The USA PATRIOT Act is an Act of Congress that was signed into law by President George W. Bush on October 26, 2001. Its title is a ten-letter backronym (USA PATRIOT) that stands for "Uniting and Strengthening America by ProvidingAppropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001".^[1]

On May 26, 2011, President Barack Obama signed the PATRIOT Sunsets Extension Act of 2011, a four-year extension of three key provisions in the USA PATRIOT Act:^[2] roving wiretaps, searches of business records (the "library records provision"), and conducting surveillance of "lone wolves"—individuals suspected of terrorist-related activities not linked to terrorist groups.^[3]

From broad concern felt among Americans from both the September 11 attacks and the 2001 anthrax attacks, Congress rushed to pass legislation to strengthen security controls. On October 23, 2001, Republican Rep. Jim Sensenbrennerintroduced H.R. 3162 incorporating provisions from a previously sponsored House bill and a Senate bill also introduced earlier in the month.^[4] The next day on October 24, 2001, the Act passed the House 357 to 66,^[5] with Democrats comprising the overwhelming portion of dissent. The following day, on October 25, 2001, the Act passed the Senate by 98 to 1.^[6]

Opponents of the law have criticized its authorization of indefinite detentions of immigrants; the permission given law enforcement officers to search a home or business without the owner's or the occupant's consent or knowledge; the expanded use of National Security Letters, which allows the Federal Bureau of Investigation (FBI) to search telephone, e-mail, and financial records without a court order; and the expanded access of law enforcement agencies to business records, including library and financial records. Since its passage, several legal challenges have been brought against the act, and Federal courts have ruled that a number of provisions are unconstitutional.

Many provisions of the act were to sunset beginning December 31, 2005, approximately 4 years after its passage. In the months preceding the sunset date, supporters of the act pushed to make its sunsetting provisions permanent, while critics sought to revise various sections to enhance civil liberty protections. In July 2005, the U.S. Senate passed a reauthorization bill with substantial changes to several sections of the act, while the House reauthorization bill kept most of the act's original language. The two bills were then reconciled in a conference committee that was criticized by Senators from both the Republican and Democratic parties for ignoring civil liberty concerns.^[7]

The bill, which removed most of the changes from the Senate version, passed Congress on March 2, 2006, and was signed into law by President George W. Bush on March 9 and 10, 2006.

The PATRIOT Act^[8] made a number of changes to U.S. law. Key acts changed were the Foreign Intelligence Surveillance Act of 1978 (FISA), the Electronic Communications Privacy Act of 1986 (ECPA), the Money Laundering Control Act of 1986 and Bank Secrecy Act (BSA), as well as the Immigration and Nationality Act. The Act itself came about after theSeptember 11th attacks on New York City and the Pentagon. After these attacks, Congress immediately started work on several proposed antiterrorist bills, before the Justice Department finally drafted a bill called the Anti-Terrorism Act of 2001, introduced to Congress on September 19, 2001. This was introduced to the House as the Provide Appropriate Tools Required to Intercept and Obstruct Terrorism (PATRIOT) Act of 2001, and was later passed by the House as theUniting and Strengthening America (USA) Act (H.R. 2975) on October 12.^[9] It was then introduced into the Senate as theUSA Act (S. 1510)^[10] where a number of amendments were proposed by Senator Russ Feingold,^[11]^[12]^[13]^[13] all of which were passed. The final bill, the USA PATRIOT Act was introduced into the House on October 23 and incorporated H.R. 2975, S. 1510 and many of the provisions of H.R. 3004 (the Financial Anti-Terrorism Act).^[14] It was vehemently opposed by only one Senator, Russ Feingold, who was the only Senator to vote against the bill. Senator Patrick Leahy also expressed some concerns.^[15] However, many parts were seen as necessary by both detractors and supporters.^[16]^[17]^[18]The final Act included a number of sunsets which were to expire on December 15, 2005.

Due to its controversial nature, a number of bills - none of which were passed - were proposed to amend the USA PATRIOT Act. These included the Protecting the Rights of Individuals Act,^[19] the Benjamin Franklin True Patriot Act,^[20]and the Security and Freedom Ensured Act (SAFE).^[21] In late January 2003, the founder of the Center for Public Integrity, Charles Lewis, published a leaked draft copy of an Administration proposal titled the Domestic Security Enhancement Act of 2003.^[22] This highly controversial document was quickly dubbed "PATRIOT II" or "Son of PATRIOT" by the media and organizations such as the Electronic Frontier Foundation.^[23] The draft, which was circulated to 10 divisions of the Department of Justice,^[24] proposed to make further extensive modifications to extend the USA PATRIOT Act.^[25] It was widely condemned, although the Department of Justice claimed that it was only a draft and contained no further proposals.^[26]

United States Constitution Controls the Patriot Act!

