Clarice Barnes, I think, last name is, very involved in the water compact, on the Flathead, with the Salish-Kootenai Indian Tribes . . . ask people at the Republican Pachyderm meeting, held today, Friday, at noon, to help the Flathead County Commissioners, define the word, navigable, which I did several times, in the last two years, in both written and oral arguments to the Montana Legislature.  The deadline for the definition, which is often what the law boils down to, it tonight, I think, if I was listening, at 11:59 p.m., so there it is, and here is the analysis I did a year ago . . . save the bucks!

Contract law: offer, acceptance and consideration on the part of both sides

• CONSIDERATION IS SOMETHING OF VALUE ON EACH SIDE

• implied contract: using services which would indicate a contract, rational basis that rights connected to contract are valid, those things necessary to carry out the terms of the contract
• you have to look at the entirety of the treaty, history, intent, constitutionally, fiduciary responsibilities of federal government, relationship with states, and with tribes
• this was to provide the Indian tribes with a viable homeland, in exchange for the Indians to cede, relinquish and convey their property

OFFER

• UNDER THE COMMON DESIGNATION OF THE FLATHEAD NATION, WITH VICTOR, HEAD OF THE FLATHEAD TRIBE, AS THE HEAD CHIEF OF THE NATION

• that implies water sufficient for their needs for use and occupation of the said confederated tribes

• however, the right to all citizens of the United Sates can enter upon and occupy as settlers any lands not actually occupied and cultivated by said Indians at that time and not including in the reservation above named
• free access to nearest public highway, right in common with citizens of the United States to travel upon all public highways
• exclusive right of taking fish in reservations
• waters that will sustain salmon and fish indigenous to the stream running through and bordering the reservation
• now tribes can’t sell oil, gas and coal leases, then cry foul when the water is polluted, they have an implied duty to protect their own water systems
• right of taking fish at all usual and accustomed places, in common with citizens of the territory
• may imply state fishing license and limits
• of erecting temporary buildings for curing--imply water those buildings might need?
• privilege of hunting, gathering roots and berries, and pasturing their horses and cattle upon open and unclaimed land
• this may imply a need for state hunting license?

ACCEPTANCE

•   in consideration of the above cession, the United States agree to pay to the said Confederated tribes of Indians, in addition to the goods and provisions distributed to them at the time of signing this treat the sum of one hundred and twenty thousand dollars in the following manner:
• first year after ratification, thirty-six thousand dollars, under direction of the President, in providing for their
• removal to the reservation
• breaking up and fencing farms--implied agricultural water rights
• building houses for them--water rights for home use
• and for such other objects as he may deem necessary  
• as things unfold on the reservation--open clause for future growth; however the U.S. Supreme Court has said that is hard to quantify, due to the fact that land may never be sold, projected growth may not occur
• money is to be applied to the use and benefit
• under the direction of the President, who may from time to time determine, at his discretion, upon what beneficial objects to expend the same for them
• and the superintendent of Indian affairs, or other proper officer, shall each year inform the President of the wishes of the Indians in relation thereto
• the United States further agree to establish at suitable points within said reservations:
• agriculture and industrial school, erecting the necessary building, keeping the same in repair, and providing it with furniture, books and stationary,--water
• blacksmith shop, attached tin and gun shop, carpenter’s shop, wagon and plough maker, for the instruction of the Indians in trades, and to assist them in the same
• sawmill and flouring mill, keeping the same in repair and furnished with the necessary tool and fixtures, medicines and furniture, and to employ a physician
• to erect, keep in repair, and provide the necessary establishments to be maintained and kept in repair as aforesaid, and the employees to be kept in service for the period of twenty years
• water rights implied--even though the term of agreement is for 20 years, water rights attached or needed, would not stop after the time allotted
• pay $500 per year to selected chiefs, so long as them may be elected to that position by their tribes, and no longer
• all expenditures and expenses contemplated in this article of this treat shall be defrayed by the United States, not deducted from the annuities agreed to be paid to said tribes
• nor shall the cost of transporting the goods for the annuity payments be a charge upon the annuities, but shall be defrayed by the United States--NOT MONTANA!
• THE PRESIDENT (not governor of Montana) may survey into lots, assign families as are wiling to avail themselves of the privilege, and will locate on the same as a permanent home, on the same terms as the sixth article--obvious implied water right
• tribes promise to be friendly with all citizens, commit no depredations upon the property of citizens
• shall one or more of them violate this pledge, and the fact be satisfactorily proved, the property take shall be returned, or in default, or is injured or destroyed, compensation may be made by the Government out of the annuities
• nor will they make war with other tribes, but will submit all matters of difference to the Government of the United States, same with for depredations to citizens
• tribes agree not to shelter or conceal offenders against the laws of the United States, but deliver them up to the authorities for trial (DUI, Montana state legislator?)
• Bitter Root Valley, above the Loo-lo Fork, carefully surveyed and examined, in judgement of President, to be better adapted to the wants of the Flathead tribe than the general reservation provided for in this treaty, may be set apart as a separate reservation for the said tribe--no part of this area opened to the settlement until such examination is had and decision of the President made known

Courts are all over the place--GOAL SHOULD BE TO SATISFY THE TRIBAL NEEDS--bottom line

