I rarely watch Fox News; however, while in Rome, do as the Romans . . . this is the preferred news source in Northern Montana's, conservative, Kalispell.  I remember when I first came to the town, running out of gas, parking my car in the Walmart parking lot, where people were allowed to sleep overnight, and trying to entertain myself, listening to the news, which I am addicted to.  The only radio programs I could get, where Fox Channel related: Rush, Hannity, Michael Savage, Laura, and the crew of conservative talk show hosts. Oh, well, that is better than nothing . . . sometimes.  And I wonder who, Frank, the editor and chief of the Daily Inter Lake, newspaper, could possibly get the facts so back-ass-ward, in the Michael Brown slaying!  When I thought about it, I REALIZED, that he too, is probably only getting his news from the alleged fair and balanced position of Fox News!

So, this morning with no other news ever on the silent TVs at the Kalispell, McDonalds, where I like to get a cold Diet Coke, breakfast was at Subway in Big Fork, eating it a Wayfarer's Park, on the Flathead Lake, shore . . . CIA, check to verify, my only existing form of authentication that you can trace to authentically connect me to other forms of stolen ID, since I used my Walmart Money card to pay for breakfast for John and I, before trying to go walk the Swan River Trail, but I am turning into a true Montanan, hating crowds, congestion, and traffic, but still more tolerant than local Montana boy, John, who gets pissed at someone tailgating him, as close as he is tailgating the driver in front of him . . . LOL!  But I did get a good laugh at John's comments, when Beatles, John Lennon's song, Imagine There's No Heaven, came on his car iPod, with 2600 songs, which he has turned control as DJ over to me, lately, so I changed it, telling him that song always depressed me . . . he immediately, joined in dissing that song, imagine there's no heaven, what the hell is up with that?

John is a reformed Catholic, and I am a reformed, Mormon, and we have much more in common, that I have with an active Mormon, or that John has with another Catholic, who is practicing; however, with both hold deep convictions in God, and totally dig what Christ did for us, so a world without the thought of heaven is totally bogus to both of us, since the only reason we both are good, most of the time, is we believe in heaven, judgement, atonement, heaven and the possibility of hell.  Some people say, I don't know where I would be without . . . blah, blah, blah, and I would ask, look where you are with it?  Heaven is a good thing, and I can't imagine a world without it!  I actually think that you should error on the side of safety, and hedge your bets, that if there isn't one and you lived better than you would have otherwise, you can't go wrong, but, if you blow it off, do what the hell you want, eat, drink and be merry, for tomorrow you shall die . . . you might be shocked, that death, as I have heard, is just like walking from one room in your house to another.  

You might just not like the other room, in the house, you go to, if you did whatever in the hell you wanted to, treated people like shit, and didn't take advantage of Christ's free gift, of paying for your sins; I dig that! Then, as I do often, actually cut loose and do whatever I feel like doing, as I just did, at the Blue Martini Dance Club, with the Palestinian, transplant to Vegas, Poker King . . . I didn't play, if that is what you are thinking, but did have a bit of fun, with a fun guy, I blew off the next day!  I need Christ to cover the way I treat men, more than what I do with them.  LOL!  

To me, men are like trolley cars, there is one coming around the corner, every 10 minutes . . . John, who loves his ex-girlfriend, is making me look at men beyond sex objects, pay for dinner checks, and sex in exchange for a new, red, Dodge Dart, getting 41 mpg, that I want, but wouldn't play with the  Poker King of Vegas, whom wins up to $52,000 per game!  My cousin, assured me, that this guy who called, stalked me, and showed up at the dance club looking for me, while I was pretending not to she him, pretending that Edward was my date, hoping he wouldn't recognize him, and who had been calling Edward's phone for days, after our chance meeting, would be glad to be used by me!  I am just not that kind of girl.  Wink!

In Montana, it really is only about the Hokey Pokey, but in Las Vegas, you have Poker Kings!  A little to risky for me, big time players, big time money . . . I decided a town that rolls up at 6 p.m., and rises at 5 a.m. really is more my style, me and the ranchers and farmers . . . All Women Sport Show . . . Fox Sports, Worked for the News

Anyway, what seemed to work so well for ratings on Fox, filling the news hours with alleged foxes, mainly, blue eyed, long blonde hair, Barbies, worked--men and women, alike, were so mesmerized by their alleged good looks, that their news, reporting the facts correctly, their view points, analysis, and logic, just simply didn't matter, or was missed by the general populace, who took these baby dolls, at their word, even if it meant misleading the public at large . . . like I heard from Sarah Palin fans, hell if she is stupid, at least we can look at her!  One heartbeat away from the President?  Are you fucking kidding me?  Like either Hamilton or Jefferson said, the masses are asses, and men, in particularly, put lipstick and a short skirt on it, and sell it . . . sex sells!