SOME GENERAL REMINDERS & CAUTIONS

The United States Constitution, is the Supreme Law of the Land; therefore, as Congress considers refunding the Patriot Act, there must be a line of demarcation, drawn between U.S. citizens, and alleged terrorists. Before anything can be done, to an AMERICAN CITIZEN, there must be probable cause, that a crime either is going or has happened, before doing an reasonable search or seizure, remembering, that the persons, places, papers and affects of American citizens have rights and protections, different that citizens of foreign countries or terrorists! And then, and only then, based on this probable cause, law enforcement, even covered agencies under the Patriot Act, like, FBI, CIA, DIA, DEA, ICE, local, state and national cops of any flavor, including the cyber cops, NSA

must obtain a warrant, through oath and affirmation, going to a magistrate or judge, who is an independent, and hopefully, unbiased, objective, approval, after the presentation of probable cause, listing with particularity and specificity, the persons to be arrested or seized, or the items to be searched and seized, as part and parcel of the crime being committed. The general rule, is that the 4th amendment demands, that cops prove that their search and seizure is not unreasonable, by an independent standard!

The only exception to the general rule of warrants by independent determination, by judges, not by cops, turning them into judge, jury and executioners of the law, is exigent circumstances or emergency measures! That exception is providing for the potential destruction of property, escape, or the crime is being committed in the presence of the law enforcement officers! The Patriot Act, cannot protect officers from federal and state, statutory and constitutional violations of civil rights, while acting under color of law, or as law enforcement or state officers! What has happened, it that, cops, state officials, in both the criminal and administrative areas, have gotten lazy, and have acted like, regardless of due process and equal protections, that must be their when dealing with citizens of the United States, providing, charges, notice, hearings, trials, appeals, that are constitutional rights, as is right to counsel. I am particularly concerned about detentions, without warrants, charges, notice and hearings . . . that opens the doors for cops and state officials, or local or feds, the same, to circumvent rights and protections! I see the three provisions of the 2011 version of three provisions, with the library records provisions, being interpreted as business records!

This is problematic, especially in light of regulatory government agencies, like the SEC or Security Exchange Commission, in light of professions, like physicians and financial planners, both of which, I dealt with, finding that administrative subpoenas, allegedly civil in nature, were far more invasive searches and seizures, that would be allowed under criminal means, depending on actions based on probable cause and an independent warrant issued by a third party or judge! However, the charges included the threat of fines, and prison time, criminal in nature, but in an administrative system! I know, that with the doctors, I got 9 federal agents, investigators, and attorneys, fired for not following their own regulatory provisions, based on administrative protections for constitutional rights, like due process and equal protection! Now, terrorists, foreigners to boot, are not entitled to constitutional protections, but they are entitled to UN or international protections from torture, war crimes, or deprivation and inhumane treatment, as agreed to by conventions, treaties, alliances, compacts, etc.

If you are a hammer, everything looks like a nail, but it is not . . . some might be screws, fucking government officials for violations of rights protected . . . government immunity is only, when WELL ESTABLISHED LAWS have been followed, in addition to regulatory rules, and department policies and procedures . . . don't be fooled by the Patriot Act!

How in the Hell Did You Get to Shelby? Again!

Well, let me count the times and the way, other than curiosity over the fight, I heard about, the first time on the Amtrak Train, going to Washington, D.C., to lobby against the Cyber Intelligence Sharing & Information Act, before Edward Snowden ratted the NSA, or National Security Agency out, and I threatened, Senator Hatch and crew from Utah, that if they didn't vote against the Cyber Intelligence SPYING & INTERCEPTION Act, I would personally come to Washington, and lobby against it myself, and do all in my power to trash their fucking, anti-constitutional names . . . Hatch has just come out with a book called, A Constitutional Hero? are you fucking kidding me! This violates, 1st, 2nd, 4th, 5th, 9th and 14th amendments, at best! You ask, this constitutional law attorney, what the hell the 2nd amendment has to do with spying on Americans? Well, I will fucking tell you . . . you know that little constitutional group, called state militias . . . yeah, I am talking the boys out in the hills, mountains, and valleys of Tobacco Valley, here in Montana, that preserve, defend, and protect their rights to bear arms? Well, the second, part of the 2nd amendment, states that to maintain a free state, states, need to have militias! And I can guarantee, there are government, infiltrators, parking their asses, right now, among you, and who do they know where you are and who you are?

