not dying, and got my license reactivated October 1, 2009, taking my first case, Brock et al vs. Herbert et al, up to the 10th Circuit Court of Appeal, the deal, and then the steal, at the U.S. Supreme Court, about 20 other high profile cases were also stolen, to my work on the medical marijuana, the water compact, testifying at the legislature, to speaking at the statewide, Federation of Republican Women, and on to my blog.  I am here to tell you, that no matter who I tell, who reads this blog, and what authorities are contacted or made aware of this fraud, on all accounts, with a blog of over 200,000 pages, of not only my story, but on Constitutional issues, news, current events, and politics, these fuckers are allowed to steal, rob, fraud, lie, and kill, in at least 25 cases, and nothing is being done about it . . . this is the preface for the story, I first heard about, 2 years ago, and at the Republican Pachyderm Meeting today, was able to here the mother of the young man who was murdered in Singapore . . . I think.  We are being destroyed from the inside out . . . something needs to be done, or we will lose who we are as Americans, these are not real stories that should be happening to American citizens, and people in authority, need to help!

Hard Drive

Several years ago, while I was fighting to literally, be me, taking 24/7 effort, to pull that off, after a ten year hiatus due to being told I was going to die, now, looking back, that was true, but not for the reasons, that I was told, not for a terminal, genetically contacted, brain disease, but due to a government plot, to take me out of commission, worried that I would run for attorney general, and be the boss over all the cops in the state, as the top law enforcement agent in the state, if elected, thus poisoning me, with a man-made substance, that mirrored or resembled, or I was just told, was Pick's Disease, or the deterioration of the frontal lobes of the brain . . . all bull shit!  But, at the time I first came up to Kalispell, again, not knowing that I was being shadowed and followed, with a double, mainly sisters, and another attorney, jumping in wherever I showed up, with them working in concert with cops, to run me out of the jurisdiction, having post traumatic stress disorder, having first been poisoned, then having my life being threatened on several occasions, being falsely incarcerated, and chased, since the day I got sworn into the United State Supreme Court, well aware, that going back to be sworn in was a race between me and the double, standing in for me, without cause, reason, or legal standing to represent me and totally against my will, but in 2012, I believe that is when I heard about Mary Todd, and her son, Shane, who was found hanging on the back of the bathroom door, in his apartment in Singapore, while working for a high tech company, and being scared that he was involved in some type of security breach, and being pressured to give technology secrets to the Chinese!

I remember the authorities stating that this was a suicide and that Shane was depressed, and thinking, oh, hell, no, he was murdered!  I had too much experience with the government, with secrets, with agents being brought into my small Utah town, to conspire with local cops, prosecutors and judges, to take me down, and stop all my cases from going forward!  I had to get to this woman and tell her of my experiences, believing full well, that at some point, in this new state, that I would be able to convince, the powers that be, that I was the one and only, JoAnn S. Secrist, J.D., and that there were doubles, impostors, and that they had stolen my identity . . . I found, not only was that harder than I thought to prove, but the locals were participants in the fraud, cover up, and bull shit, promoting sisters, other attorney, in stuff they knew full well, that I had done, not the double!  Due to politics, differences, or that they just like her, or their hair better, or their dress better, or they thought she was nicer, or was more Republican or a better Democrat, with me being on neither side of the isle, but about where an educated analysis of the Constitution would fall, they chose to be part of the cover-up!

A Family's Fight Against Three Countries . . . NO SHIT!

This is not surprising to me at all . . . as Mary filled in many of the details of her son's murder, defensive wounds, evidence of two other people's DNA on the noose that he allegedly hung himself on, signs of moving, after quiting his job, boxes, packing, etc., telling his mother that he believe that there were big security breaches that could hurt America and aid the Chinese in stealing our technology secrets, telling her that he was coming home and even warned her that he was worried for his life, even after all this, the authorities, did little to help.  She did say that our Congressional delegation, in particularly, Senator Baucus, who, just up and low and behold, got made Ambassador to CHINA, was very helpful, until he got his new appointment, then due to a conflict of interest he couldn't help any more!  Any connections, to a guy who said his only qualification for this position, was his game of Chinese Checkers!  And an even more curious connection for me, is the fact that before that, it was former governor of Utah, Jon Huntsman . . . I have my suspicions, why these secrets were being given to China.

China as the New World Leader . . . President Connections, Selling Navy Bases, Spending up the National Debt, Putting it in China's Hands, the Chinese Olympics, Ambassadors, Mormon's, Mitt Romney, Etc.

This is coming from within America!  President George HW Bush, had particularly close ties with China, not sure what they were, but I have read or seen videos of the fact that he is connected . . . Yale,  Skull & Bones shit?  Then you have President Clinton, selling an old Navy port or base to the Chinese, and who in their right mind, would let, China of all countries, not even an ally, with more people in their military, about 400 million, with our entire population, about 330 million, hold our debt in their hands . . . does this make sense?  And then, came the Chinese Olympics . . . we all know the Romney connection to the Olympic Committee, allegedly cleaning up the Olympics and putting them on the straight and narrow path . . . Romney spend or was given, 7X the money of the previous Olympics.  Then you have the Mormon connection with former Governor Jon Huntsman, being made Ambassador to China, a former missionary who spoke Mandarin, so at least he was more qualified than Baucus, but the connections are to spurious, for my liking. Then we have the UK, PBS, special, a documentary that was to aired, the day after, my Brock case was terminated, just up and poof, gone, nada, and the money went to Mitt and the Mormons!  

I remember, Henry S. Brock, in a meeting, before the case was finished, and his business plan, called MUTUAL BENEFITS . . . and him mentioning that he had dreams of having the BROCK name, hanging on a building in Shanghai or Singapore!  Big dreams of going over to Asia, and at who's determent?  What deals had been cut, what back door cover-ups, what FBI and CIA, Mormon China connections, sons who served Mormon missions there?  What in the hell is going on with China, and is America getting sold down the tubes, and the next world, super power, is going to be China.  The Yen, or it was said at one time that Brazil, India and China, were the new growing economies . . . then you had Bush, W, and the economic melt down, and the selling of Lehman Brothers to London, home of the world bankers, and also, the dollar was no longer to be the common world currency . . . on and on!  Is it any wonder, that these All American boys . . . Mary told us today of another Ph.D, and son of a woman in California, who ended up allegedly dying of natural causes, just 2 weeks after he got to China!

Analogous Comparisons To Greek and Roman, Mythical One-Eyed Monster and the Modern National Security Agency, PRISIM Program of Meta-Data Gathering!

Cyclopes were mythical characters, giants in form, with a single eye in the center of their forehead, with a foul disposition, synonymous with brute strength and power, and their name was invoked in connection with massive masonry.  This breed of gigantic monsters, with one eye, were guarded by a female, named Campe, and they were known to have fashioned the thunderbolt for Zeus to be used as a weapon.  Now, what in the hell do cyclopes have to do with the National Security Agency?  Well the second, I heard that a U.S. federal court had ruled or held that the Patriot Act, does not allow for the large meta-data, gathering that the NSA has been doing, forcing, literally, with many providers, trying to protect account holders, and even some providers opting out of the business, rather than to allow the NSA access to their clients or account holders information, my mind for some bizarre reason, connected that with the mythical monster, the cyclopes of ancient Roman and Greece, the Iliad and the Odyssey, of Homer, in size an magnitude of what the court just did, literally slaying the monster, in my mind, and putting out its big ass singe eye in the middle of its forehead! 