Okay, with that off my voluptuous breast, or rather chest, just kidding, now, Fox, under Rupert Murdoch, the owner, is going to try that same tactic in the world of sports casting . . . selling it with advertisements, that resemble the old pin-up looking girls, of the 50's, you know, back where women, were women, with those shorty, short, hot pants, long legs, with high heels on their feet, when, even educated, women, knew their place, and that was under a man, reliant on a man, dependent on sleeping with the producer to get the lead role in the movies, and now, of course, in this sports crazed world, of amped up steroids, salaries, egos, contracts, and cheerleaders, we are going to introduce a female phenomena of an all female sports show!  Yahoo!  Can I stick two fingers in my mouth, rather than the usual one?

Militarization of the Cops, Makes them More Chicken Shit!

My hell, they are the armed ones, the ones with the guns, the tasers, the handcuffs, the tear gas, the tanks, the semi-automatic riffles, the M-Raps, the BearCats . . . and they all acted as paranoid, as if they were actually the terrified for their lives, and lined up three rows thick, pointing guns, over-reacting, while protecting one of their own, with basically, over all, peaceful protesters!  So, what is up with that?  And, in top of that, they did nothing to protect the store owners from looters . . . that is their fucking job!  There was this huge show of force, all show and no action to back up this standing army of cops!

I guess they were afraid of the looters, and focused their attention on the protesters, showing, those citizens, who was boss of their 1st amendment rights!  Whooooh, tough guys!  Really . . . as the anger subsided, and the nights protests got shorter and more calm, some of the cops, even went into a church, staying open late to serve protesters, giving them as safe place to rest, recoup, and take a break, and the cops, went in a raided the food, and one report said, they robbed the church! So, what they justified their comrade in arms, doing to an unarmed 18 year old, if he even knew about the alleged robbery, they were doing themselves . . . too bad the pastor, wasn't armed, and shot their asses, killed them for doing, exactly what they justified and defended their fellow officer doing to Michael Brown!  Good, God, almighty!

Afraid of Their Own Shadows!

So, while the world is watching Ferguson, and Officer Ron Johnson, is doing what cops used to do, working with community leaders to calm down and angry crowd, and rightly so, being angry that is, with at least 6 unjustified murders of black male teens, within less than a year of Trayvon Martin's murder, parents, grandparents, friends, neighbors, and school chums, have a fucking right to fear, not only for their black teenage kids, but for themselves, knowing full well, the cops are their, circling the wagons, so to say, with an army, defending, a cop, who, might, very well be looking at criminal charges, in an indictment by a grand jury!  And for so long, they have gotten away with it!

There is a blue brotherhood, that was alive, well and kicking, and has been for centuries, or at least as long as cops have been around, protecting, defending, covering, and lying to protect their own, or even one who wants to be one of their own, as in the case of Zimmerman . . . cop witnesses, turned on prosecutors, who are normally, part of the unofficial blue brotherhood, along with the judge!  As an attorney, who has been both on the prosecutorial side of things, and the defense side of the courtroom, all the power, rests with the other side, or the state's side . . . and under the Patriot Act, or the UnPatriot Act, better name, their is a concerted effort, to even take away all constitutional protections, civil rights, and even, in my case, instruct the jury, that they can't consider defense counsel's arguments . . . I was winning and the jury kept asking the judge, for clarification on civil and constitutional rights!

And, that is after the prosecutors and cops, had witness tampered, threatened potential witnesses, and even went to the jails, intimidating my client's cellmates, and friend, that they would have warrants, they never had before, and my client, saw the county attorney, who had to recuse himself from the case, actually going into the jury, and staying their for 45 minutes, and I was in the rooms outside the judge's chambers, which is near the jury deliberation room, with my client in a holding cell, just across the hall, as a deputy sheriff, or the bailiff, two times, both when the CA entered the jury room, and when he left the jury room 45 minutes later, and saw, what I was puzzled by, the prosecutors going in and out of the back of the court, in halls that they should not have been in, allegedly to enjoy 4th of July treats . . . a bit of a conflict even on the treats!

This happened, late afternoon, on July 2nd, but the Friday, before the 4th of July, with the county attorney, suppose to be, long gone, up at his family cabin, with his wife and children, not hanging around the court, waiting for the jury, especially, not fucking talking to the jury in secret!  I subpoenaed the surveillance camera tapes, and they had been doctored as well, so . . . come on, this side has total access to fuck with any witness, jury, case, defendant, and apparently had the approval of the judge, who has the job to kick their sorry asses, out of questionable areas during jury deliberation.  So with me witnessing the prosecutors going back with the judge and jury, like going in a revolving door, and my client seeing the CA, even with the cop blocking his view, between me and my client, the CA was back there as just the time, the jury was deliberating!  