Your right, through NSA, "to watch" lists! Kind of like the one, that I am on . . . during the run in Cliven Bundy, rancher in Nevada had with the feds and the BLM, with me squarely in the middle, where the Constitution, generally lands, both sides claiming constitutional protections, and they were both right, for different reasons . . . Bundy had private property rights, under the 5th and 14th amendments; however, Congress has the duty, right, and responsibility to make laws that the country needs, giving those departments, officials, and agencies, the powers to protect, manage, and maintain WE THE PEOPLE's, public lands! My daughter, Greta, was working with the BLM, from less than an hour's drive from Bunkerville, Nevada, in St. George, Utah, field office, and I was living with Tony Osthemeier, in Missoula, MT, who had constant contact with militia members . . . I wrote a blog about government infiltrators, and at the same, time was either given a book, or found it on Tony's shelf, entitled, They Fired the First Shot! A bible for militia members, just hunkering for a fight, as I believe the feds were . . . until, it only took 300 militia to back them down, rather than the 10,000 the feds, said the rancher would need to do anything . . . as the world looked on, and bridges, onclaves, and federal blockades, tried to keep militia members and their horses, flags and guns, in free speech zones . . . they know, that all of America is a FREE SPEECH ZONE!

FEDS did a POWERFOLD . . . and as my future attorney daughter, reported, to me last month when I was in St. George, for a grand-son's birthday, in April, to this day, Bundy, has not had to pay lease fees for using federal land, OUR LAND, paying grazing rights . . . ah, going from one extreme to the other, is not right either, it is fair to ask Bundy to pay his fees, not seize his cattle and auction it, but to do as the other ranchers in the area, and across the United States are doing, pay your fucking fees . . . welfare ranchers, need not apply! Anyway, as is generally the case, my travel and living plans are determined, by the local, state and federal cops . . . after being watched, tracked, blah, blah, blah . . . four different times on Sunday, as I crossed through the Kalispell Regional Medical Center Campus, where Frank Garner, who can't get the idea that there is a difference between being the police chief, and being in charge of campus security at the Hospital, must have some order out, since the last time, he and the Whitefish PD, followed, me with guns in tow, which Frank said he would never allow on campus; therefore, the plain clothed cops, is out of his jurisdiction, and was again, yesterday, and maybe Sunday too, for God sake . . . passed me 4 times, accidentally hit the cap key, and just guess what came up, the "$" symbol! If that is not telling, I don't know what is . . . are they on Shelley and Frank, Interpol, Mitt's Mafia, or the Mormon Mafia payroll . . . I would check Frank's religious perferences, but cop connections are good enough to prove what is going on . . . hell, they, the docs, ought to pave a golden path through the hospital, where I walk, I saved their fucking doctors from Medicaid/Medicare investigation, that are heating up again! Talk About Heaven and COPS . . . Painting in Hospital, Gives Me Hope for Them! LOL!

When I walk through the hospital, as a former, Utah Medical Association, the attorney, who was their general counsel, back in the day, before this new push to get docs, and was poisoned for saving the profession . . . the thanks I got, was getting poisoned and my clit cut off, by two docs . . . I love the art work, hanging in the hall, the one with the bright yellow background, a sun and sun rays, with hands reaching heavenward, as if reaching for Jesus Christ, the Son of God, and the light of the world. Now, either the artist had an accident when painting or transporting this picture, or there is a message, not even at a subliminal level, but right their in front of your eyes . . . just below the sun, there is a symbol of heat or an electric burner from the top of a stove or it is purposefully there, as a sign of, what else could it symbolize, COPS or HEAT, and in my case, SAVAGE HEAT! I guess there is always the hope, that cops can be rehabilitated, reformed, changed, which is all repentance takes! LOL! Just change your piss poor attitudes of power tripping on citizens, especially attorneys, who, if you would listen would and could be your best friend, stopping you from making mistakes, like telling cops, after Treyvon Martin, Davis, Rice, Garner, Michael Brown, to knock the shooting unarmed blacks, for dumb ass charges, there would not be 6, well, 7 officers and one cop volunteer, facing murder charges . . . fuck up their lives, at least for a while depending on how the jury, not the closed door, grand jury, finds the facts to be, as applied to the law!