I don't know when you watched the movie, Enemy of the State, with Will Smith, produced back in 1998, nonetheless, but I recently viewed it and was shocked that it was about the NSA and legislation connected to it.  Now, I knew of the thousands of people a day, added to the NSA to watch list, and about the spying on America, even on generals serving their country, to the point of listening in on their pillow talk with their wives, or mistresses, but for some reason, I guess I just didn't put all this together, two and two, and what the hell was and is going on.  I knew that I had long been a target of the NSA, and with no doubt a member of their to watch list; however, I don't think, even with Edward Snowden, that I fully comprehended the extent and the nature of the NSA activities, separate and aside from the constitutional violations that were glaringly apparent to me, if not to the federal court! 

Back Door Man 

I always have this suspicion, with the passage of blatantly unconstitutional legislation, like Montana's water compact, or standing in U.S. federal district court, arguing the 4th amendment, and having a federal judge, say to me, Ms. Secrist, you are not winning any arguments with me, using that line of reasoning or argument . . . my response, then, your honor, you have just thrown the U.S. Constitution out of your courtroom! As my clients, watched with fear and trepidation, as the judge didn't seem amused . . . nor was I at his lack of acknowledgement, to an argument, that two months earlier, while being sworn into the U.S. Supreme Court Bar, the Supremes actually, in my mind, having filed my brief, with the same arguments the Court used in U.S.A. v. Jones, taking them from the brief I filed almost a year earlier in the Brock securities case!, that there isn't some covert effort, by government, law enforcement, Congress, the courts, and whomever, to get rid of this pesky document we call the Supreme Law of the Land or the Constitution! 

While knowing damn well, they are not going to get away with a full on frontal attack of the U.S. Constitution, they are just refusing to acknowledge it, vote against or for legislation that requires that they do one or the other to preserve, defend and protect the document, that has withstood, 240 years of legal scrutiny!  I am frankly shocked, and the aberrant behavior of people sworn to uphold, protect, defend, preserve, obey, and whatever, who are so callous and thoughtless as to just blow the grand old document our their unreal asses!  It is almost like an in your face type attitude, that regardless of what they took an oath to do, they are not going to do it, or are pledging allegiance to a foreign flag, or set of standards and mores, that are not part and parcel of the Constitution, but something other than what we are expecting. 

Terrorism Was the Goal of the Patriot Act, Responding to 9/11 . . . Somehow that Morphed, Like Kafka's Metamorphosis, Into Some Giant Cockroach, Being Turned and Used Against American Citizens

What should have been a creature created with two eyes, one distinguishing and addressing terrorists, and the other, being filtered through Constitutional glasses, lenses or contacts, and making that difference, not only felt but seen, one eye in dealing with terrorists, who don't have Constitutional rights, protections, and privacy, and the other, clearly recognizing, that if there is cause for concern, that citizens, have all the rights, protections and freedoms, afforded and provided under the U.S. Constitution; however, those two eyes have morphed into one monstrosity of an eye, focusing the same on both terrorist and citizens!  The cyclopes were connected with massive masonry . . . brings me to the thought of the masonic order . . . once when talking to a friend and clients, father, who was very connected with Homeland Security, FEMA, Search and Rescue, told me, when I inquired, how these guys could have taken the same oath of office I did, and we could be enemies, and he said, they took what they felt was a higher oath, and that was to the masonic order!  Get the fuck out of our country, that is not our system, nor where your allegiances should be!

Zeus could be looked at as symbolic of the President, and the cyclopes are fashioning thunderbolts to be used as weapons for Zeus . . . again, is there a comparison?  My blog for instance, has been dinged, from 155,000,000 hit/results per 54 seconds, back last February, with intervals of 95,000,000, 65,000,000 and so on, to the point, that Google, was putting a limit or cap on my blog, at roughly 1,500,000 per 54 seconds, then that bumped into bing, which started up where around 25,000,000 per roughly a minute, and that was then cut in half, then topped off at about 220,000 per the same time frame, so I started to go onto Yahoo, and hit, 30,000,000 per about 35 seconds, and mentioned that my numbers, for my first amendment rights are back up and happy about that, next thing I know, they are capped off at, again on all search engines, about 230,000 hits or results . . . hell, my hits or results, my pay for writing, they already take the money, I just dig knowing the readership . . . were at 13,000,000 per 60 seconds, the 3rd week I was writing back in 2013!  

The one-eyed cyclopes of the NSA, used lightening bolts, to slam my blog!  The government was created by men, not the other way around, the PEOPLE were not created for the government.  The primary role of the government is to protect the rights of the people!  It is my first amendment right to freedom of speech to redress grievances with the government!  I am free to say what I want.  Regardless of how high my numbers go, worldwide, it is not in the power of the government to thunderbolt my blog!  I think they decided they would provide me with my first amendment rights to free speech, by giving my blog lip service . . . oh, we are not totally taking you off the Internet, which they have done on several occasions, we are going to let you write, but we are going to not only steal your work, your money, at a penny per hit, pretty handsome sums, regardless of me swearing off the money, in exchange for your trust!, they are going to deny me the satisfaction of seeing the numbers of readers that my blog is bringing in! That is taking away my 14th amendment, liberty right, and my ninth amendment, right to privacy to know what my numbers are!  WE THE PEOPLE are entitled to all our constitutional rights, not just the ones you think we are entitled to or the ones you feel like giving us!

U.S. Attorney General, Lynch . . . Patriot Act 215 is Vital to Fighting Terrorism and Keeping the Homeland Safe . . . We Can Make It Work Within the Confines of the U.S. Constitution!

This morning on the news, AG, Loretta Lynch, yeah, took the stand in I believe, Senate hearings on spending for the Patriot Act, which is fine to be used against terrorist, who don't have constitutionally protected rights, but the portion of the law, 215, the notoriously controversial section of the Patriot Act, has been misused and abused, being found, down right illegal by the federal court yesterday!  Congress needs to take a look at the Act, and at that section . . . we do not need to throw the baby out with the bath water, but we do need to fix the law, making sure that the Constitution is followed, and that the NSA and other spy agencies, do not treat citizens, like terrorists!  At one time, President Obama, extended to world citizens the protections of the United States . . . I would say that is a little if not a lot, out of his jurisdiction, duties and responsibilities as President, as outlined in Article II, of the United States Constitution!  We are sovereign nation, and we intend to stay that way . . . hang the one world order . . . we don't want it!

I think the Bush plan was to lower the United States to a third world status, breaking it economically, trashing the Constitution, that has worked, treating it as merely a damned piece of paper, and do what is the government's forte', to break it, then remake it, in the image they wanted, a one world order!  The two things that stand in the way of the one world order, are the Constitution and Christianity . . . and there has been a war on both!  I am glad that the Congress has to re look at the Patriot Act, which has a due date of June 30, 2015, and make the necessary changes in the program, or get rid of the whole fuckin' thing! I heard a few cops, from very high up on the cop food chain, speaking after the Baltimore, Freddie Grey thing, with 6 cops getting indicted on up to murder charges, and they said, what happened with the Patriot Act is that it gave the cops a way to cut corners!  Warrantless searches, writing their own warrants, letting cops go in people's houses while they are not home, not reading Miranda, letting cops lie on the witness stand, letting actors and actresses take the place of witnesses in FBI cases!

Look where the short cuts got us . . . cops feeling they have and had the right to gun down citizens, merely for looking at them!  We had unarmed black men getting gunned down for cigars, tail lights, selling already taxed cigarettes on the streets, etc., blah, blah, blah!  Just like in the world of professions, THERE IS NOT SHORT CUT TO SUCCESS!  Congress, you need to get with your legislative counsel, your Attorney General, and make this work, to protect the homeland, yet protect the rights of the citizens, we are not the enemy!  Go after ISIS . . . if you have some hopped up cop, send him on special missions to take down ISIS!  Good God, we don't want that here, we are not terrorist, a constitutional law attorney, does not belong on the NSA to watch list!