• courts should award sufficient water for other uses that make the reservation a viable homeland
• should give more rather than less
• include water for: domestic, commercial, municipal, industrial purposes
• preserve fish and wildlife
• should actively seek partnership with Indian tribes and protect tribal resources
• broad homeland purposes in addition to advancing the PIA standard for reservations with agricultural purposes
• in stream flow to protect on and off reservation fishing rights
• there is a fear that courts might manipulate legal standards to reduce tribal shares to water and protect non-Indian uses
• opt for settlement negotiations to quantify their rights
• focus of courts may put emphasis on protecting federal treasury and less rather than moral obligation
• can provide substantial economic benefits to tribes

CONCLUSION

• success--federal government assist and encourage negotiations
• provide lion’s share of funding to implement agreement and negotiated settlement
• take into account inequitable treatment in the past
• historical water context
• transparent analysis of the tribal claims to water, tribes deeds, potential federal liability, and other benefit to settlement

PERSONAL, HOPEFULLY EDUCATED OPINION

• Hellgate Treaty itself, implies other uses beyond only agricultural purposes
• the treaty, when taken in the contextual foundation of other United States Supreme Court cases, really, if you connect all the dots, covers all aspects of the landscape or menu of cases
• Montanans, Indian tribes, and U.S. Government Officials, need to do the homework necessary to reach an agreeable settlement
• plain language, intent and history are the clue to an implied contract, which is totally consistent with the stream of U.S. Supreme Court cases up to this point
• we are where we are . . . now save the time, money and energy
• this is not an all or nothing thing--treaty suggests otherwise
• in any good compromise, parties give up something and parties get something--nobody gets to be 100% happy
• use the guiding principles of the courts listed here--and by no means exclusive, but a good overview
• attorneys on both sides have the background, knowledge and hopefully good faith to do what it takes to pull off a successful settlement agreement
• this is not about ego, but what is right . . .
• get rid of bad actors, don’t need them, not warranted--have clean hearts and hands in this--futures depend on it
• truly believe Cowboys and Indians will save this country, don’t have time for in-fighting
• the law is the law, is the law--we are where we are!!!!!!

They did however, steal, the other blog, same blog of another sister, and shut that down . . . take the money and run!  Jealousy, jealousy, jealousy, will get you now where!  The other day, in the magazine, called, Psychology Today, there was an article, that was about dissidents.  And it went on to say, that dissidents, who are considered, specialists or experts in their fields, are particularly influential and powerful, because they are not outsiders, looking in, they are actually, insiders, who have left that area of study, politics, political persuasions, field of practice, like law and medicine, government agency, particular college, environmental system, or whatever, who is way more damaging that someone from the outside of that system . . . you can never change a system from outside the system!  So given the fact, that I have paid my dues, done the dance, climbed the ladder, clawed and scratched my way to the top of the legal profession, in many ways, with a variety of notches on my belt, skins on my wall, lipstick marks on my calendar, and doing to for 20 years, it is hard for the government chicks, to catch up, imitate, or captivate and audience of readers, like someone who has taken no short cuts, to success, but walked one baby step at a time!

You cannot cheat your way to the top!  Just recently, here in Montana, we had an appointed, U.S. Senator, who was forced to step down from his actual and real bid for the Senate, and I believe he was a favorite to win, the seat, or at least a strong candidate, but for the fact, that some Republican think tank, or watch dog, with so much riding on these elections with the risk of losing control of both the House and the Senate, back in Congress, dug up the dirt, on the man, finding that he had plagiarized his master's thesis, while in the military academy.  Other candidates, have had to bow out of races, for the very same reason.  I am glad to see that there is a swift hand of justice, that protects, the work product and intellectual property of a person, who has paid the price, to be where they are, to write the things they do, and to claim credit for their work, without the fear of some low life, dumb ass, stepping in and saying that they were actually the one, who wrote the article, did the research, attend the necessary college, or took the tests to be called an attorney, doctor, professor, engineer, architect, cop, judge, elected official, teacher, etc.  To do anything, other than give credit where credit is due, is total bull shit, and disgusting to the lowest level of scum . . . and to have the cops, the government, family, church, power structures, even in Washington, D.C. decide to give the honors, the credit, the award, the money, the case, or whatever, to a lesser person, woman, even if she has the greatest ass and tits, that man has seen, usually cheated on that too, is fucking horrible, at best!

Graduating Senior, Plagiarized His Paper in My Argumentation & Research Class, at Utah Valley College/University--YOUR OUT!

I started teaching argumentation and research at UVU, transitioned to university status, either while I taught, or just after I finished, and took a job at the Utah Prosecution Council, Criminal Enforcement Division, of the Utah Attorney Generals Office, while I was a third year law student, so I was a busy as a law student could get, with school, a job, a research assistant for three law professors, and a teaching assistant, in small section torts, teaching legal writing, and taking care of my four children, keeping them on the straight and narrow path to the absolutely wonderful human beings that they are today, in spite of their over taxed mother!  So, needless to say, I was busy, plus, I was keeping company with two boyfriends, in my spare time, being recently divorced.  So, this either lucky, or poor engineering student, who happened to plagiarize his last semester, needing my class to graduate, must have had all the stars in the heavens, lined up against him, or for him, depending on who you, the read, wants to look at it!

But, one day, while I was sitting up at Deer Creek Reservoir, enjoying the fall leaves, gorgeous scenery, and autumn, splendor, and correcting my students, English papers, I started reading one about Mega Cities . . . and as I read, it hit me, that first of all, this kid was writing far above his level of expectation, or rather, my level of expectation, for mere college students, in fact, even for the law students, at Brigham Young University, with years more experience writing under their belt.  Red flag, number two and the killer, was the fact, that as limited as my time was, while I was at the Heber City Library, Utah, one day, doing some homework of my own, waiting for one of my flames of the year, Jerry, to get done, doing something, I happened to walk through the periodical section of the Library, and noticed, a National Geographic Magazine, with an article, entitled . . . MEGA CITIES!  