Like, I said, a friend, tells you what you need to know, not what you WANT to hear . . . oh, you big strong, handsome, heroes . . . you are doing so great, we will give you militarized vehicles, reward you with big boy toyz! Roughly 6 months ago, when I spent a week in Shelby, covering the boxing match of 1923, I was daily reading the Great Falls Tribune, and as my luck would have it, and yours would not, on the front cover of the Trib, there was an article about the militarized armored vehicles, that, Great Falls and Bozeman, had just purchased and the two different responses to the vehicles. In Great Falls, the cops, just up and purchased one, a militarized vehicle, or had one on the way without the Mayor or the City Council approval, so the council and mayor, acquiesced to their request and gave the remaining monies from tax payers to cover the cost of the cities portion, not covered by government grants! I guess it is easier to ask forgiveness than permission! And then, you had a totally different response from students in Bozeman, who got a thousand or so signatures of people in the city, saying they didn't want one, and they could see no use for the armored vehicles, other than, chasing stray chickens and rounding up drunk students after homecoming games! Yeah, it was me, not the journalist with the blonde hair, and great legs, that wrote all 500 blogs, fucking in my list on BAD ASS CON LAW CHICK BLOG . . . bad con law chick blog, with all the hits, that is the pirates version or government giving access to NSA hackers!

While in Missoula, again, being chased or something out of Kalispell, the local cops were applying for a grant for an armored vehicle, with their portion of the cost, after the feds grant, being somewhere around, $289,000! That is a pretty penny, to go after the "extremist" Rainbow Gatherers, who come to Montana, every 16 years! One, cop, on Mayor Engan's Public Health Committee, who took public comments, even after a very smart, police chief, withdrew the grant application, after I wrote my blog, and there was about a two hour hearing on the subject, with local activist attorney and Rainbow kids, testifying with dogs in tow! LOL! But I think there are plenty of worthy causes, like the Great Falls Tribune, My Neighbor in Need or Need Help causes, that help keep people going who are struggling with challenges! Or you could have community policing BBQ's, like the Las Vegas, PD, or was that just because I was in town, and they know I love to eat, and would never, unless sponsored by cops, turn down a great BBQ! Now, what did you say your name was? LOL! Stupid, but I am not that DUMB! However, a great idea, for people, to put names, faces, and hearts behind the badges . . . I know you have them; you have to . . . to be alive, other than that I am not sure at times! LOL! Seriously, community policing works, a neighborhood, in the worst part of Las Vegas were able to meet with community leaders, religious leaders and parents and turn a bad neighborhood into a favorable place to live now . . . WE CAN DO THIS!

This morning on the news, the national newscasters were talking about spending time in their gardens, over the extended, Memorial Day Weekend, were talking one female news anchor, talking about getting her daughter, into the garden, and planting some veggies, and getting her excited about the number one hobby, worldwide, GARDENING! They were talking zucchini, broccoli, tomatoes, pumpkins, cucumbers, etc. FUN, FUN, FUN . . . and talking about turning weapons into plow shares or garden tools, inner city teens, who are involved in community gardens, are 50% less likely to get involved with drugs, crime and other bad shit! I know, First Lady, Michelle Obama, is pushing gardens or has been for the last 6 years, grows one on the South Lawn of the White House, and invites kids to come work, with her in the garden! WAY COOL! I am going to put a plug in for the gardening book, Ms. O, helped write with her chef, I think . . . beautiful pictures, and great growing ideas. Many past presidents grew gardens on the south lawn of the nations Capitol, first residence! The chef for the White House, who just retired or quit, said, that by about, June, 260 of produce had come out of the garden, and was used in dinners for leaders of foreign countries, heads of state, and other dignitaries . . . if you haven't tried a homegrown tomato, you don't know what a fresh tomato or real tomato tastes like!

Grow a garden, make your kids and neighbor kids get involved, it is a magical experience! I could never quite get it all together . . . the first year, I planted, but wasn't great at weeding. The second year, I was good at planting, weeding, watering . . . I had irrigation rights, right in downtown Provo, Utah, so cool, kids loved when our turn came during the day, rather than in the middle of the night, so they could get their summer floaters, and run, dive on them and cruise across the water on the lawn! But, our garden in Provo, on 5th East and just below center, verify, verify, verify, near Maeser Elementary School, grew 64 pumpkins, enough for the whole block of kids and adults to each pick their own for Halloween, and we had plenty of food, fresh produce for our summer dinners and corn off the stalk for our BBQ's and tons of food that I was not great at harvesting, so I let a single mother with two son's come pick whatever she wanted, with tons left . . . it is fun to share your garden with neighbors! My oldest son, had two great gardeners behind his apartment, and he and his wife, loved all the food, they were given, and helped, young budgets, stretch, like most of us have to do, now and then. That same son and his wife, had large pots, they grew tomatoes and herbs in. My youngest son and his girlfriend, grew a live, lemon tree in their front room, with tons of gorgeous lemons . . . bright yellow, on green foliage . . . very pretty addition to their cool house, they rented!