And the nation and world, wonders with the county attorney, McCulloch might want to recuse himself? Come on, his father was shot by a black, half of his family works with the cops, he wanted to be a cop, and he failed to prosecute a DEA agent and other cops, who gunned down two people, blacks, sitting in the Jack in the Box parking lot, and one had nothing to do with the case . . . unloaded 21 shots in the vehicle!  The Patriot Act has allowed the cops, of any level, rank, training, lack thereof, do whatever in the hell they want, and we are seeing the ramifications of that . . . is has weakened cops, made them cowards, and their job, is to protect themselves, on our pay rolls, and leave us without protection, especially when they are involved, and they will throw the book at us, while turning a blind eye, to murder, in their ranks and file!

While I was an assistant attorney general, and the cops saw me as the go to person . . . they asked me to come to a remote part of the state, and give an ethics presentation to a group of cops, mainly sheriffs and highway patrol, or the guys who wear brown, there were no, blue city cops, as I recall.  But, they had been asking for an attorney general to come down and talk about ethics for two years.  I am all about action; however, I never expected to hear what one older cops whispered in my ear at the beginning of a break.  He said, Give it to them harder, there are guys in here, that have literally gotten away with murder!

This is the story, that some girl, was allegedly drunk, and an officer hauled her ass into jail.  Several of the late night officers on duty, either on the streets, or in the jail, raped and killed her.  And when her parents came looking for her, they told them that the girl was drinking, and they just threw her in the drunk tank, to sober her up.  And when she seemed okay to drive, they released her, and they had not seen her since 10:30 p.m.  No one ever found her body . . . they have the power, the badge, the access, the ability to commit all kinds of crimes!  So who watches the watchers?

On another occasion, a deputy sheriff from a small county, called me and had taken his job serious, arresting guys who beat and battered their wives.  He and another, young fellow officer, both getting different calls, went to the homes of other deputies, to find they had committed domestic violence against their spouses, to the point, they felt they needed to arrest them to follow the law . . . extremely hard to do, as a cop, arrest another cop.  But, they did their job, followed the law, as the legislature in the state saw it, and I had taught it to them.  Several hours later, the elected county sheriff of about 20 some odd years, called the jail, and the officers and told them if they didn't release his deputies, they would both be fired!  

They asked me what they should do . . . I said, I will mention it to the attorney general, who is the number one cop in the state, and see if he can bring some wrath down on them, but they needed to take that sheriff out of office . . . well, there were only 925 people in the county, and he was related to almost all of them, those old pioneer, polygamist, that populated and settled big chunks of land in Utah!  So, there was no remedy for this crooked sheriff, other than to get the attorney general, who is just as unlikely to do anything, especially in Utah--the last two AGs are looking at indictments themselves, and possible prison time for corruption, and I would venture a guess, that it is for more than taking gifts, money, and offering bribes, or I can fill in Sim Gill and Troy, or Mary!

The law is the fucking law, is the law . . . period, applies to all, to cops, citizens, of all colors!

Leave No Witnesses . . .

While all the drama was doing on in Ferguson, the other 23 year old was shot!  I thought, how in the hell, do these cops, dare shoot, another black male, with the whole world watching the sadness of the last one. Well, city alderman, French, jumped in and allegedly was a witness or close by, when the incident happened, and calmed the angry crowd, gathering in shock and dismay, in his part of the city, with another body laying, slain in the streets, but with the mayor, the chief of police, and the alderman, acting like what had happened just down the road, causing such a stir, was certainly not going to happen in this town!  We are all over it, and these blacks in our community of St. Louis, have a voice, representation, and they, the citizens will not go days without a comment by the police chief, like the 9 day wait in Ferguson . . . nor will we need tanks, we have a handle of the situation.  

REALLY . . . and you bought the bull shit lie, that two armed officers, were afraid for their lives, when a single alleged shoplifter, brandished a knife, and refused to put it down, therefore, the officers were afraid for their lives, and did just what the guy, who really just didn't want to kill himself, wanted them to do, kill him, for him?  These officers were allegedly in fear of eminent threat of their lives being taken, by a guy with a knife?  Just the numbers don't add up, let alone the weapons of choice . . . one knife welding crazed, suicidal maniac, and two, armed officers?  Could they have divided and conquered, tased him from behind, called for back up?  What the hell, there were multiple options, before ever, if ever, consider shooting him!  And how do we know that he was begging to be shot?  Why would he have a knife?  We will never know, because, as is usual, there are no witnesses to offer testimony to the contrary!  The officers can say, whatever in the fuck they want, there is no one to dispute the facts!

Call me suspicious, but the incident sounds staged!  Like, see, this guy was shoplifting and he got just what the officers thought he deserved, death!  Implying, by symbolic similarity, that Michael Brown, a shoplifter at a similar story, so factually similar, really, just wanted to be shot, suicide by cop, he had his hands up, and willingly went along with Officer Friendly omniscient observations, and he complied with Michael's death wish!  Well, we will never know . . . and the cops are doing great job, not talking to the eye witnesses to the shooting, discrediting him, well, the friend who was with Brown, was also a shoplifter; therefore, his story cannot be believed!  Nor, can the two girls, both who witnessed the shooting and the facts, first had, one from her car, and one from the streets, just behind the officer's squad car!  Well, they are black, so what do you think they are going to say, yet that same logic doesn't hold true for the cops . . . they are considered above reproach, and they would never, never, never lie for a fellow officer?