Montana Mothers Are Heat Packing, Fly Fishing Gals!

I dig the fact that the women, me, not one of them, are just as likely to have a gun, as their husbands.  With an average of 27 guns per household in Montana, mom, is just as adept at shooting, hunting, and generally fishing as her man.  The first year, I was in Montana, a grandmother, a couple of her daughters, and several kids, cousins, nieces and nephews, all garbed out in Cabala's hunting gear, told me one of the youngsters had just shot their first deer, and everyone but the niece, had their deer for the season, and they would continue to take her out, until she got her deer!  We were all sitting at Subway Sandwich Shop, in Walmart, and I kept looking around for their husbands . . . oh, we are not with our husbands, we just take the kids out on our own, the husbands had to work and they, the females could take the kids out, and catch some fall afternoon sunshine, before the sun went down.  Right on!  They offered their services, and said they would be glad to teach me to hunt, if I would like.  They seemed like a lively, fun group of gals, with a few teens in tow.  This is Montana!

I loved it this morning, when riding on the bus, to hear the advertisement for the concealed weapons permit and fly fishing classes, that came in a package along with dinner and door prizes, and night out for mom and her friends . . . holy shit, I love this place!  I was not raised this way, but I dig the hell out of it, and love the fact that the females are so independent.  The bus driver, Sam, informed me, proudly, that his wife, is a far better shot than he is, some tiny, little wife, who goes target shooting with him and enters in competitions. Other guys I have met, have wives that are champion sharp shooters, and they are as proud as they can be. I love the culture, and the freedom, that these frontier women have . . . I say that, with all sincerity, because, so much of Montana is wild, open, rural, and deserted, being the 4th largest state, with only barely 1 million people, it is not very populated!  So, much like in the early days, of homesteading and pioneering, these women have to be able to protect themselves, and their children, from intruders, both of a human kind and of an animal nature, with bear, mountain lions, moose, and whatever, that might come through their front door.

In fact, in the mornings, on Monday, Wednesday and Friday, I take a water aerobics class, at the Kalispell Athletic Club . . . room to grow here too!, and one of the exercises, is called, circle the wagons, in which we have our arms up in the air, like we have a lasso, in our hands, and we are trying to rope a cow or something.  When the teacher heard I was from Utah, I think she got a bit self-conscious, and said, that I guess that is a funny name, but I couldn't think of another one, to describe what we do, and it used to be called, ride a cowboy! until her mother came to visit the class, and told her to change the name . . . but, that would fit the Montana cowgirls, save a horse, ride a cowboy!  LOL!  I did get a kick out of the exercise, and thought the name, was one that you would only find in Montana!  Gotta love this Montana ride!

Day of Reason . . . Reason to Celebrate!

This will appear to be an oxymoron, but, the glory of God, is intelligence, even though, many of the members of this group, do not believe in God, or reserve the right not to believe in Him/Her, and are big time into the secular approach to life, society, and national rule of law, and they are right, we are a secularist country, and the founding fathers set their individual religions at the door, to do what was best for all of society, America, if you will, regardless of religion, and whether or not you practiced any religion at all! Under the first amendment, you are free to practice religion and free from the practice of religion if you don't want to practice or believe, that is all up to you.  Some of the things the local Rationalists or Flathead Secularists have done, it to fight to get the statue of Jesus taken off the grounds up at the ski resort in Whitefish, that case is up on appeal, because the district court, if I remember, said that it was put there by the Knights of Columbus, and at the time it was private property, and it had been grandfathered in, and therefore, it was not subject to first amendment challenges.

They, Flathead Secularist or Rationalists, recently were involved up at the Montana legislature, stopping the bill that proposed that creationism be taught as part of the public school curriculum, and they also, got an injunction against the local high schools, a few Christmases ago, from being required to perform during the Holidays at the Church of Jesus Christ of Latter-Day Saints, or the Mormons, Christmas celebrations and nativity displays, making it mandatory for the students to attend the concerts, making their grades, dependent on the participation in the Christmas pageant . . . they, the schools were also using school property, buses, and teacher time, to get the students to perform in the religious concerts.  It would have been okay, had the Mormon church, invited students, to join in a concert, on their own, so that members could, and non-members didn't have to perform, having no consequences on their grades!  By forcing the students to perform, and only for one religious denomination in the Valley, it smells of establishment of religion!  Can't do that, so good work, Secularists!

Quest Speaker, Renowned Scientist . . . Science: (1) Meaning; (2) Purpose; and (3) Value

Within the context of reason, we all think that we have the ability to reason, which is a problem solving activity, to avoid risk, injury, protect others, and to do the right thing.  There are two types of reasoning: (1) justificatory reasoning . . . justifying our beliefs or the reasons we feel and think the way we do, and; (2) explanatory reasoning . . . used to explain what we observe, like B is the causal link to A.  Science is explanatory reasoning, and applies things we observe trying to explain what we observe through a theory, supported by facts that have been observed, like the melting of glaciers up at Glacier National Park, taking the observation that of the 125 previous glaciers, there are only 27 glaciers left . . . scientists seek to explain that observation, with theories, that make sense and can be verified by any scientist who cares to join in their experiments or agrees with their theory, like that of global warming.

Science is the most advanced method of acquiring knowledge, and it can be done through both inductive and deductive reasoning, based on assumptions with real underlying objectives: (1) existence based understanding; (2) through writing; (3) community science; and (4) research . . . primarily addressing reason and observation, as a way of understanding facts, evidence consistent with theory or claims that are made, but science doesn't prove anything.  These elements of scientific experimentation need to be present: (1) observation and measurement; (2) a theory; (3) developing a model of the theory; (4) experimentation on the theory; and last but not least, (5) repeatability . . . others who can take the same theory and model and get the same results.  All empirical knowledge is tentative. 

Scientific Methodology

It is unprejudiced, conclusions must be held, irrespective of state of mind, religious persuasion, state of consciousness, or ideology.  Science can't answer, values, emotions, morality, and the supernatural.  The importance to society, comes by way of reliance on science as the major driver of technology, and the public should invest in science and the sciences.  Japan is one of the best countries, in investing in the sciences, or they watch what America's scientist are doing, and watch as many of them are either not funded, or underfunded, and they take the results back to their country and create technology based on the scientific experimentation and theories, like dealing with batteries, and they go back home and develop the new batteries using new scientific methods!

Note:  This coming Friday, Flathead County Republican Pachyderm meeting, has invited to speak, local mother, Mary Todd, mother of a young man, working with a large technology company in China, was found dead, after telling his mother that he was experiencing trouble on the job, and that he was not suicidal, and if he ended up dead, it was because he would not give technology secrets to the Chinese!  Mary Todd will be speaking; she has written a book about her son's strange death, and it should go right along the lines of this presentation to the Rationalist . . . it is free, public is invited, Red Lion, noon, can order lunch, see you there . . . lunch is $12.

Scientific Skepticism

Be skeptical on all theories until you see the evidence . . . rational, structural evidence, playing by the Rules of Science, is where to get your information, not through some dishonest tactics.  Indiscriminate skepticism or denial, is not science at all, only a fad science would dismiss, based on the evidence or lack thereof, replacing science, theory, facts, evidence, with their own personal beliefs. We need to remember, in science, as it is in the law, the facts are the facts, evidence is evidence, and the rules of science are the rules of science, as well as the law is the law, is the law!  I was thinking as the speaker talked, who analogous, science is with the law.  Generally, attorneys, on either side of the case, will create or come up with a theory of the case, based on the facts, the evidence, and the witnesses.  Then the theory is presented to the jury, who then, based on all the evidence and facts, within the theory, either of one side or the other, or the prosecution or the defense, decides which factual presentation or theory, best fits the evidence and witnesses.  Anyway, just a thought to help you understand, both science and the law . . . all based on facts, evidence and witness accounts.