4-H Science Program Enlightens Students . . . GF Trib, 3A, Wednesday, May 20, 2015

Speaking of gardens, agriculture, there are 25,700 new jobs for management and business in agriculture and 14, 600 new jobs in agriculture and science engineering each year, according to a U.S. Department of Agriculture analysis of job figures. The gap between expected job openings and agriculture and related fields graduates is about 1,000 each year. Looking for a profession or job, there you have it. As I was coming over to Shelby, by shuttle, the driver, who has seen me on numerous occasions, pointed out the Hutterite Community, just outside of Shelby, just as I was looking over the vast farmlands in this area, and wondering what they were planting, wheat, barely . . . breweries! and other grains, that grow over here in Big Sky Country . . . looming on the horizon, mixed in with the wheat fields of amber!

Not only are there a lot of ranches, farms, but retiring David Letterman, has a cabin, and a ranch outside of Great Falls, so with his kind of money, you know this is a pretty area, he even granted an interview with a local reporter, Pat Douglas, called, Quizzing Letterman, B.B. King, chatting with the part-time local resident, who is having his final show on "Late Night With David Letterman" actually tonight, so watch! Thanks for making us laugh, keeping us entertained, and taking on politicians over the years, and others! LOL! But the reporter, oh, I guess I stand corrected, a Guest Opinion, found on the Two Cents section of the Trib., also interviewed, B.B. King, who just died this week, after a great part of his 84 years, brought jazz and blues to the world, great stuff, and his club was next to my apartment, while living in Chicago, Illinois, summer of 1992, for an internship with Americans United for Life.

Pat, got a quote from B.B. King, that I could not agree with more, and my philosophy on this blog, "All I can tell you is, I'm B.B. King and I do my show," he told me in 2005. "Would do it for nothing if somebody would pay my bills." The one great thing about being poisoned in 2000, is aside from getting my private insurance, that was somehow taken from me, when I didn't die in the alotted 2 years, is getting Social Security Disability, which I tried to quit, back in 2009, when I started practicing law again, but they would not let me, given the serious nature of Pick's Disease, a terminal brain disease, that eats, your frontal lobes, but I guess, that Susan Schidt, my younger sister, the history major, who wanted to go to law school, the one who has been playing she is an attorney and me, even fooled Governor Bullock and AG, Tim Fox, or they just didn't like the fact that I opposed the fucking water compact, they pushed that in my mind, fucked 300,000 Montana's in 11 counties, but hey, what does the real constitutional law attorney know, let's listen to the fake, MY MONEY DOES TALK! Hopefully, the courts will stop this compact, that I worked on for two years, doing constitutional analysis, and speaking at the 2013, April, hearings of the House Judiciary Committee, but, I am sure that Rachel, Sue, Shelley or the cop girls club, were standing in this year and fucked it up, but went the way of the Gov . . . NOT ME! DAMN BITCHES . . . get your own degrees, your own lives, your own kids! Fuck YOU! SISTERS? PARENTS?

"MOVE" Organization, From Bizarre Family to Alleged Terrorists! Hopefully, Cops Learn From Mistakes . . . Appears So!

Next to blogging, watching true crime shows, comes next . . . "Let The Fire Burn", a documentary, on the tragedy in Philly, back in 1985, appeared on my YouTube recommendations, well, connected to the option I took, and after the first few shows, this documentary came up, an historical account of the call, Mayor Frank Rizzo, cops, firefighters, and other city officials made, that led to rethinking, their approach to apparent, agitators of city peace, after the call was to drop a bomb on a fortress, the Move Organization, had made, after having run in after run in with cops, being hauled into court, charged with harassment type charges, ended in this group, becoming more and more militarized, angry, and eventually, a cop gets killed, and war breaks out, ending with an entire city block of homes burned to the ground, after there was no one who called for the fire from the bomb to be put out. Eleven Move members, were burned alive, babies and a male member, were, it appeared to be murdered or killed, just outside the back door of the compound, with police brutality. I believe, that there were only three members that lived, two women, and 1 young male child. One of the members, was a former, Black Panther, which may have added to the fear of the Move Organization . . . in the documentary, as the interviewer, talks to the young man, a bit older, and in the custody of his father, who was in the Navy, was juxtaposed to the testimonies of the police officers involved.