Dash Cams & Uniform Cams

Some company or university, justice organization, just did a study of the effect of dash cams and body cams, or cameras, on both complaints against cops, and alleged altercations between citizens and cops.  It was found that the complains in one city went down, 80%.  However, they found that was an anomaly and was far higher, due to the cop shop, city, or something like that . . . but, consistently, it was found that the complaints dropped between 40 to 60%, when officers used one or the other device or both.  Apparently, Ferguson, had cameras already purchased, but said they didn't have the funds to install them . . . oh, but I guess they did have millions of dollars for the riot gear, the M-Raps vehicles, uniforms, head gear, rifles, and such?  Really, we are suppose to believe this . . . the city purchased the equipment, that citizens can use to prove police brutality or the lack thereof, but didn't install them?  Yet, they had plenty of money to buy a BearCat for $400,000?  And all jacked up like the ones we saw on the news, at least a half a million dollars. Come on!

Nevada, Senator Reid, Fine With $2.2 Million Worth of Alleged Surplus Military Tanks, Equipment, Guns, Uniforms?

He did, however, state that there should be training and guidelines for the use of this type of equipment . . . do ya think?  Senator, Rand Paul, made much more sense, when he said, there should be a difference between a military presence and a law enforcement presence!  Hell, yes.  Some criticized President Obama, for not speaking out more against the situation in Ferguson, and that is because, he, in his election or first speech, told the nation, he wanted a standing army, just as well funded, domestically, as we had abroad or to fight wars abroad!  I think I would remain silent on the issue too.  We do not fucking want to be China, Russia, Germany under Hitler, Korea, or any of the totalitarian countries, we just don't need it, nor do with want it . . . are we jealous of the easy rule?

And Senator Reid and his son, were also the ones, who said, during the Bundy situation, rancher v. BLM, that this was not over . . . meaning the stand-off between the feds and the militia!  He probably realized that he and his feds, were out-manned, backed down, and pushed around.  And that is precisely, why you need a trained militia in each state!  The second amendment, to the United States Constitution, clearly states, that to have a free state, free of the bull shit, other countries citizens have to deal with, boots marching up and down their streets in a show of force, unlike we have ever seen, nor ever want to see, on our streets!  No thanks!  The nation was shocked to see the military style treatment of the citizens, the protesters, the death of a teen, over a fucking cigar and the failure to jump to the demands of the cop with short guy syndrome!

Senator Reid and the feds didn't give a rat's ass about the desert turtles, when they wanted the land for the Chinese solar companies . . . they just used the Endangered Species Act, protecting the tortise, to further their own agenda, to allow the Chinese, who we don't want on our soil, doing anything, even if we do owe them our debt, we will figure out how to pay them back, and we have so far!  We don't need to shut down the government, commit treason, by waging war on our citizens, just like what happened in Ferguson, or give aid and comfort to our enemies, as the not-so-good, Senator is trying to do!  I think we need to seriously consider bring back charges of treason, to people who are doing exactly what the plain language of the U.S. Constitution is calling a high crime and misdemeanor, or treason!  Eric Holder, anyone?

Thank God, for Representative, Claire McKaskill . . . a Former Prosecutor!

She is looking into the situation in Ferguson, looking at the militarization of the cops, and actually going to do something about it, rather than vote with the good ol' boys club!  I know there are many more of the Congress, concerned about the facist actions, that were taken, with a clear move toward officially setting up a militarized police, and desensatizing the citizens, to accepting a police state, as needed!  There have been operations, in many of the nation's bigger cities, even with crime statistics showing a decrease over the last 10 or so years, even in New York City, so, what in the hell is up with increasing the police presence, or even making it a military presence?

In the United States Constitution, we have a standing army in each state, already, and that is the National Guard, who are trained under the U.S. Military system, and are at the desposal of the President, when he needs them, and otherwise, under the direction and use of the Governor of each state!  That is the official and constitutional militia, referred to in the Constitution.  In state constitutions, in light of the 2nd amendment, which is where the people get their rights to bear arms, and should be organizing a militia, to remain a free state, as the plain language suggests, with the founding fathers, understanding far too well, what tyrants Kings and others can be, the federal government in this case, and know that there needs to be a balance of power between the federal government and the states, as witnessed in the Bundy Ranch standoff . . . I am not saying that Bundy doesn't need to pay his leasing fees, like ever other rancher who leases land for grazing, but I am saying, there are ways to handle situations of rebellion, better than sending in 200 jack booted thugs, storming a house, or ranch, like SWAT exercise, and killing cattle and stepping on the heads, tasing sons and relatives of the Bundy's . . . We are better than this America, Nevada, Missouri!

Michael Brown's Legacy--Stop the Militarization of Cops, Police State!