The engineering student, was far to smart to name his paper, the same name as the article, but the more, I read, the more and more familiar the student's term paper had become.  Now, I was a bad ass professor, or adjunct professor, even more hard core, than any undergrad professor should be, because, I was simultaneously, teaching, at the same time, I was being graded harshly at the law school, on a curve from hell, so, my expectations of these students, was probably a bit high, and I am sure that I put the fear of God in them . . . and told them I never gave away cheap "A"s . . . and I didn't even give one for the first two years I taught at the college!  And expectation is a built in resentment, so, I didn't want the students either proving to me, that I didn't teach them well enough to write for the one setting the standards, so I eventually, softened a bit, and started giving a few A's, but they were not cheap!  Although a few years later, I had a student, who, bravely came and stopped in to tell me, that she had transferred up to the University of Utah, where I was then teaching family law, and she said, I hated you beyond words, for giving me the only C, I even got in college, but a loved it when I transferred, because you taught me how to write, and a C in your class, is an A, in anyone else's class!  She was now pulling straight A's and entertaining the thoughts of going to law school . . .

You Make a Grown Man Cry!

So, back to the story of the cheating student . . . the next class, I pulled the cheater in and told him the bad news, that he was kicked out of my class, failed and would have to enroll in the class again, but not in my class.  He just stood there, looking at me, like he couldn't believe, first that he got caught, and second that I would take his offense so serious, as to fail him and kick him out!  He begged and pleaded with me, said he had to have this class to graduate, and he was graduating either that semester or in the spring, and he needed this class.  I reminded him, that at the beginning of every semester, while I was going over the term and the work necessary, covering the syllabus, and informing the students of the value I placed on writing, and that I hated professors, who made grades cheap, like some I had in my undergrad, as an English major, and then, I covered the issue of what would happen to them, if they plagiarized their papers.  So, in my mind, there was not excuse for this student, I didn't rely on general college ethics, I covered it and gave examples, so, there you  have it, YOU ARE OUT!

While he was crying, and asking if he could make up the grade, begging me for mercy, I started to lecture him on what the larger or bigger picture of the problem was, that if he were to be an engineer, a bridge could collapse, or if a doctor, a patient could die, or a lawyer, someone could lose their fortune, their children, their job, or even their life, with the death sentence.  I informed him that he was going into a profession and there is a reason, they call people in these fields professionals, and that is because they are held to a particular standard of service, care, or expectation, that far exceeds, some other areas of employment, because so much is expected, their are licensing issues, and tons depends on them knowing their shit . . . although, I didn't swear as much in those days; I hadn't been a criminal defense, civil rights, or constitutional law attorney back in the day!  But, I was hoping, that while a tough lesson to learn, as in the case of our Montana Senator, we just can't abide by cheating, it doesn't do anyone any good!

People Trust Me & Read My Blog, Because . . .

Prior to the government fucking with my blog, splitting it, playing games, taking 8 hits, for every one I get, with the same information, same picture, same, basic name, other than lightening the word ass, then getting caught at that, then making it look the same, but still getting the money from the blog, by the fact that as soon as people who had grown used to finding my work, under bad con law chick blog, but in the title on the page, bad ass con law chick, and now, taking that other site, at least for now, as of last night, leaving me, the one, they have buried for the last year, after hitting the 13 million hit mark, just three weeks into the blog, later hitting or getting results at 155 million, with them bank rolling me, daily, literally their Daily Bread, probably marketing my work in a book, like they did with my emails, that were long, exhaustive, and comprehensive dialogues with clients about key legal and constitutional issues, dealing with my famous, multi-million dollar cases, that they stole the computer on that one as well, but, I am going to say, that I refused to take money, even a penny a hit, or result, over the 200,000 mark, making up to, $300,000 for one day, hitting that mark, not just once, but twice in one day, because, my goal, as stated so well by the British band, New Order, when asked if they made a shit load of money, Bernard Sumners, said, We didn't make music to make money, we made music, to make history!

I wanted to use the knowledge, education, experience, adventures, escapades, romps, and whatnot, to enrich, change, elevate, and improve lives, change nations, better relationships, make a better America, and a better world, one based, not on power, money, greed, hate, police, but literally, a New Order or a New Beautiful World . . . evidence of that change, came yesterday, as President Obama and the Chinese leadership, made a back door deal, to curb carbon emissions, as the two largest consumers and users of that type of energy, hoping to set a standard for the rest of the world!  KUDOS!  Or as I mentioned the other day, the leader of North Korea, letting two American prisoners go, way cool, and a new beginning, hopefully of peace, sanity, love, improvement, and an uptick, in all conditions of humanity, with rights, protections, happiness and prosperity for all members of the human race, homosapians, in this food chain of intelligence, and hopefully, my blog will inspire students, to give college their best, high school, junior high, elementary school, we fucking need smart people to pull this world peace coupe off!  Learn your lessons, pay your dues, take baby steps to success, for it is preparation and opportunity, that meet, when success happens!