Be Smart, Be Rational, Be Skeptical, Rely on Facts, Evidence, and Witnesses, or Expert Opinion!  At Least Have a Rational Basis for Your Positions, Thoughts and Even Politics!

Unconstitutional Actions Are Unconstitutional By Presidents, By A Republican Controlled House and Senate, By States and Their Legislatures, By Governors and Attorney Generals!

There is not one person, among whom I have just addressed who is not a sworn official, taking the oath of office to uphold, preserve, defend, and protect the United States Constitution and the state constitutions of the one they live in!  This is not dependent on whether you fucked your wife or husband last night and you are in a good mood, or that nobody peed in your cereal, or you got up on the right fucking side of the bed, it is every day, every decision, every vote, and every law, keeping in mind the two landmark U.S. Supreme Court cases, and this goes for the Supreme Court too, stating, basically, that any law, compact, agreement, treaty, alliance, that is repugnant to the Constitution is void!  And any law, compact, agreement, treaty, alliance, that is consistent with the Constitution, it constitutional!  This is the first point of contact, and decision making . . . now that saying, you have to have at least a copy of the plain language of the document at hour disposal, and let me recommend one version of a pocket sized copy, that is a very useful tool, with more than just the document itself in it, but with many aids and guides to help you decipher, what it is you are trying to do, and making sure that it is within your responsibilities, duties, powers, and control.  You don't just vote for the water compact, because you have done it before, or because you have spent so much time on it, or to avoid litigation, because that can and is cutting both ways!

Congressman Zinke, went to great lengths, to kind of trash President Obama, Attorney General, Loretta Lynch, and Secretary of the Interior, Sally Jewel, stating either that they have violated the Constitution, or that he doesn't trust them . . . I would surmise it to say, that with the little understanding of most people with regards to the Constitution, that many times, it takes an 8 level analysis to get to the right point, to determine, whether or not something is constitutional or not constitutional.  It is not easy, and that is where, attorneys, for Congress, legislative counsel, or the Attorney Generals Office comes in . . . you just don't say, or decide that they are going to do something that is politically expedient just because they are a Democrat, or in the converse of that, a Republican.  The Constitution was a compromise broad enough to bring under its penumbra, both abortion and right to bear arms!    The Constitution was intended to make a more perfect union, taking into account the great variety of opinions, special interests, religious backgrounds, races, parties . . . hell, there were something like 12 political parties at the time of the drafting of the document, even more convoluted than it is now!  So, if 12 political parties could come to a compromise and make this thing work, surely two or three parties, and some other varieties can, meet somewhere in the political spectrum of what is constitutional and stay out of the unconstitutional parts, especially, when the plain language of the document, clearly, states what can and can't be done by states, or Congress or the President, or the Supreme Court!

The Constitution Paints a Broad Brush, Taking In Both Conservative and Liberal Views . . . Anything Outside That Area, Can Be Considered, Anarchy or Terrorist Ideologies, Treasonous in Nature!

Congressman Zinke, said, that the United States is going to make it . . . we are fine.  The first step to making sure it stays okay, and keeps going with the success it has for the last 240 years, is to follow the Supreme Law of the Land, the U.S. Constitution, and preserving the rights, freedoms, liberties and protections, it provides, and use the guide posts, dictating who does what, when, how, and where!

Muttin' Bustin' For You City Folk . . . Kids Riding Sheep, That Sometimes Bust the Kids!  LOL!

Kael was my first grandson to brave entering the muttin' bustin' contest, and he did a great job, just hung onto the sheep's wool, closing his eyes, and wrapping his legs around the belly of the ewe, the technical name for sheep, for those not raised in the country . . . my husband, used to get pissed at me that I didn't know the difference between hay, barley, and alfalfa!  Yeah, like you know the difference between a will, a living will, powers of attorney, and durable power of attorney!  I wasn't raised on a farm, so how in the hell would I know, what the difference between things, that look similar to me, are growing out in the fields!  LOL!  I used to love to read a book to may kids, called City Mouse and Country Mouse, cousins and what they learned by visiting each other, that was me and my husband.  But it was fun as hell getting to know country music, to see that horses had their own personalities, and loved to see me gather barley out of my husband's hands, as he mowed the weeds down on our 23 acre farm, that his family had for generations, that we also loved.

In the next heat of muttin' busters, or kids, who are brave enough to get on a sheep's back and go for the ride of their lives, to that point.  Tristan, a beefy kid, much of the physical build of his father, who was a Navy SEAL, until he blew his knees out two years into the program, and he got unlucky enough to get a huge sheep, that wasn't putting up with any of this stuff, letting kids, ride on his/her back!  Tristan last about one second on the sheep, went straight up in the air, and landed, right on his head, with his body, straight up! He got up, dazed and confused, not knowing which way to get off the arena dirt, that he had just landed on!  LOL!  He staggered, walked, looked a bit confused, and finally made it over to me and his parents, where we were sitting in the stands . . . fighting back tears, Tristan said, Grandma, the dirt hit me on the head!  I am sure, that as short as he sat on the sheep, and being quickly thrown upside down, and going straight down, hitting the ground, it would have seemed that the dirt hit him on the head, because the last time he had any cognition, he was going up, not down!  LOL!  Thaddeus was too young, but he got the jest of the event . . . a little girl, hardly as big as a button, with long hair, walked away the winner of the heat, having hung on to the sheep, being on the side of the sheep, clinging on for her life!  LOL!  But she made it across the arena, and cowboy dad, couldn't have been prouder!

Family Favorite & Yearly Event, The Demolition Derby!

Fun, fun, fun, for anyone who has not been to a demolition derby, is really missing out.  People get these old cars, many of them back before the days of fiberglass cars, the most sturdy they could find, many had been in a derby the day before, but got knocked out early and still had life in them, even though they look like shit. But there are several cars, or more, that start the derby, and they smash, crash, thrash, and pummel, the other cars, until they are all rendered inoperable, or are out of commission, and there is one car left standing, usually, doing a victory lap, around the dirt arena, the same one they have the rodeos on, generally playing to a full house!  My daughter, Greta, always wanted to be in the powder puff derby, or the girls, part of the night's events.  Many of the cars, were pink, gussied up, like the gals would like them, but the drivers, tough as nails, with many of their daddies in the audience, egging their baby girls on . . . like father, like daughters. But about the time, I got out of law school, and working to have the means to have money to invest in a junker car, Greta, up and joined the Navy, before the county fair came, leaving us without the joy of seeing her compete in the derby . . . guess she wanted to compete in a bigger arena, the NAVY, and she ended up, coming out of boot camp, Navy Hall of Fame, for being in the first co-ed division of the naval graduates, with only 69 divisions to get that distinct award, out of the 9 divisions, that graduate weekly, in the 85 years of the Navy history!

Rodeos Are Always Fun . . . Even Get Exciting When a Bull Gets Loose!