If one must endure a breach of justice, so egregious as the death of a child, just getting ready to start college, with his whole life ahead of him, let it not be in vain!  Some 18 year old's have their blood shed on the battlefields of Afghanistan, Iraq, maybe Syria, and else where in the world, but none the less courageous, taking on a cop on the streets of Ferguson, standing up for what was right, respect, rights, protection, freedom, liberty, as he crosses a street, free of harassment and ego, power trips . . . we don't know what was said between the two engaged in this deadly conflict, over nothing, but we do know what happened afterward, the horrific show of force, the attitudes, of cops, the display of the likes we have never seen before in America, by cops . . . race riots, Kent State . . . terrible, at best, have we not progressed?

Most elected officials, cops, military, judges, attorneys, President, and others take an oath to defend, protect and preserve, the very rights, Michael may have been demanding . . . protection of these rights comes against both foreign and domestic enemies!  If what we saw for days on end, guns pointed as citizens, participating in peaceful assembly for the most part, expressing their first amendment rights, both to speak freely, and to redress grievances with their government, not to mention, to peacefully assemble . . . then Michael, through his blood, brought this ugly militarized police force, right in front of the cameras, for the world to see, what the leader of the free nation, was starting to look like, on the streets, betraying everything this country stands for, freedom, liberty, justice, equality, etc., then, Michael, and his parents, can stand proud, as could many other soldiers protecting, preserving and defending the rights, every citizens, not only deserves, expects, and should get, in these here United States, the envy of the world!

Stand Tall, Michael . . . There May Have Been No Other Way, This Horror Show, Could Ever, More Effectively Come to Light, and Get the Attention of Our Law Makers!

In a Room of 200 Attorneys at a Bar Conference--Only Two Had Ever Been to Court or Trial!

I think the best advice I ever got from an attorney boyfriend, who could not get a firm to hire him, or a job, was that he just finally hung out his shingle, and decided to go it alone as a solo practitioner.  He said he drove the judges, other attorneys, bailiffs and the court recorder crazy with his lack of experience, and the need for them to actually give him and hand with procedure, writing and trial practice . . . and he was the better for it.  And, yes, he looked like a fool in court, but hey, you have to learn somewhere, so might as well jump in and either sink or swim.  That resembles the way my father taught my brother to swim, he took him by the leg and arm, and hurled him into the deep end of our swimming pool, where we lived at the time, in Northridge, California.  And, by the way, he did swim, learned rather fast, shocked and gasping for air, but loving the water and taking to it like a fish!

One day, I was standing out in the hall, at Brock & Associates, in St. George, Utah, discussing some trial tactics with a client, when a tax attorney, who over heard my conversation outside his office, leaned out and said, are you a trial attorney, and do you actually go into court, and that would scare me to death!  I was equally amazed, thinking that all attorneys like trial work, dream of joining a big firm and finally making partner, so they could fast track it into the courtroom scene . . . not so.  There seems to be divisions of lawyers, those who dig bull shitting their way through the court system, rarely doing much paperwork, leaving most of that to their legal assistant or secretary, paralegal or junior partner.  Then there are those paper pushers, who dig writing, briefs, transactional work, like contracts, real estate, securities, patent law and such.  There are attorneys who specialize in appeals work, like going to the Courts of Appeal, or the Supreme Courts, either state or federal.

So, if you are tentative and afraid of actually speaking up in court, you are not alone!  And, it has been found that one of people's top fears, is public speaking!  So, public speaking with a purpose, or a legal situation can even be more intimidating, with so much resting on the outcome of the case; however, pro se litigants have won seasoned attorneys, to the embarrassment of the attorney, who most likely under prepared, and thought is was an easy win, only to find out that regardless of the weaknesses, the court room errors, and the lack of knowledge, the jury, or the judge believed the person representing themselves.  And if I remember from reading the rules, judges are to be lenient with people representing themselves and to give them the benefit of the doubt on a close call.  So there are several things working in your favor.

Good Sam Laws Protect Doctors Who Assist Someone Outside the Normal Arena, Like Finding Someone Who Was Just In an Accident . . . there Should be Good Advocate Protections for Attorneys Who Help People

I try to help everyone I can with legal issues, I look at my license to practice law as a license to serve!  The second someone finds out I am an attorney, the next thing out of their mouths is, what kind of law do you practice, and can you help me in California, got that last night, while on a shuttle between Salt Lake City, Utah and Rexburg, Idaho.  I help people checking out groceries in a store, the waitress, the neighbor, friends and others, not in the normal retained manner, with a contract for hire, and usually free of charge!  In fact, over 75% of my practice, even at the height of practice was pro bono or free.  I had several regular paying clients, and large retainers, that came in often, and that allowed me to carry the rest of my clients free, and what a blessing to many.  I found that the people with the best cases, usually had been injured the worse, or had the most notable and warranted issues, that needed addressing.