This morning, in the Daily Inter Lake Newspaper, there was a great cartoon, of the little PC owner, getting choked by the hands of the NSA agent, sticking his head out of computer, and ringing the guys, scrawny little neck, if I remember, and a huge guy, representing the government, wearing a suit, and a large smile, with the caption, saying something like, sure, we will take control of the Internet, under the auspice of Internet Neutrality!  The mantra and motto for the government, is first we break them, then we make them . . . or in other words, the government agency, the National Security Agency, through the PRISM program, and other federal spying programs, under FISA, or the Federal Intelligence Surveillance Act, has basically given federal cops, and to some extent state and local cops, almost total access to all your personal information, through meta data gathering, from all the people you trust with your email, computer service, and phone services, so at the drop of the hat, at any given time, regardless of connection to terrorist organizations allegedly outside the country, or like with me, I don't know anyone outside the United States, other than a Mormon missionary or two, who you really should be afraid of, because they will be your next generation of FBI, NSA, or CIA agents, spying on you, thinking they have every right to do so, because, as they are brainwashed in the Mormon Church, extending that brainwashing to the government, they will end up working for, against your interests, when authority figures have spoken, like the church, the government, a boss, THE DEBATE IS OVER!

These are the ranks and files of educated, useful idiots, that have been raised in a church that gives little credence to the principles, understandings, concepts and tenants, of everything that is involved in government's number one priority, and that is to protect the rights of its citizens!  You see, you need to look to Utah, the umber police state, with Mormon Church tentacles reaching the greater majority of the intelligence community, that is filled with brainwashed pansies--who were either raised in a state with no concept of the U.S. Constitution, let alone their own state constitution, and that is including most attorneys, who know little of either, and they believe in a patriarchal male dominated society, the Mormon Church, who runs, all three branches of the government, with absolutely not separation of church and state, and big time connections up to the highest ranks and files of government, bar none, even with two Mormon attorneys, drafting, the Bush and Cheney, water boarding policies for their administration, that should be charged with war crimes, just like Hitler's SS men!  

IT IS ALL ABOUT FREEDOM!

The Internet, provides the greatest avenue of free speech the world has ever known, and it is for the good . . . if a government, a church, an agency, or any entity, can't stand the light of day, transparency, openness, dialogue about its activities, then something it fucking wrong!  And if people are angry about what one of these groups is doing, it is probably for a damn good reason, because there is not reason to not conduct meetings, acts, votes, agendas, in a transparent means, keeping government leaders, on their toes, doing the right thing, limiting corruption and fraud, altogether . . . if you can't stand the light of day, get out of the limelight, and crawl back under the fucking rock you came out of, we don't want you, your policies, or your programs!  Internet neutrality is nothing more than controlling our 1st, 2nd, 4th, 5th, 6th, 8th, 9th, 10th, 11th, and 14th amendment rights, and all others to a lesser degree . . . WE DON'T WANT IT, WE DON'T NEED IT . . . if fact, we need more openness, transparency, light, observation, open dialogue, and debate, that is what makes up the workings of great governments, legal decisions, policies, procedures, cases, decisions, in put from everyone, then making a decision.

No More Big Brother, Big Sister, We Can Think for Ourselves!

I have worked in five statewide jobs, at the highest levels of state government, and risen professionally and legally to the highest level of laws, cases, and court oversight, and I know how good, government can be, but, I also, have learned how fucking bad, corrupt, inert, inept, devious, secretive, and closed, with the outcome being far less than admirable, if not downright corrupt and criminal, when there is only the fox guarding the hen house, so to say!  There are places that government oversight is needed, like on Wall Street, when they have proven to be absolutely greedy, deviant, corrupt, liars, selling fraudulent products, inane loans, gouging the American public on all sides of a home purchase, refinance, or mortgage modification, leaving many without homes, and the bank coffers bloated, on fees, fines, and all kinds of mortgage insurance, 9 to 30 times the worth of the house, bundling, laundering, selling mortgage back securities, that fuck everyone except the banks . . . yes, there is a time and place, when a whole industry or segment of the American system has failed the people, and while I am thinking about it, why doesn't the government take control of the Federal Reserve Bank, with absolute freedom to set interest rates, mess with and manipulate the stock market, print money, without a gold and silver standard or backing, start there if you have a need to control, control something that is out of control, and unmanageable!

Stay the fuck off our phones, out of our emails, and get the hell out of our computers, our tax dollars, have better things to be spent on, than supervising us, when we have little power, other than to redress our grievances, and speak our peace, or gather and assemble to express either!  Geez almighty, we are not the ones who need monitoring, turn the mirror around and look in it, try the NSA, who is using this to stop me from writing at will, censoring, cleansing their errors, their bloody hands, when all I am doing is educating the people, as to what their rights are, what the law is, and speaking out against things that I don't agree with, from a pretty educated position, sharing ideas, thoughts, comparisons, and such with people, leaving them free to come up to their own conclusions, determinations, and resolutions, to government, legal, or church issues, believing strongly, that if people are getting the right information, they will mull it over in their own minds, and make decisions, that are best for their circumstances and their given situations, within the framework of their vote, their government, their churches, families and lives, having touched many of those areas, in a professional arena, with a bit more insight, that can either be heeded or discarded, according to the readers will.  But, the Internet, give access, to the world of minds, ideas, and the benefit of other people's educations, without actually going to school, in that area of study, with all the benefits!

To Me, Government Control of the Internet, Is The Equivalent of Book Burning, By Denying Open Thought

What doesn't kill you makes you stronger, stronger, me, myself and I, stand a little taller, etc.  A song that is on the PA system, right now, and some good advice to the government, elected officials, agencies, churches, what doesn't kill you makes you stronger, stand a little taller . . .  If you are threatened by the truth, ideas, or controversies, that may involve your entity, then, perhaps, you should take a look at what your are doing, and adjust, either to fit the times, modernize your thoughts, that may be abhorrent, like polygamy, let it go, and get with the time, get over it, I will demand uniform operation of law, equal protection, so think again, when you collude with Muslims and their programs of multiple wives, we will as in the early days of Joe Smith, first prophet, we can be sealed to more than one man, and at the same time, with modern gals, not brainwashed, you got problems CENTRAL!