None of the cops and city officials were ever charged with crimes, the city, the mayor, and law enforcement were found to be negligent, a dark spot in the history of the city, and hopefully, will never be repeated again. A lifestyle that is different from the norm, is not reason, to harass, intimidate, threaten, and follow, seeing the members as suspect, reading more, between the lines, and forcing, strange behavior, in a means of defense, to a war with the city, and growing into making the organization, actually train, in military defense . . . it was rumored that the Move members, had rifles, firearms, and they stood watch over their compound, but it was later found that none of the guns were in fact, operable, adding to the tragedy, with questions of getting the right information, before the call to bomb the compound. There were allegations of family abuse, which was also found to be false Intel, and on and on. Often, when we don't understand a group, their practices, principles, and lifestyle, we want to judge them, simply because they don't conform to the standards that society has set, and expects . . . as in the Preamble of the United States Constitution, we are seeking to make a more perfect union, making a more tranquil society, looking for the general welfare, common defense, justice for all, and peaceful prosperity for people and their posterity . . . that is the GOAL, seeking a Utopia, or the perfect society . . . we can do this!

If We Fail to Learn From History . . . We Will Forever Remain As a Child!

The Gang Riot in Waco, Texas . . . The Former Scene of Another Showdown with the Branch Davidians, A Similarly Strange Family Unit that Ended in Tragedy Too, But This Time, From All Appearances, Law Enforcement Got It RIGHT . . . Right Place, Right Time, Right Forces!

I just happened out of the swimming pool, at just the right time, to be able to catch the interview with, Stg. Patrick Swanton, apparently, the officer, in charge of doing the press conference, and rundown of what happened, yesterday, Sunday, between 5 rival gangs, and the cops. I was impressed with the immediate, transparency of the presentation of the facts, the players involved, the police agencies that showed up to help with a situation, that an intelligence agent, had alerted law enforcement of, that bikers, fighting over turf, drug territories, recruits, and other issues, were heading to Waco, Texas, and they needed to be ready for whatever might happen. Tristan Jared Lameroauex, one of my clients, who saw, blue prints for nuclear missile ranges of cities, that Japanese Mafia and Neo-Nazi's, were hiding, as he, contact them in Mesquite, Nevada, just to buy drugs and got into much more than that . . . he told me, that the Hell's Angel's, were the American Mafia . . . very violent, dangerous, and powerful! My client, had a Vagos biker tattoo, on his arm, and had ridden with the biker gang, known as one of the Top Ten Most Dangerous Gangs.

So, this was not child's play, and with 5 rival gangs, ending up in the same town, which, as Stg. Swanton said, could be any town in America, so, they hoped that they, Waco, could be a model of how to handle this problem, if other cities, end up with bikers converging on their town, bringing with them, the violence, the fighting, the turf wars, the participation in drug trafficking, and other types of criminal activities . . . it is always nice to have cops do what cops do best, control a very dangerous situation, that could have been way worse than it was . . . Thank God! The law enforcement spokesperson, did, make it perfectly clear, that they shot at armed bikers! When suspects, are using lethal force . . . there is no other choice, that for officers to use, lethal force against them! With 170 to 200 bikers, in one small, location, with me wondering, how in the hell, they all fit in the Twin Peaks Restaurant, is a mystery to me.

As I understand it, because I was not in a position to take notes, on Swanton's, very informative, but cautious in what he did report and what he couldn't, informing the press and the public with all he could at that time, knowing that cops would be gathering evidence, information to get enough evidence to hold those responsible, who caused the original fight, that led to the deaths of 9 people, the fight, started between two bikers, of rival gangs, in the bathroom, that quickly spread to the main rooms in the restaurant, with cops, taking just seconds to get to the cite of the violence, riot, and gun fire. I can't recall of the cops went in, or if they waited, or were surrounding the restaurant, and as the fight, started to come outside, the bikers started shooting at cops, as well as continuing their fight with the other bikers. This type of crime, violence, gun slinging, should never be on the streets of any city in America . . . so Kudos to the cops, their supporting agencies from other towns, surrounding Waco, and who ever, put the lid on this type of activity, making the citizens, innocent, at risk! Thanks for serving and protecting, in an admirable manner! We appreciate it . . . and a model for the nation! Good job!