I found it appalling, that often, people looked at the glass half empty, rather than the glass half full, getting literally hundreds of free legal hours, and without paying even a minimum amount, not even travel expenses, but expecting $250 per hour service for nothing, or the bar wanting to hold you to the same standards as if the client had professionally retained me, rather than me just helping as much as time, energy and effort would allow . . . they, the client, the bar, and other attorneys, thought that a pro bono client, unofficially retained, with me just volunteering to help, under duress, at times, but doing the best I could, coaching them, helping them here and there, and with many having great outcomes to their cases, even trials, taking the bull by the horns, once I got them over the hill, to smooth sailing, or when I saw that I might be doing more damage, rather than good, with professional jealousy, rivalry, or what not, or just getting too busy with paying clients, that I had to take care of to pay the electric bill . . . just one of those realities of life, that make you prioritize cases!

Dentists & Docs will Say that Welfare Patients are the Most Demanding . . . Now I Know the Legal Equivalent, This is not the Way to Win Legal Assistance, and Influence Attorneys!

And, at times, the freebies getting mad, not appreciating the free work, and expecting me to do a stellar job, worth normal billing prices, or getting pissed when I would tell them, my way or the highway, if they are wiling to pay me $250 per hour, they can call the shots, but if my name is on or connected with their case, and I am getting nothing but a win, and the satisfaction of helping win, with just a little coaching, then, things will be done my way, and I tell them before I start, that they will be abused by me, I promise that!  I never had time to pussy foot around!  One woman, actually had her daughter pick me up from Helena, bring me to Kalispell, ruin my summer plans to help her, and after me working, writing about a 27 page brief, she wants to quit, take a nap, a bath, and I refused to even let her take a break to go to the bathroom!  I was like a horse to water, racing to the finish line, and didn't want to stop, until we were done!

Rather than being grateful, thanking me for my time, work, and surprise court appearance in the Matter of the Estate of Dorothy Darrow, she, took the second brief, copied it, with her name and contact information, taking my notation that I was coaching her, adding my name, as a member of the U.S. Supreme Court Bar membership, a cut above the rest, taking credit for what I did, and then treating me as if a stranger, or as if someone else did the work, or that she actually did the work herself, acting cocky and different.  Fucking amazing!  Of course, like ABC, my double, follows me around, client by client, friend by friend, stealing my work, and either giving the person I helped the credit . . . I am a legal fiction, or someone other than myself, gets to play role me, and take the credit for superior work, better than most of your average attorneys, including the one, I humiliated with the law in this case!

There are six or seven things the Lord hates, and ingratitude is number one!  I have had clients that have had to hire, and seem to do so easily, another attorney, after my free services end, due to necessity, having to pay $250 for inferior service, loses, and even a increase in time served by their daughter, who was actually originally sentenced to 6 years, with likely 3 years time served, ending up with a new trial, and a sentence of 15 to life, so, who do you think they are mad at, you got it, the attorney who worked an entire year, carrying the case, even after they stopped paying me anything, hired a new attorney, against my wishes, on a civil rights case of first impression, not your average, case, where the client can hire and fire at will, but actually, in a hostile effort, stole a very hot, unique case, politicking and hoping to get a cut of the deal and the action for the new attorney, who they were paying $250, and I guess I am to blame for their daughter's new trial, and worse outcome?  I don't fucking think so!

Read, Read, Read

You can't expect to take your case, write briefs, or do paperwork, go into court, and not ever read anything about what you are doing.  At the time I was practicing 22 hours a day, in about 5 states, and a case load to rival a small firm, myself, my sister, Shelley, was working on mortgages or refinancing, and even helping and assisting people to take their cases pro se . . . sometimes crossing the line between help and practicing law without a license, which she was dinged for or looked at by the bar for doing, until the bar allowed her to practice law without a license and held me responsible for her work!  But, often, she would ask me questions about procedure, forms, briefs, rules, laws, ethics, etc., and in passing, I would, say, do what I have to do, get out the rules and read!  Do just what I have to do, to know, what the hell to do!  The law is no mystery, but it is a hell of a lot of work!

At the time I did the original complaint on the Brock, securities case, I was handling 521 pages of evidence, a 39 page brief, learning 281 federal rules of procedure, and learning the federal district courts e-filing system, and including writing the brief, had less than 24 hours to do it all, at the request of a client, who I had been trying to get to give the go ahead for two solid months, after learning that the state financial planner association was planning on stealing my bar complaint about the attorneys involved, and filing a class action suit, had me, after driving to Salt Lake City, meeting with Chuck, the president, driving, meeting with Hank, late on my birthday, December 17th, nonetheless, and having him tell me, he wanted me to sleep at his office, giving me a blanket and pillow, demanding it be filed by 3:30 p.m., on the 18th!  I made the deadline, but learning the e-filing system took until 5 p.m.!

Anyone dealing with legal issues, has to read, read and read more!  But remember, knowledge is power!

Warning Women, Attorneys & Pro Se . . . Don't Let Them Scare You Out of Court!