We don't need to go backward, there is not need, we don't need closed societies, systems, and formats, taking control of the Internet by the government is only, to possibly destroy the very reason for a government, making you obsolete!  In the Declaration of Independence, at any time that this form of government doesn't serve the needs, will and wishes of the people, we are advised to CHANGE IT!  With growing sentiments, screaming for more, not less freedoms, liberty, and rights, that have slowly been eroded, while many, including, WE THE PEOPLE have slept, and have nobody but ourselves to blame, for failing to be vigilant, a watch dog over our government, and pushing back, like people are starting to do, working the government, the way it was intended to be, with public officials, elected officers, working for us, not for themselves, and their private bank accounts!  We are just fucking sick and tired of it, get with it, or we will disband, you and start over!  Don't tempt us!

I Qualify as a 20 Year Veteran of Domestic Wars

Often, when we honor the fallen, those serving, or those who have served this country, to keep it free, we fail to acknowledge, those who have laid their lives on the line, fighting domestic enemies, not only of the state, and the nation, but of WE THE PEOPLE, a very different war in deed, and one with enemies, not so easy to identify, because they may be our neighbors, our friends, our church members, working in ways and using means, that violate and injury our American way of life, freedom, liberty, rights, that we have all become accustomed to, and expect as American citizens . . . they may work on our streets, in our courts, for our government, and in our military, having access to the tools, power, machines, and technology to bring this nation to its knees.  I would say that Edward Snowden, among other alleged whistle blowers, who then have the powers that be, turn the tables on them, and try to assassinate their characters, make it look like the whistle blower is the bad guy, the evil doer, the less than American, doing wrong to the system or threatening national security, the catch all for people, willingly giving up their rights all in the name of safety!

These people, not to unlike myself, are heroes in their own right, taking on a system that has long violated the United States Constitution, the terms of agreement between the governed and the government, with the citizens, creating the states, that in turn created the governments, with the sole and major responsibility of protecting, providing and defending citizens' rights, those not so minor, inalienable rights, that make all men, created equal in the eyes of their creator, who is actually the provider and originator of those rights.  Often we turn those rights around, that neither man, governments, cops, prosecutors, or judges, can take away, unless their is due process of law, both procedural and substantive, with equal protection under the law, or uniform operation of law, providing justice for all!  Many of the violators, do not even know the Constitution, were trained under the Patriot Act, the PRISM system, using Federal Intelligence Surveillance Courts, to take away a citizen's rights to privacy, without them even knowing it, or allowing the NSA, or National Security Agency agents, to look into your bank accounts, your email and computer accounts, or check your phone records. The people that do this, are domestic enemies, who daily violate your rights, and those who help bring this to the attention of the public, are actually soldiers of this country, serving in a different kind of war, but no less the warriors of freedom, liberty, rights, numerated and non-enumerated . . . and the government, or Congress, or the President, just can't take those away, without violating the letter and spirit of the Constitution, thus making all of these actions void, being repugnant to the Constitution!

I was thrilled to note last year, that Edward Snowden, was nominated, or actually came in second, and would have been first, for TIME Magazine's Man of the Year or Person of the Year, had it not been for the fact that the new Pope Francis was chosen by 1.2 billion Catholics, represented by Bishops, Cardinals, and other Church hierarchy, in the Senate at the Vatican, Snowden, would have been the selection, and well deserved!  Snowden, who loved the country, enough to risk his own citizenship in the USA, is safety, and even his life, and many, many, many, risk their lives daily, as unsung heroes, fighting on our own soil to keep you free from domestic terrorism, perpetrated by your own government!

The Law of the Jungle . . . The Militarized Robo Cop  

We should not over look, fail to mention, and appreciate the people, who are fighting for you in the courtrooms, the backrooms, and in the gorilla warfare that is going on everyday . . . for three years, almost, minus a two months, since the very day, or rather, before, I was sworn into the United States Supreme Court Bar, well, actually starting the October before that, while I was filing the necessary paperwork, with petitions and briefs mounting up, the local cops, I am sure at the direction of higher ups, took out the engine, the transmission and the oil filter in my truck, with me needing to be in court, in Salt Lake City, Utah, over 250 miles away, that very day, having put an incendiary device on my tires, making them explode with a whole over an inch and a half wide, in my brand new, beefy jacked up tires, sending me careening into the medium, then almost rolling across the two lanes of freeway, then almost tipping over, as I slammed on the breaks and landed on the side of the road, with a tire, completely mangled!  But for the grace of God . . .

Okay, so that was then, and this is now.  Again, lately, the CIA assassin chick showed up, now twice, out of now where, the reason, I left Kalispell, last summer, after ratting out the CIA's drug running enterprise, into the local airport, and taking the drugs up to Canada, via Tobacco Valley, north of here, right near the Canadian border, just like they used to do, 17 years ago, flying drugs and firearms, every night at 12 midnight, into the Heber Valley Airport, pushing one local informant, from an airplane, after she disclosed to some friends, what was happening, with them watching the sheriffs and other cops, meet the small planes, every night.  This type of activity is not new, and has been around since the inception of the CIA, dealing with crime syndicates, paying off the very people they are suppose to be arresting and investigating, to get a cut, and then promising to let them continue in their endeavours,without fear of investigation and prosecution.