I remember going to a rodeo, in it seems, Lehi, Utah, and one of the bulls got loose in the streets, making several of the cowboys, having to leave their posts watching the rodeo, and track down the bull, before it hurt someone or got hit by a car.  The livestock used for the rodeos, are worth a fortune, with a bull like that, or a champion, that doesn't let too many cowboys ride them, with wild ass names, that terrorize the crowds, and leave the cowboys praying for life, clowns, watching the bulls every move, but they are bred for rodeos, and trained to buck, throw, play with the clowns, and make their owners a shit load of money, some of the bulls going upwards to a half a million dollars . . . why do you think I wanted to breed bulls, when I won my big cases, when I thought, winners got the money, not government inter pleaders, who pretended to be me, and took the money and ran!  But, the bucking horses, the bulls, are amazing and shock the rodeo goers, and some are almost impossible to ride, seeing cowboy after cowboy, hitting the dirt, much in the same way my grandson did.  And by the way, the World Bucking Bronce Home, is somewhere near, Ukalaka, don't know how to spell it, but out in south, eastern, Montana, some guy, just decided to breed horses, and has had some 6,000 famous bucking horses, come from his breed!

My Personal Favorites At the Fair . . . Always Go to See, The BULLS!

One year, about 10 years ago, while I was waiting to die, I broke my left leg, in about 5 places, shattering both ankles, and many of the bones in my foot, and all boxed up in a case, with crutches . . . but, that was not going to stop me from going to the county fair, to see my bulls!  I asked everyone I could, to see if they didn't want to go to the fair--many people in Cache County, were raised on farms, ranches, and they were not as impressed with farm life, since they were raised that way and many went to college to get off the farm and stop having to get up early to milk the cows at 5:00 a.m., completing the duties and chores before school.  I should have been born the farmer's daughter!  I love that lifestyle, but I was not raised on a farm and may feel differently if I had been . . . my father was a CPA, Certified Public Accountant, and my mother was a school teacher, but we did as a family go to rodeos and county fairs, often, as I also did with my children, when they were young.

But, come hell or high water, that year, while convalescing from my broken leg, I was bound and determined that I was going to the county fair, regardless of how I had to get there!  I called the bus, told them that I was on crutches, and would need help to get to the fair, with the bus making special trips to the fair, hauling patrons, and participants . . . they were more than helpful, much like Eagle Transit, who shuttles people to and from county events, and they made sure the driver knew he would have to put down the ramp and get me to the fair, and he did.  Once to the fair, there were wheel chairs, that I could use, and I don't recall, having to pay for them, but that was a while ago, and each fair will differ, but I left my crutches with the place that gave them out.  The next challenge was to make it around the what 168 acres of the fair grounds in a wheel chair, not ever having used one.  But, I found that people, who noticed my challenge, rose to the occasion, and helped me get everywhere I need to go, even down to the bulls, which seemed to be down in the lower 40!  The asphalt, was uneven and hard to navigate, but, nothing could stop this determined, bull lover, from getting to see them, like I had most years of my life . . . fun day, great people, random acts of kindness got me where I wanted to go, and I made my yearly pilgrimage to the fair!

Pickles, Pumpkins, Pies, Quilts, Even Goldfish!  And Coveted Blue, Red, and White Ribbons!

I got a big kick out of the Coalville, Utah, fun parade and county fair . . . I couldn't believe what animals were entered into the fair, cats, dogs, and goldfish!  LOL!  It is fun to walk through all the exhibitions, checking out the rabbits, the chickens, and other farm animals and what not.  The homespun, flavor of the fair, reminds you have past days gone by, remembering that grandmother, her garden, grandpa and his chickens.  My second husband, and I lived up in Midway, Utah, and it took him it seemed 12 years to get a housing unit, that protected his free ranging chickens, during the day, but locked in Fort Knox at night, to save then from the dogs, the wolverines, the fox, snakes, coyotes, and other predators, that lurk and hunt during the night, and even in the day.  One beautiful spring day, Jerry and I, sat out in his new chicken pen, connected to the already cool chicken coop, barn, with its nesting and moulting stalls, and while we let a dozen or so, baby chicks, replacements for the ones who had just been slaughtered and eaten in part, run round, while we were sitting out on the hay, all of the sudden, between the bails of hay, a snake came, chomped down on one of the baby chicks, peeping and crying, as the snake darted back between the hay, as Jerry grabbed a shovel and tried to hit the snake, killing it and saving the chick, but to no avail.

I used to bottle fruit and vegetables, so it is fun to go see the award winning bottling.  I have even bottled and dilled pickles, that I don't think, before that, ever connected, pickles to cucumbers!  LOL!  A farm girl in progress . . . gardens are wonderful.  My mother used to grow tomatoes every year, but not much more. When my first husband, was going to the University of Arizona for his master's degree, we lived in a little Quonset hut village, part of the universities, student housing, paid $43 per month, including electricty!  But, our neighbors, next door, happened to have a garden spot between our two huts, and so we jointly grew the first garden I had ever grown . . . I loved it, just seeing the green plant shoots, come up through the black dirt, was amazing!  I used to read my daughter a book, called, Frog & Toad Grow a Garden, they were so excited to see something grow, that they stayed up all night, played music, and finally gave up, and about 10 days later, the plants started to grow!  Gardens are amazing things, and produce can be spotlighted at the county fairs, the best, the biggest, and the brightest!  You can pick up ideas for what types of seeds, tomatoes, award winners, to grow, the next year in your own gardens!  And there is a great feeling of self sufficiency growing your own food.  I wanted to paint a picture of the first fruit that I bottled, I was so proud, and it was beautiful on my shelves, up in my second kitchen, at my home on Eccles Avenue, in Ogden, Utah!

County Fairs--People Connecting With People!

One of the great things, is that people get busy with their individual lives, taking kids here and their, working our jobs, going to church, being involved in politics and community, but the county fair, is a place, that in one week, many of the people throughout the community, go, and connect, either in booths, at events, or checking out the produce and animals, giving people the chance to do what many used to do over the backyard fence, just sit and chew the fat, talking shop, catching up with old friends, maybe seeing people coming back to spend time with mom and dad . . . but a great time to connect, reconnect, and get acquainted for the first time.  Last year, I worked a booth, dealing with the closure of roads by the Forest Service, promoting educational information, and taking tickets for a raffle of really great prizes.  The guys, or actually, the wife of one of the guys, who happened to pick me up, coming down from East Glacier, hijacked me and inducted me to work the booth with her husband and I had a ball.  They loved it, her husband, and Gerry O'Neil, a state senator, representing the Flathead . . . actually, this was two falls ago, the day, I started this blog, being tracked by Indian trackers and blood hounds, an a ton of feds, stopping me from getting on the train, and I was just returning a key to Swiftcurrent Lodge where I was going to work that summer!  After walking out of the Park at 4:00 a.m., to Firewater Point, some guy picked me up on his BMW motorcycle and dropped me off at A & W, Root beer, in Columbia Falls, and that is where the woman, who picked me up and hijacked me to work the fair . . . it was fun, educational, and I met people, connected with political allies, to some extent.

Spin Squad of Cops Starting To Protect Their Own!

Okay, so the State's Attorney, Marilyn J. Mosby, does her job, professionally, in quick order, given the climate in the city of Baltimore, has 50 city detectives on loan from the cop shops, along with a city committee of cops, to advise her and aid in the investigation, and the state coroner, in his investigation of the cause of death, declared it a homicide!  This is not her call, this is not her husband, a city councilman's call, nor the call of the youth and other protesters, we have a fucking dead body here, and someone is responsible . . . Mr. Gray did not break his own larynix, give him a spinal cord injury, and stop trashing the victim, trying to make it look that it was a drug deal that made Freddie run from cops . . . hell, it was not a month ago, a man got shot in the back by a cop, 8 times, and it is not as if, it hasn't been open season on unarmed black men!  Good, God, where does the cop frat rat organization, stop!  Look at the god damned facts, the evidence, the video, the position, the policy violations, the 5 stops that could have been used not to just check on the man, but to believe him, get him the medical assistance he needed!  When do cops, just take the side of what is right?