Constitutionally, Insurrections & Rebellions, National Guard Jurisdiction

I would not say, that this incident, rose to the level of an insurrection or rebellion. Generally, with this type of spontaneous combustion, that is very likely, with 5 rival gangs, coming to town at the same time, going to the same place to eat, it is almost a guarantee that there will be problems. Under the best of circumstances, bikers, and shockingly so, know for violence, and often, deal with issues, in more of an undercover, or covert manner, dealing with their problems, in almost an underbelly of society way, mafia style, yet rarely comes to the attention of the authorities. So, this was different, that, what my client, Tristan, who was contacted, after telling the military, what he had seen in Mesquite, Nevada, with anti-American gangs, vying for two Americas . . . dividing America into two sections, half, all about America, with the Hell's Angels on one side . . . and Ayrian Nation, white supremacists, Neo-Nazi's, into racial purity, on the other side, by the FBI and Military, or the National Guard, the constitutional group with training under the United States military, and under the command of the President, commander-in-chief, and when not in use, under the direction of the Governors of each state!

My Intel man, on this issue, Tristan, was that there was going to be a war, between the Hell's Angels, who are all about America, defending the current politics and country, warring against the white supremacists groups, who want two separate Americas. From all I could tell, this was an FBI, Tristan had an FBI number, and was often contacted by them, and the National Guard, called to handle situations that are larger than the situation in Waco, TX, with the bikers gangs . . . same groups, but much smaller scale, and over turf, but not over the whole country and divisions. Where Tristan got tangled in the mess, was that his wife, Misty, who had been born into a biker gang, the Hell's Angels, whom he married, because of the FBI and Military asking him to serve his country, in a different way, that officially joining the military, which he was willing to do. But, Misty, slept with one of the military guys, who was a high ranking member, engaged in putting down the insurrection and rebellion, with people not knowing, what she knew, of sensitive and confidential information, and what she had told Tristan. Here is where the situation, gets bad, due to the lack of sexual control of the military member, three members of the Iron County Sheriff's Department, were also, members of the National Guard . . . I believe, they were called into stage a suicide, and they murdered her, in a botched attempt to stage the scene. Tristan, was charged with her murder, as a cover for the cops/National Guard members. That is how I got involved.

President Obama's Announcement To Limit The Number of Militarized Vehicles the Local Cop Shops Can Have . . . National Guard Already Has Tanks & Other Vehicles, That Might be Needed!

What is no body's job or responsibility, is every one's job . . . that is not how this country is run! President Obama, yesterday, announced that he, through an executive order, is putting limits on local cops, for the number of militarized vehicles they can have, and should have. SWAT vehicles, and a few others are for the safety of situations that do not rise to the level of an insurrection and rebellion, and those limited vehicles can handle the normal criminal activities in a city; however, when something, like the Waco, situation, escalates, more to a rebellion or insurrection, that could have happened, in a stand off, or a shoot out, that involved the 200 bikers, who may have sided with each other, against the cops, then, that is a time to call in the National Guard, who are equipped and trained, to fight wars, domesti c and foreign, which this was a possibility of becoming, but didn't rise to that level, so well handled by local cops!

Every time I go to and from Missoula, Montana, I pass the National Guard, going up highway 93, and there are tons of tanks, trucks, and other militarized vehicles, that are only miles outside of town, and easily accessed, and deployed within a city, to take care of a situation that escalates, beyond the cops control, or man-power. There is no reason to have two government agencies, having the same equipment, to handle the same situation, when the National Guard, is trained in war-type activities, that could have so easily happened, and best suited to deal with wars, on our soil, in our states. The governors have the power to call these men and women out to deal with larger problems within the state limits and boundaries. Just like there are jurisdicitonal issues between cop agencies, this is just another jurisdictional, or power to act, issues . . . where one is trained for war, and the other is not, and should not have war or miliarized vehicles, made for those trained to do that type of work!