As the only female attorney, I ever saw, while practicing law in Southern Utah, other than the female prosecutor, who worked part-time, I found out, and had personally experienced years before trial work, that there seems to be a local practice by male judges and bar members, that the first time a woman has an appearance in court, she is likely to be taken in the back room and verbally beaten, abused, and battered by the judge, who will tell her that her performance in court was lacking, and that is putting it mildly!  Shelley had a mortgage case, and a female, whom I was sure, I thought I might have seen outside of court one day, talking to a client, come into court, with her mother, and I said, didn't I see you, working with a client?  And aren't you an attorney?  And why aren't you representing your mother?

She bowed her head, and said, yes, I was an attorney, but the judge told me how bad I did in court, and I decided to just teach college!  Sorry to say, that is the plight of the weak at heart . . . law is not for the timid, frail, or easily discouraged!  I have heard this from many women, and with over 51% of law schools female, why in the hell are the courtrooms, still almost all male?  I interviewed with a judge down in Las Vegas, between my first and second year of law school.  While I was waiting outside to meet the judge, several female lawyers, working in Clark County Prosecutors Office, happened to mention how sexist the judge was, and how he would ask very sexist question, leaving many job applicants, coming out of his office crying!  They told me some of the question, like are you planning a family, and such.  I said, well he can't ask those type of questions, it is none of his business, and doesn't have anything to do with a summer internship!

When I walked in the judges chambers, there were pictures of golfers on the walls, a bright fun office, so the judge and I had an entertaining and light exchange of golf game horrors, leaving both of us comfortable and at ease, until he started the interviewing process.  One of the first things he asked me was, do you have a family?  Yes, I have 4 children.  And who is going to take care of your children while you work?  I said my ex-husband.  And to my shock and dismay, the interview abruptly ended!  I walked out looking at the female attorneys who warned me, and said are you kidding me, like there are not single dads out there who he would never inquire as to whom he was expecting to watch his kids, while he did an internship!  So, be tough, calm, stay your course, fight hard, represent your position and don't back down!  Remember, stand your ground . . . doesn't just apply to physical self-defense!

Have Fun With the Law, the Other Attorney, the Judge--TNT When I Go to Court!  I Heard You Were the Best Attorney . . . in Parowan!  LOL!

I responded, I am probably the only attorney in Parowan!  The ironic and funny thing about this situation with a partner from the state of Utah's second largest firm, Parson Bailey Latimer, is that this Richard Geer, looking attorney, in his thousand dollar suit, Italian Shoes and matching leather brief case, perfect teeth, spiked up hair, was that, while he had read my Brock and Cheek case briefs didn't send the female attorney I had been talking to on the phone, as most law firms will make you earn your stripes, for about 20 years, before allowing you to go to court, so this woman assured me that one of the partners would see me in court, rather than herself . . . whatever.  I am one attorney, who is not impressed with making partner, all the trappings of attorney, dress for success, because, once you have made it, no one gives a rat's ass what you wear, nor should they ever!  And here is the rest of the story . . . 

So this is on a child custody issue, involved in a big divorce case, with a ton of money, property, businesses, and such involved . . . me and about 6 other attorneys in the case are all sitting talking before court, Mr. GQ, comes up, making an entrance, gunning only for me, many firms paid to read my briefs when they hit the e-filing system at the federal district court, and they knew my cases where hot, fun and challenging, so it was obvious to me, I was the one he was worried about, in the crowd of attorneys.  Being a lawyer, male or female is all about posturing, psyching the other attorney out, bull shitting the court and the jurors.  So, this guy is getting an early start, testing me before court, summing up his enemy.  I am not worried, don't play attorney games, I just know my stuff!  And I am not impressed by material trappings!

Dude is Assuming I Was Born Yesterday, And Just Got Lucky With the Brock & Cheek Cases, Both with Nationwide Readership--Failed to Realize that I had 7 Years of Practice Under my Belt, Award Winning Manuals, 3 College Professorships, Etc.  In Other Words, He, as Most Males, Underestimated Me!

The first issue before the court, touches on domestic violence, now the judge recognized me from her early days, and my expert days, training cops, prosecutors, judges, social workers and community members, and she is just waiting for me to capitalize on my strengths . . . well, your Honor, in the manual I wrote on domestic violence and sexual assault, getting an award from President Clinton, under the Violence Against Women Act . . . blah, blah, blah.  In my peripheral vision, I could see my client's wife, who just found out that I traded her husband attorney's fees for automobile repairs . . . they owned a prosperous auto body shop, glance at her attorney, like I am paying you $350 per hour, and he is getting it for car repairs!  It gets worse.

The next issue that rises out of the Wheel of Fortune game is the fact that my client has a DUI . . . well, your Honor, as a former assistant attorney general, who represented the DMV, or Driver Motor Vehicle Division of the state, handling 270 cases, statewide . .  . blah, blah, blah.  With each revelation of my past life as an attorney, prior to the 8 year hiatus for the government poisoning, or terminal brain injury, sent fear in the eyes of my opponent, as he got smaller and smaller, and his client was becoming increasingly more pissed off, while I am listing all my qualifications, to not only understand the issues, but devour my opponents brain whole!  Tootsie, who may have hired Mr. GQ, was squirming, acting bothered, while her high priced attorney, was doing everything but put his head in his brief case, expensive as it was . . . magical chambers to make you disappear as in a magician's show, perhaps?  LOL.