Like I said, the only way I can prove all this, is if I end up dead, or jailed, incarcerated or detained for the rest of my life, with over 25 deaths I can validate and prove, or used to could, that were either former clients, or somewhere connected to my cases, people who got in the way, or just recently, as of September 1, 2014, was tasered by the cops, and he died, they know right were to taser a guy, to cause death, with this friend, Michael O'Connell, a graduates of Stanford, in Chemical Engineering, or something like that, the perfect type recruited to work either in government contracting or with the NSA and CIA, who he was terrified of, and came to warn me, because of my blog, and some of the things I was writing . . . these are and should be, our unsung heroes . . . yet, we are the first to rat them out, turn them in, and feret out for the feds, and others, where these people are hiding, that norm for this type of activity, telling on the government, exposing them, or defending the rights of the people!

So, yesterday, just minutes after I finished my blog on Veterans Day, and stating that I am going over to the Depot Park, I want someone, knowing where I was last, before I get blown away, or taken, jailed, etc., so I often report where I was last, or where I at least wrote my blog, so I can, maybe be found, or at least have my body found . . . As I a waiting a minute, making one small correction, this guy, who had said, markedly Hi, to me earlier, while I was blogging, came and parked his ass, by me, bugging the hell out of me.  He asked me what I was doing, and where I was going, or what I was going to do today!  I said, do I know you?  He said, yes, I see you at the Samaritan House, oh.  Well, I am going over to the Depot Park to hear the Veteran's Day Celebration, really, an no brainer, for anyone, who knows me, that would be a given, even as cold as it was.  I half thought this too weird, even if he thought he knew me, to ask me where I was going.  We are creatures of habit, and I love this country, had just written about it.  I told him, and the person he just called, that they should go over and honor the Vets.  He didn't seem too interested.  My red flag was up, something was up.

I don't think, I have ever seen a guy, quite like this, fit as hell, nice teeth, beard, cheeks so chiseled that there was a crease down his cheeks or face, like you see on Call to Duty, game video type guys, wearing a varigated greens, knit beanie hat, navy green or dark green jacket--as I recall, Levi looking pants, nice boots, and as he walked in front of me, acting like he knew the husband and wife, team, holding one child in their arms, and another in the stroller, he lifted his jacket, and tucked in behind a gun, on his waist . . . not a sight you see everyday, even in Montana.  I gave him the benefit of the doubt, and decided to watch him, as he went over to the brass that was in charge, and they didn't seem to acknowledge him and were wrapped up in their conversation, but he was trying to act like a local, or blend in, which was fucking impossible, looking like he did.  

I listened to the speaker, a decorated Vet, with a resume that took longer to read, than his speech was on this freezing November morning, and kind of blew off the guy, although innocent, until proven guilty, may have been giving this guy too much leeway, but, later, my eyes caught up with him, mingling with the crowd, but acting like he was looking for someone, almost frantic by this time, head bobbing up and down in the crowd, but a ways from me, disguised as I was . . . luckily, due to the cold, I had taken my black sweatshirt hoodie and pulled it over my black baseball hat, with a very distinctive design on it, that was now covered, with Mr. Mall Rat, probably calling in the latest and greatest, description of what I was wearing, leaving me, standing right behind this guy, not wanting anyone standing behind me, blocking the sunshine, the only warm thing, with just a mere shadow, making me colder. The speaker cut his remarks, short, due to the cold and invited everyone to the Elk's Lodge, a mile or so, to the south side of Kalispell . . . I decided it wasn't worth it, but I noticed the green check of the Nike shoes, on the guy in front of me, and thought, is that a sign I should go, a God thing?  I blew it off, opting to go spend the rest of my gift card from Starbucks, with hot chocolate and a sandwich, already on my mind as a reward for withstanding the cold, I am a wimp!

Once again my eyes, shot right to the stupid black, with a green Just Do It check on this guys shoes, annoying me that my eyes would go there AGAIN!  The buses were not running that day, and it was fucking cold, and a hamburger, was normally worth it, but not today, but being the obedient agent, of the God Squad, I started to walk down the streets of Kalispell, looking in store windows, and heading toward the Lodge with free food, and two cool elk statues out near the road, and one elk up closer to the building, that I hadn't noticed before.  The guy who was the announcer, invited everyone who attended the ceremonies, to come have free burgers, or so I thought.  When I got there, expecting the madding crowds, I noticed a very small contingency of uniformed military and their wives, most eating by the time I reached the place, but there were a few people left, waiting for food, and as with the Mormon at the Catholic BBQ in Missoula, and the Catholic Oktoberfest, I joined in, not thinking anything until, I got there smelling the food, and refusing to leave!  LOL!  Some guy asked a woman across the table from me, if she was a Vet, and she said no, he never asked me . . . apparently, my unofficial, warrior status as a Vet of an undeclared war, on the streets, in the courts, and in the governments of America, was highly apparent to this man, and he served me with all reverence, as he should!  And I am not kidding, for the hell I have been through the last three years, now!  Good God almighty!