Laughlin, Nevada . . . Do You Want to Die April 18, 2012

I was going to tell you about, Laughlin, Nevada, back in 2002, if I remember. Back in 2011, Allan Rex Bess, was murdered . . . this date was just on an FBI File episode, and reminded me that I wanted to give, whomever, some piece of evidence, that there is a difference between, Allan, who rode with the Vagos, and Frank, who was either, at Laughlin, based on the way he acted, when I hooked up and befriended, several biker bitches, who were at Laughlin, when the shootings and riot broke out between two biker gangs, Hell's Angels and Mongols, with three people ending up dead. Frank, not Allan, he was already dead, murdered by Shelley and Frank, burned in the new furnace in the basement of the Parowan house, belonging to the Bess's for the last 58 years, and then his ashes, mixed with cement, and cemented around the wood and coal window, that went from the driveway, at 291 North 100 East, Parowan, in the previously, spotless basement, when Allan owned the house, and the trashed, searched, and messy house, after Frank showed up and took all stock certificates, bank account information, property titles and anything he could get his gold digging hands on, that Shelley scoped out, when she stopped by and had sex with Allan, who was horney as hell, and would have jumped anyone, after a year in jail! Shelley, had sex, and employed, Frank's favorite assassination technique, by waiting until the Marine, I Corp. member, cowboy and biker, was asleep, after sex, and then using a 22, Shelley, shot the real Allan Rex Bess, behind the ear . . . cops can still get DNA evidence, as I asked them to do, from the blood pool, that is right where Allan's head would have been laying, with someone else in bed with him. Far be it from me, to tell the cops how to do their jobs, since I had done it 15 years earlier for pay!

You see, the way, this double thing works, is they find either an actor or actress, who is either close to the victim and target, or claims to be, like Allan, who rode with the Vagos, and Frank, who claimed to be an inflitrator for the government of the biker gang, Hell's Angels . . . or was he a bikers, who got caught by the feds, through an infiltrator, and was used to get information about the gangs he had ridden with? Anyway, the stories, involving bikers, were not even close, nor were their stories of service in the Viet Nam War . . . Allan was I Corp. Marine, who wanted to go into battle, but was stuck at a desk, and tried to stop the war, seeing the huge ass number of casualties, that were kept secret to the American public, but know to Intel, compared to Frank's stories of being a platoon leaders, who took 82 boys into battle, and only came back with 53 . . . with him telling me, that those who listened, implying, that I should listen to him, lived, and those who didn't listen, died, maybe implying that I would die if I didn't foilow him . . . I didn't owe him anything . . . Allan Rex Bess is dead, and his Social Security check is being collected by Frank, as well as his VA benefits, and there is no, death certificate for Allan . . . because that would stop all benefits! Allan was connected to the Vagos, and Frank, never mentioned them, only the Hell's Angels, was he at Laughlin, NV? He hid his face from the biker chicks, I met and talked to at Duck Creek, Utah, at a concert, held during the day . . . Frank disappeared and mentioned that he didn't want them to notice him, as a government infiltrator!

Allegedly, from the biker bitches, who were friends with some of the Hell's Angels, they only mentioned one, and wanted me to represent him in his criminal trial . . . Frank didn't want me to. Why? They told me, something different that wiki reports, and they were there, as I understand it, from their recounting of the case. Apparently, the Mongols were having a wedding, down in Laughlin, or it was the Hell's Angels, and while the wedding was going on, the rival and dangerous biker rivals, showed up and started to cause trouble, and someone shot one of the Mongols, and a riot broke out, and some chick, called the cops, and everyone was pissed at the girl, and some gang members tore into her for calling the cops . . . one of the 6 bikers, on one of the sides, was the one most pissed, and I think, because he got into with the girl for calling, somehow, he was blamed for starting the riot, and being one of the shooters, or responsible. Again, 6 members of each biker gang were arrested. Shelley, off and on, spent time with bikers . . . once being the chair person, setting up the Children's Justice Center, connected with the Utah Attorney Generals Office, and BACA, Bikers Against Child Abuse, got involved and contributed, when they were going through Logan . . . did Shelley meet, Frank, in one of the biker trips through Logan? She allegedly sold school libraries, books, during the years between 2005 and 2008 . . .

I believe the cops, didn't figure out what happened in Laughlin, until about 2008 . . . was she making trips, two weeks at a time, meeting Frank in Nevada? At the same time, my son, Elliot's band, God's Revolver, is rockin' the U.S.A., and mafia, got involved in the music industry . . . Shelley's youngests son, Tyron Southwick, in Logan, I think, was the son, of Jimmy Robinson or Robison, who was a music mixer for the Doors. He owed Shelley a ton of child support, when they found him, living in a gated community, in New York . . . did the Office of Recovery Services, let him off the hook, or the assistant attorney generals over child support collections, give Jimmy a deal, to do the mixing on the pirated music . . . with Shelley, Jessie, and Tiffany Anderson, making tons of copies of a CD, only with the word, Bandit on it!