These injuries could not have been self-inflicted, look at the facts . . . if Mr. Gray's family contributed campaign money to Ms. Mosby, is beside the point, if he had used drugs in the past, or had a rap sheet, again, is irrelevant to what happened the day, 6 cops were involved with Mr. Gray, and he ended up dead! My God, this man is only 25 years old, it is not as if, he was some 60 year old man, in poor health, some junkie, who was on the verge of death anyway, and this just pushed him over the edge!

Cops Need to Stop Acting Like A Gang . . . Going After Anyone Who Questions Them, Holds Them Accountable, And Doing a Character Assassination on the Victim . . . We Have a Dead Body . . . We Need Answers!

Last night on Fox Opinion, which I just tuned into, up at the Kalispell Athletic Club, after a short swim, so I didn't quit get the whole jest of what was going on, but Geraldo Rivera, appeared to be interviewing an alleged cop, disguised, wearing all black, looking more like ISIS, who of course is anonymous, since he fears for his life, of course, so he can avoid being interviewed or being called as a witness, is just picking up shit from the cops and spouting it off on national TV without being at the scene, without knowing the facts, that are not available to the public, including other cops . . . just like the bar witness, who refused to give her name, and seemed to be privy to Officer Wilson's side of the story . . . this dip shit is starting to raise questions in the minds of those who will not take the time to realize, that he doesn't know jack shit, and he is presenting what the cops think, will help taint the jury pool, giving them cause for reasonable doubt, which is all they need to get the cops off, with criminal charges, as the standard of review!  

The Fraternal Order of the Police, think that Ms. Mosby's announcement was premature, and politically motivated . . . why?  The cops, who did the internal investigation, through cop, Internal Affairs, who takes the first look at the case, found that there was probable cause to go the next step, turning the case and the results of their investigation over to Ms. Mosley, the next step in the chain of process, part of the due process the officers are entitled to!  In this case, however, Mosby is not sending the case to the grand jury, taking the chicken shit way out, as the prosecutor did in the Michael Brown case, and her office is going to be the ones to charge and prosecute . . . she didn't wait, 9 days to release the names of the officers, nor allow time to pass, so the spin doctors within the cop organization to do just what they are trying to do, protect their own . . . she was not dumb enough to wait!  She doesn't see herself as an extension of the police force in Baltimore, or working for them, protecting them, much like we saw in both the Treyvon Martin and Michael Brown cases!  I am sure she has learned something from watching what happened in those cases!  State's attorney, Mosby, ran on a platform for the office she holds now, against an incumbent, who spent 3X the money, and won, on the idea that she would prosecute cops who were involved in incidents, just like the one we have, at hand!

God-Damned Cyber Cops Just Erased The Last Few Paragraphs--Good Fuck!  If YOU Don't Have One Cop Group of Rats, Protecting Cops, You Have Another!  I Amp Up Dip Shits, Don't Think I Can Write This Again!

Although, it was nice to see, that Google, intended or unintended, had my numbers back up to where they used to be, around 30,000,000 for 34 or 54 seconds!  Thanks, that is the only pay I get, since, you give to the fucking fraud broads and the bastards that give them access.  You see what they do to get access to be able to erase my writing, that is very damning to the cops, they put some fucking stupid text box, up that says, you have changes that have not been saved, then it gives me the options of closing, which does nothing . . . and then the other one, gives them access to my blog!  Which they have been trying to get all morning, but I had published it, making it harder . . . but, they find a way, and when I hit the only choice I have, they erase all the last few paragraphs I have written, either wanting to steal what I have written, or to keep if from being erased . . . I am sure, my butt fucking stupid, Mo sister Sue has been given credit for what I have been writing on separation of powers, and branches of the government . . . she is a fucking dumb ass history major, wanna be attorney, never worked a day of her married life, until she got to be ME!  LOL!  

I am not that bitch, Sue always in my shadow, since birth, a Molly Mormon, with a corn cob up her ass, I am sitting her at Target in Kalispell, Montana, talking to Natalie, a friend who works the counter, talking politics, and other things!  Sue is probably at home in Utah, or allegedly on a mission in Turkey, and she is a turkey to think that I believe anything but a cover for it looking like she is on a mission, is what is going on . . . she is another sister, trying to get a piece of the JoAnn S. Secrist Pie!  Mormon Muffins, still don't get it, with the CIA, Make a Wish Foundation behind them, that there is fucking NO short cut to success!  I paid the price for success, and that is exactly why I have it, and they can just steal it . . . okay, now where was I?

Restoring the Trust of the Community

It pisses me off so bad, when I write and it is great stuff, and it comes in a flow, and these fucking box trolls steal the writing and I can't remember, exactly what I wrote being in the flow of writing and they break the thought patterns . . . so, theft of intellectual property a, fucking CRIME . . . where is Mosby when I need her?  This is not nearly as good, they steal all the good stuff, but I am going to put a list of thoughts, that will help cops restore community trust after an indecent, like this, not only leaving people in fear for their lives, but worried about their children, any exchange with cops, that even an eye to eye contact, can result in death!  

• cops need to stop defending hideous actions of cops--with the attitude, that cops can do no wrong
• when the evidence, clearly shows that the cops were not only abusive, negligent, violated their own policies and procedures for safe transport of victims, and then ignored cries for help, and medical assistance, don't defend those clearly negligent, if not outright depraved hearts, not even doing what a normal human being would do, but with blatant disregard for life!
• stop doing spin control, for God sakes, let the system work
• stop coming up with anonymous alleged cops or witnesses, who are not privy to anything but cop bull shit, and try to pass it off as an insiders information
• rely on the formal proceedings: (1) the independent internal affairs investigation, that found probable cause to believe that there was enough evidence and facts, to go the next step, taking it out of the control of the cops alone, and turning it over to the State's attorney; (2) Mosby's office, had 50 detectives, out working 14 to 16 hours a day, to get a handle on the facts, to do their own work, separate and aside from the cop investigation, which, concluded that there was cause to go the next level of official actions against the officers . . . so, this is not politically motivated; (3) the coroner who performed the autopsy, looking at the injuries, concluded, independently of both the cops and the prosecutor, that it was a homicide!
• when you have a dead body, you have to hold people accountable . . . a charge is just that, a charge, allegations and reason to believe that there is cause to believe that these crimes had been committed and need further examination, and a jury to decide what to do, and who is culpable
• not only do we have a dead body, but the dead body, never should have been arrested, there was no probable cause, the standard for chasing and arresting Mr. Gray!
• and how stupid do the cops think we are, to look at the almost lifeless body of Freddie, even before he is put, with handcuffs, shackled and chain, not only on his hands, but on his legs as well, then, placed on his stomach, with not restraints!  Are you fucking kidding, he crushed his larynx, and gave himself and spinal injury . . . ah, how?  He must be Houdini!
• the jury is the trier of fact, and there are as many people, who give credibility to cops, so thinking, that for one second the jury pool, is going to be so tainted, as to not provide for a fair and speedy trial, with a jury of the officers' peers, is just not reality
• media outlets, like Fox Opinion, need to focus on true journalism, not sensationalism, by not letting alleged, cops, who refuse to give their names, are wearing black, looking like ISIS members, and giving all kinds of bull shit, accusations and promoting information, that is not correct, just giving cops and their ilk, access to the media, and feeding the public with material that is not factual, with witnesses who are not privy to inside information, don't know the findings of the investigation, nor are they members of internal affairs, the detectives who did the investigation, nor are they one of the attorneys or the cops, who are given the right to have access to the right information, and you have to consider the source . . . as Geraldo Rivera, interviewed this person, who will never be called as a witness, just wanting to raise, reasonable doubt, before the jury of public opinion, in our system, a person, has the right to face their accusers . . . poor Freddie, is not here to defend himself, against accusations of drug use, of doing a drug deal . . . which didn't come out in any of the investigations, but this asshole thinks he can just fool the public, and throw any bull shit out to the sharks, who want to find something wrong with the victim, so the cops can get off . . . but on this program, and I had just gotten out of the swimming pool, at the Kalipsell Athletic Club, and as the interview with the chicken shit, or planted cop, trying, to of course, assassinate Gray's character, Sean, and I would assume, that is Hannity, because it was around 9:45 p.m., when I got out of the pool, but it sounded like Sean, paid the bail for the driver of the jail transport vehicle . . . I am not sure, but that sure as hell seemed implied, but the bail was somewhere between, $300,000 to $350,000, which is a hefty sum for most of us, especially the cops, but for Sean, no big deal!  All the cops are out, therefore, it is safe to assume that all sentiments are not against the cops and for the victim, as they should be!
• cops lose credibility with the community, when the totally ignore the facts, the law, the evidence, and just do whatever it takes to get the cops off, regardless of what it does to the public, to the future interactions with the community, to the trust, seeing that, no matter what a bro in the law does he or she is protected, against the very people they are suppose to protect!
• if cops can't be appalled by the lack of disregard, inhumanity for the basic safety of this man, who was in their custody and should have been in their safe care . . . they should at least, remain, neutral, and wait until the facts come out, or just shut the hell up and let the process work!
• a person can not be deprived of life, liberty and property without due process of law!  Mr. Gray was deprived of life, liberty and property, for daring to make eye to eye contact with three officers! In this world of instant replay, I think that often, we think, that we can just go back, and like an actor, or a cartoon, that someone who died, will be back the next episode, or the next movie, or cartoon, or we can just replay that act that caused the death, and like magic, the person is back, no big deal, they will be back by tomorrow . . . no, once you are dead, you are fucking DEAD!  