My Table Was Near Copies of the Constitution, the Bill of Rights, Other Documents, But Centered on the Monroe Doctrine

Being the nerd that I didn't start out life as, but have grown more and more, to have become, the documents caught my eye, and I knew, that sometime, in my high school years, taking world history, I had remembered the teacher, briefly mentioning the Monroe Doctrine, but being more concerned with boys in those days, I could not remember, for the life of me, what the hell it was about, so I took the opportunity, to read the document . . . written in 1823, just years after the young United States was formed, but I was still taken with the nice, but very pointed, warning to, what must have been the world super powers of the day, Britain, Russia, and Spain, and several others, that this gutsy, upstart of the country, was basically saying, you step one foot on our home soil, and we are going to fuck with you like you have never have been fucked with before!  That is my take on it, but it was stated in much more, gentile language of the day, but implying just that, long before, I think we had a Navy, whooops, Star Spangled Banner . . . I am not going to go there, because I remember my daughter showing me her inch and a half thick blue covered book, if memory serves, of all the stuff she had to know, to pass some test, and much of it was on the history of the Navy, and it is mentioned in the powers and duties of Congress, so, logical deductive and inductive thinking, would tell me, that there was a navy, in 1823.

Nonetheless, I hate, not knowing what anything stands for, especially, when it is near, those other documents, that are so near and dear to my heart, the ones, I, along with every other officer of the court, military, legislatures, local, state, national, cops, and tons of other people took an oath to uphold, with about 90 percent of them forgetting that they even raised their arm to the square, and took those oaths, without it meaning too much to them at the time of swearing in . . . pitting them against another oath keeper, in the jungle warfare, I find myself in daily!

Samaritan House Starting to Look Dicey!  Almost Left for Shelby This Morning . . . But, Got up at 3:00 a.m., out the Door by 4:30 a.m., Trick or Treat?

When you start to connect the dots, you start to see patterns, that start to set up red flags, and that has been happening, in the last few days.  This systemic violence, much like domestic violence on a large scale, puts the victim, threatening to leave, at the highest level of risk, because the abusers, are going to lose the fun of putting you in fear of them, making you walk on eggshells, with the victim, me in this case, knowing full well, that something is up, and the battering system is activated, and the blows are just waiting to happen, normally when the abuser will kill his prey, rather than lose them.  So, Monday, I notice a guy, who looks very government, with no apparent reason, just like last time, to be, hanging around in the kitchen with Corky, just chillin', really?  I just don't think so.  Then there was the guy, who must have followed me to the mall yesterday, before the Veteran's Day Ceremony.

And when I got home, last night, I had a new roommate, have been alone all week, so I was somewhat surprised, but it is cool, so that could be normal.  But Corky, told me one day, that I would be getting a roommate . . . this is a transitional housing service, and how would she know that I was getting a new roommate?  Other than the last time I stayed, a few weeks ago, I know my roommies were ratting me out, watching my comings and goings, and asking me, where I was going, when I would be back, and all kinds of informational type questions . . . not hard to see where this is going, so I split.  I tried not to talk to the chick, and was somewhat bothered, when she interrupted me, very intrusive, coming in my room, with her having the other room to herself, and me the second room, with a common bathroom and hall.  She could easily, be an agent, and her boyfriend, who is staying at the Sam House too, actually happened to have been, an elite riot guard member, at some prison in Washington state!  So why in the hell, is he here, allegedly homeless, looking for work?

Corky was off yesterday, paid holiday, but today, the same guy, you know, just 225 lbs. of him, kind of like the elephant in the room, CIA/FBI looking guy, is back just hanging with Corky in the kitchen again, no biggie . . . right?  Wrong!  I look at the TV, and it says, PRONTO!  At the time, I saw that, I didn't know this dude was in the kitchen, but after I put my dishes away, and saw him, I knew, that message was from my Intel guy, God, and I booked it on our of there, through the back door, where his brand new, shiny Chevy truck was parked, out in the alley way, his payment for taking me down?  My enemies, money launder the bribes, with truck loads of new vehicles, that used to frequent St. George, and now I am seeing more and more of them now, improving economy, or God's Revolver $$$$$ kicking in from around the world, with the new uptick, thanks to me, but capitalized on by my domestic enemies!

After having a great burger, and walking back to Starbucks, what is getting into the Christmas Spirit, I luck out, get a chocolate cookie and hot chocolate, using the remaining money on my gift card, that I am so grateful for, not only for the food, but to legitimize me hanging out in the coffee shop for a few hours, while I stay out of the cold and get off the streets with, cops, sheriffs, cruising the area with regularity, so, fun atmosphere, fire in the fireplace, and some puzzling recommendations.  What does polygamy have to do with baby snatching . . . and, like clock work, the Mormon NSA, just joined me, trying to stop this blog, before I start talking about Mormons, Mobsters, and Men in Black, or the guys BABY SNATCHING, and the ones who are promoting polygamy, as a carrot for other non-Mormon MIB!  LOL!  I am already a polygamist, married to two of these fucking assholes, making up the core cadre of my enemies, to this day, with the first one, Brett, refusing to divorce me, so he could taste all the Southwick flowers, married or not married, as well as work with Daddy Warbucks, replacing me as daughter and wife, with Kay Baby, and the rest of the Southwick Bouqet!  It takes a binder full of Southwicks and friends to make up for losing me, darlin'!

Pity Parties, End Quickly, In Montana . . . Huge # of Vets!