"But For" The Actions Of the Officers . . . Freddie Gray Would Still Be Alive!

While the officers, didn't set out, on the chase, the arrest, or the transport to the jail, to kill Mr. Gray, or to do what would have caused him to expire, just a nice way to say, die, the actions they either took, or failed to take, resulted in the death of this man.  In the law, criminal, negligence, and other areas of the law, there is the but for issue that has to be considered, the series of events that took place, while Freddie was in the custody of the cops, and but for what the officers did, didn't do, just blew off, Freddie Gray would still be alive!  The man interviewed and the Fraternal Order of the Police, acted like the officers, merely, failed to restrain Mr. Gray, and didn't take him to the hospital . . . well, and just those two things, caused the death!  Therefore, it was the depraved hearts of the officers, the total disregard for human life, taking the necessary care of a person in their custody, in which they are responsible for, once the suspect has been detained and cuffed, to make sure that he gets to his destination!

That, sadly, never, happened, Mr. Gray, never made it to the destination, the officers, picked him up and intended to deliver him to . . . therefore, the death is considered a homicide, and rightly so!  This is not just something, that people, pro-cop or anti-cop, can just say, oh, well, too bad, so a man died!  If there is a death that results from the actions of another, or while in the custody of another, especially, those who have complete and utter control over this man, must, protect his safety.  It is not as if, this was a 60 year old man, in ill health, ready to die, and the actions of the cops, just gave him a nudge into the grave!  Hell, this was a healthy, as far as I know, 25 year old man, with his whole life ahead of him!  We just don't brush that under the carpet, and say, well all is well, and we can just go on . . . that can't happen, there is an accounting, for this life that society demands, and that is what we call justice!

Cops Are Innocent, Until Proven Guilty!

Don't forget, that this is the beginning of the legal, criminal process, just the preliminary steps have been taken: (1) all officer misconduct, goes through internal affairs first, and if they find probable cause to believe that a crime has been committed, just like the standard that the officers who arrested Mr. Gray should have considered, before arresting him . . . and it was found, after several independent investigations, that the officers had probable cause to arrest the man, and there in lies the problem, only ratcheting up the mistakes, making the death even more egregious, than it would be otherwise, and after fellow officers, within the department, found that there was reason to pass this case over to the state's attorney for further investigation and the possibility of criminal charges, being looked at by an elected attorney, who was voted in to do her job, and either, even going the second mile, doing a separate and independent investigation from that of the police department, using 50 detectives to help gather the facts, not wanting to make mistakes, or even rely on the internal affairs set of facts, doing their own; (2) with a committee of cops, and several other attorneys, after looking at the facts, being compared to the law, all the elements, that must be met, in a criminal case, and just that morning, holding off, until she got a third independent investigation, or with the results of the autopsy of the cororner, coming in as a homicide, she looked at the possible crimes that might be associated with the behavior of the officers, and decided to proceed with prosecution, which is the state's attorney's call, not the cops; therefore, any involvement the cops have from this point forward, should be at the direction of the attorney in charge of the case . . . just because, Ms. Mosby, is the one over the office and elected, doesn't mean that she will be the prosecutor, who will handle the case, in fact, most likely, that will be assigned to another attorney in the office.

The Process From This Point . . . Long Way From Finished!

Steps to go through: (1) decision to charge; (2) arrest of the officers; (3) the arraignment, where they will either plead innocent or guilty, and based on the fact that they are all out, they most likely all pleaded innocent; (4) in most states, that have a preliminary hearing, or a hearing of that nature, where the state's attorney, will have the opportunity to present the charges and the facts supporting her decision to proceded with prosecution . . . prosecutors, can also decline prosecution, and drop the charges, but it is at this point that the defense attorneys get to see what the state has against the officers, and the judge will also decide to bind the case over for trial, if there is sufficient evidence to convict; (5) then there is the trial, by a jury of peers, who will decide if the facts support the charges the prosecutor charged the officers with, and if so, and all the elements of the crime are met, then they will find them innocent, or guilty; (6) each officer will be looked at differently and distinctly, for the actions they took or didn't take in the mishap and death, deciding the levels of culpabiltiy, thus showing they are either guilty or innocent as charged; (7) the sentencing phase, if they are found guilty . . . looking at priors, background, any charges in the past that might indicate the propensity for this to happen again, anything in their personnel files, and just information to help the judge determine, how much jail or prison time is justified; and (8) even at the sentencing part of the trial, the defendants, the cops in this case, are even given a chance to argue their own case or some elements of the facts that may have been missed by the jury, or where not brought up, that might even change the judge's mind about either the amount of time to be served, or the severity of the sentencing.

Both Cops And Protesters Need to Relax . . . You Are In Good Hands, And Let the Process Proceed!  And, Even That is Not the End, If Things Go Afoul, There is Always an Appeal!

Prosecutors, have a unique relationship when it comes to the cops . . . they rely on them to enforce laws on the streets, within the confines of the Constitution, using probable cause, to determine if a crime has been committed, detaining, and if necessary, arresting, gathering evidence of crimes, but while both are part of the executive branches of the government, they are separate and distinct, having very different jobs, responsibilities, duties, and they need to operate, independently of each other, while working together.  This morning, in an unexpected, press meeting, State's Attorney, Marilyn J. Mosby, only 4 months on the job, took the bull by the horns, and did her job, promoting justice for all, regardless of wealth, station, profession, race, ethnicity, in a system, that has long departed from the symbol of our legal system, that of Lady Justice, standing with a blindfold on, scales of justice in her hand, standing on the head of a snake, crushing injustice . . . at least that is like the statue, that I used to have, before, Hitler's SS men and women, dressed up like modern day, Washington County Sheriffs, and took everything I owned, without charges, without reason, without the law or the Constitution behind them . . . operating under Mormon Utah justice, trying to stop me from going to the 10th Circuit Court of Appeals, arguing my $357 million securities case against the state of Utah, and government officials for federal statutory and constitutional civil rights violations, committed by state officials, operating under color of law!