When I get feeling down, that all my earthly goods, all I worked for, even family pictures, that are in the hands of my enemies, are all gone, and I am literally, an officially declared, Bag Lady, gratefully, staying at the Samaritan House, with a warm roof over my head, food in my belly, and discussing politics, with Vets every morning over breakfast, as we watch the morning news on TV, all I have to do, is remember the sacrifices of those who have served our country, given their hearts and minds, often in undeclared, and less that worthy wars, benefiting government contractors, and to pump up the economy, get in the souls of these men and women who, so willingly, bravely, and commendably, put on the uniforms, and swear the oaths, of their individual branches of the military, and risk, it all, home, family, relationships, life and limb, my sacrifices, not only seem small, as basically monetary, with challenges, with the vultures even wanting my kids, my grand kids, and anything I put my golden hand to, to lay in wait as Satan himself, seeking to destroy, steal and kill, all I have to do to get perspective, and put my own sacrifices, into the bigger mix, is to think of the Veterans of all the wars, declared, or undeclared, scrimmages, around the earth, that, if not promoting American ideals, protect American interests, and defend human dignity and rights across the globe, something we can all be proud of, to say the least.  Thank you from the bottom of my heart, and beyond, if possible!

I am sure that the reason, my kids, especially, my two daughters, who were even more free thinkers than their parents, signed up and pledged to defend, protect and preserve, not only the United State Constitution, but protect America from both foreign and domestic enemies, serving their country, while their aunts, uncles, grandparents, boyfriends, and others, thought, that was the last thing on the face of the planet, two bright, Mormon, girls, who were even scouted out for careers in modelling, with stood all the criticism, however, not from their mother, knowing full well, that as young girls, they mocked, Mormon testimony meetings, probably due to listening to their parents, or coming up with the sob stories, imitating the criers in church services, yet, observing, the silent tears that ran, freely down their mother's cheeks, as Memorial Day Services, or at Veteran's Day Ceremonies, that as the stories of valor, of bravery, of sacrificed, touched my heart, deeper than that for church, recognizing full well, that, it is this country, the U.S. Constitution, that allows people to worship as they please, or as they don't please, free to be atheists, agnostics, deists, pantheists, Muslims, Jews, etc.

As we see ISIS or ISIL, behead, torture, threaten, kill, burn Christians, actually rolling a pregnant woman, in cloth, because her clothes would not start on fire, after burning her husband, then forcing her into the flames, as people cheered!  We see young women, who are of the Islam faith, falling in love with Christians, and see them murdered, tried, jailed, for love of an infidel!  Jews have been persecuted the world over, scattered, with horrific death, scientific experiments, gas chambers, in Germany.  All over the world, people have been persecuted for their religious beliefs, except in America!  Sure, we are dealing with people's individual religious issues, that use that the pressure, with anything going on, it is the Christian right, who has the religious freedom to persecute other!  The opposite is true in America, it is the non-believer who is held at bay from practicing their form of non-religion, that is equally protected under the Constitution.  So, thanks Vets, for creating a bastion of freedom, unlike the world has ever know before, and still in most parts of the country have never experienced . . . thanks for putting on that uniform, protecting freedom, liberty, rights, a beautiful country, worth fighting for, setting an example, like a lighthouse on the hill, for the rest of the world to see!

Principles, Concepts, Rights . . . For All Mankind!

I think there is about 190 something countries, in this world, with two in the Ukraine just taking out sovereign status as a free standing country, stopping the tug of war, between the countries of Russia, and the Ukraine, with rule over them since, about 300 years ago, and officially since 1954, if I can remember from reading the newspaper, over the past 6 months, since the Ukraine voted to go more with the western part of the world, voting for alliances, and trade, with closer ties to the UK and America, inciting the Pro-Russian separatists, who just held the allegedly unconstitutional elections, freeing two areas, from Ukrainian, control, with Russian just over the borders, breathing down their neighbor's necks!  But the good news, is they did not vote, like Crimea, to rejoin the eastern block, but remain, neutral, if you will, while leaning toward the eastern block, remaining in a position to partake of the benefits of both, so to say, not a bad move, and much better than a continual war over there.  So, over 100 countries, in forming their own constitutions . . . agreed upon laws, that both the governed and the government have to follow, or should as they evolve into the country, they all agree they want to become, have adopted and used as a model taking parts of the United State Constitution, as a guide, a touchstone of human rights, and civil rights, that they want for their own citizens.

Every country, has much to share with all the countries of the world, and as we get more and more connected, through social media, trade, technology, industry, and politics, we are becoming a better world, and that is much to the stance of America, backing allies, human rights, and fighting terror, worldwide, as one of the planet's SUPER POWERS!  What comes with that status is the duty, the expectation, the responsibility to help, smaller, newer, less powerful countries, who face, challenges from other world powers, divisions, and economic systems, to survive, thrive, and grow, under the constant friendship and alliances, with America . . . and fucking right in the middle of that is the AMERICAN SOLDIER!  America, never, never, never, would be what it is today, without those men and women, ready, willing and able to serve their country, in places, parts of the world, that Congress and the Commander-in-Chief, the President, in wisdom, sends them in harms way, hopefully through thoughtful consideration of the costs, the sacrifices, the lives, and all that is asked of our troops, to do, in the name of freedom, liberty, democracy, rights, human dignity, and all that is good in human beings!

In America, We Expect A Lot, And We Always Get A Lot, From Our American Soldiers!  Freedom, is NOT Free!  Tears, Running Down My Cheeks, THANK YOU!

P.S. I could go on forever, but I need to cross the street from the Kalispell Mall, to Depot Park, where there will be a Veteran's Day Memorial, and speaker . . . parents, if you want your children to love this country, attend services, that literally bring tears to your eyes, and you need not say more, your children will get it, without you saying a word!  I never knew my kids were even watching, actually embarrassed for crying in front of them, often wiping tears out of my eyes, as right now, so they wouldn't see their bad ass mother, crying, for this great country!