In one of the most professionally presented press conferences I have ever seen, Ms. Mosby, in an unemotional rendition of both the law, explaining to those less familiar with the process, took her stance for justice and the way it is suppose to operate, looking at all the facts of the case, going from A to Z, in a TOTALITY OF THE CIRCUMSTANCES!  She was flanked with police organizations and committees, other attorneys, who did the foot work, doing an amazing job, both professionally, unbiased, and prompt, knowing, that the people of Baltimore, who elected her to do this job, hard as it is at times, especially, against police officers that are both needed, depended on, and valued, in the community, making it in all cases, very difficult, taking into consideration for the community, the public image, walking a fine line between seeing that justice is meted out, and protecting the credibility of the rest of the police force, who risks their lives every day, which all of us, love, appreciate, dig, respect, as long as it is done within the confines of the rules of engagement . . . the U.S. and state Constitutions, Bill of Rights, legislative law, and JUSTICE in the law!

PC is the condition and constitutional standard, under which, the prosecutors had to use, to determine if Mr. Gray, was legally, chased, arrested, shackled and chained, and thrown in the back of a van, without restraint, claiming he could not breath, which led to his death!  For too long, cops, have crossed over their professional duties, and tried to use the prosecutors as their hired guns, not only to prosecute those, whom they determine, think, or want to be considered to be criminals, but to exclude fellow officers, who are guilty of hideous crimes against humanity, like this one!  Basic human decency, would have dictated a different course, listening to cries for help, getting medical assistance, that could have come, at at least 5 stops, before processing or going to the jail . . . callous, disregard for the life of anyone, suspect, defendant, criminal, or incarcerated persons . . . does not justify police brutality, under any circumstances, or under the fucking most rare exceptions!  Remember, the 8th amendment, against, cruel and unusual punishment?  Yeah, that old dusty document, that Mosby just refreshed and applied!

Just by way of a reminder of other issues . . . the Fraternal Order of the Police, is not part of the executive branch of the government, charged with enforcing the law; there is no constitutional, statutory, or legislative provisions for you to call for an independent investigation of the facts surrounding the arrests of these 5 or 6 officers, involved in this case--you may know some of the laws, even understand it, but you are not an attorney, nor where you elected by the people to represent them in issues of JUSTICE!  Just as the branches of the government, executive, legislative and judicial, all have their separate and distinct responsibilities, as set forth in state and federal Constitutions, within the individual branches, especially, within the executive branch, responsible for enforcing the laws, that the legislative branch determines the PEOPLE need, or the laws that are interpreted by the judicial branch, as the constitutional interpretation, that through the plain language of the statute or constitution, the intent of the founding fathers, or what the legislative branch wanted, or looking back at the historical perspective, making clear, what was going on when that law was made, thus guiding the executive branch in enforcing the laws.

Once, cops have arrested a person, and find that there is sufficient evidence to detain them, the charges are to be determined by the prosecutors, who looks at the facts, the evidence, the elements of a crime, and determine, whether to proceed with prosecution, or to decline prosecution, due to not having sufficient evidence to charge, detain, or jail a person.  From the first day in law school, students, are taught, various acronyms to help them remember to take the facts, the evidence, the law, and apply those elements, to see if that particular law, statute, constitution, was violated, or there are all the elements of the law met . . . cops are not trained to do that, or do not have the authority to do that!  Law school is a grueling experience, you are on a learning curve from hell, put to the test, then you are tested on 22 areas of law, probably more in the last 20 years, and then tested in a two day bar exam.  Now does that mean that all attorneys are smart, or that all know the law, or that they get every aspect of the law, or that you or any Joe Blow, could do it . . . THEY JUST FUCKIN' DIDN'T DO IT!  PERIOD!  I have people ask me, if they could make it through law school . . . I told them there is nothing special about attorneys, they just had the discipline to do it!  When cops or others are on the golf course, or skiing, or hiking . . . law students, have their asses on a chair and their eyes in a book--that is what it takes!

I would venture a guess that Ms. Mosby, much like U.S. Attorney, Loretta Lynch, were exceptional, due to the fact that they both were able to not only make it through law school, but succeeded as attorneys, to the point that they ended up either being appointed to higher positions, or elected for their unique contributions to the legal field . . . you don't reach these levels of expertise and trust, without being exceptional!  While Ms. Mosby, is just 4 months on the job, doesn't mean that she is 4 months as an attorney . . . she most likely has years of experience or she has done great work, and is trusted by the PEOPLE! Much like cops expect the people to do, sit back and let the State of Maryland's elected top law enforcement officer in the state, do her job.  And I am sure, that if she needs help, support, or insight, Ms. Lynch, can step in and direct, inform and send backup.  They are following, due process and equal protection of the laws . . . there has to be these to deprive any citizen or cop of their right to life, liberty and property!  Nobody, can take these facts, and somehow, no matter how convoluted they make the facts, and to what point, can they twist them, to saying nothing was wrong, in this situation . . . a man looks at cops and ends up dead?

Ms. Mosby, Dedicated This Investigation & Press Conference to the Youth of Baltimore . . . You and Your Fellows are Started the Protest--YOU Led Your Elders, You are our FUTURE!  Thank YOU!

I don't know if you, dear and beloved readers, know that it was the youth of this city, of Baltimore, with no declared leader, no group or organization, no predetermined actions, and little direction, took it upon themselves, I would assume, through, social media, somehow connected with other youth, groups, friends, and colleagues, to start the marches and protests in several large cities . . . New York, Pennsylvania, Boston or wherever.  And what happened was amazing.  Geraldo Riviera, of Fox News, showed up and started to interview a black youth, who promptly, put him in his place, and said, where were you on Saturday night, when 4,000 peaceful demonstrators came together in solidarity and power to try to see that justice was served for Freddie Gray?  Why are you just showing up for the fires, or the looting, reporting that we are "thugs?"  We are here, for an intellectual pursuit of justice for Mr. Gray, to see that he is not forgotten and disappears into a grave without holding those responsible for his death accountable!  This young man was articulate, strong, intelligent, powerful, right, and took the media to task, for sensationalizing the event, focusing only on what makes for scandalous events, the bizarre, the bad, rather than what really happened . . . GOOD FOR YOU!

The news and media, have a social responsibility to cover the great things, the good, the noteworthy, the noble, not just the sensational, capitalizing on numbers, rather than truth . . . trust has to be re-established with both the cops and the media!  The youth of today, the Millenniums, as they are called, are smart, and are also very trusting in authority . . . but, if you don't maintain that trust, they are the worst group to deal with, because they trusted you so much.  Unlike their hippie parents, who threw off authority, these kids, were raised by helicopter parents, who coddled and raised them, with much more care, due to the world we are living in; however, on the flip side of that, comes, the total betrayal when authority figures, like police, politicians, banks, and others . . . creates vehement hatred, disdain, and revolt!  To these young people's credit, in light of all the death, violence, carnage, and brutality, have been idealistic enough to believe that they could change things, that they had a voice, and that things could get better . . . and the tides of injustice appear to be changing, we are returning to justice, and we can thank them from Occupation Wall Street to Baltimore Youth, who carried the day, and their elected States Attorney, recognized their contribution!  But for them, the youth, this news, the facts of the case, and the prosecutions, arrests, and bookings of the responsible cops, might not have happened!

AND THERE WILL BE, JUSTICE FOR ALL!