My usual custom is to shake the opposing counsel's hand after slaughtering them, rubbing in the unexpected defeat.  But this shattered and fragile ego, of this senor partner, still young, and years younger them myself, buried his head, up to his shoulders, giving me plenty of symbolic attestation, that he had no interest in shaking my hand, all to the exasperated cries of his client!  I love the law!  By all means have fun, take advantage of the fact that men will underestimate you, makes it even more fun to beat them at this allegedly male profession, still, or is it?  LOL!  Like I would tell my pro se clients who had to go to court without me at times, when I was too busy, Rip it up, tare it up!

From the Zionist Movement to New Testament Zion

This morning, while getting off the bus and entering the UNLV Campus--I figured out that the "N" stands for "Nevada", really, I didn't know, so the University of Nevada Las Vegas Campus, there was music playing, a jump slide, I was temped to slide down, but I was afraid, I might inflate the toy, and the real students, not a visiting attorney, might not get to ride the fun slide at the Just Jew It, booth, promoting, I would guess, a club for Jews, who are attending the university; I wanted one of the bright red t-shirts, with white writing, they were handing out free; however, they might get pissed and throw me, a wanna be, eternal student, hung out on college campuses, teaching for 7 or 8 years after graduating from law school, at Brigham Young University, in Provo, Utah . . . I Just Can't Get Enough . . . love colleges, college life, young minds, always the ones to engineer revolutions, right, Egypt?  

The next booth, on my walk to the William Boyd Law School, was the Intervarsity Christian Campus Organization, who offered me a bottle of water, symbolic, I am sure of Christ being the living water, and I jokingly said, that the Jews beat them to the first spot on the walk into campus, so they better get going . . . they said, I know, they have a party each year, and I said, then, you guys better have a party.  I believe the next group of campus missionaries, were the Jehovah Witnesses, I hurried past them, once you let them in your house, you can't get rid of them, much like the Mormon Missionaries . . . being raised a Mormon, I can claim rights to all three campus groups.  Joseph Smith, founder and first prophet of the Mormon Church, realized that the Jews were God's chosen people, at least in the Old Testament, He/She might beg to differ in the New Testament, so the Mormon prophet, decided to have members adopted into the tribes of Israel, so they too, could claim that status with God, male and female, created he them, in his image . . . .  Then, of course, Mormons claim to be Christian, while there are those who would argue that point, their real name is the Church of Jesus Christ of Latter-Day Saints, in name only, from my opinion, you haven't met my family, and they do close their prayers in the name of Jesus Christ, makes them Christian?  And, then, you have the Jehovah Witnesses, whom I have entertained in my home, and read their stuff, as I have many religions material and books, but, a former, apostate of the Mormon Church, started the Jehovah Witnesses . . . with a heavy emphasis on missionary tracking and proselyting, his mission, like many youth in the Mormon Church, see their missions, as the best two years of their lives . . . all down hill from that point on . . . sad!  

But this constitutional law attorney, a strict constructionist, reads the plain language of the U.S. Constitution, the first amendment, to be exact, and is no respecter of religions, nor the right to refrain from practicing religion all together!  

My next landmark on campus to let me know I am going in the right direction, is the Lied Library, an architectural wonder, a beautiful addition to campus . . . but, my mind wonders, why the strangely symbolic name of the building?  I wonder if third husband, Brett Stuart/Stewart, Kay Burningham, aka JoAnn S. Secrist, me, his proxy wife, and Shelley, my sister, who allegedly worked for Gumdrop Books, selling books to the Las Vegas area school librarians, allegedly, during the same time, her son, Jesse Anderson, and his wife and her, daughter-in-law, Tiffany, son, Jaden, were pirating my son, Elliot Taylor Secrist's music, God's Revolver, Little Black Horse Where are You Going With Your Dead Rider CD, winning Hard Rock Band of 2008, but this was back in the earlier days of the album, roughly 2005 or 2006, in particular, under their copies on a black market CDs, entitled Bandit, might actually have been the money base for this campus library?  Just a thought . . . my niece, Margaret Schmidt, or Meg, was a law student at the UNLV law school, at about the same time, and I offered at the time, to come speak to her class or the student body, about my securities, civil rights case, in 2010, Brock et al v. Herbert et al . . . did Shelley come speak, Kay,  Rachel?

Just a few questions that come to mind, as I walk to a from the bus stop on Tropicana . . . they drive a white limo for transport!  Got music, cases, resume, blog, all free, needed to launder that music money somewhere . . . is this a spot?  Shelley would disappear for weeks at a time to Vegas, after I left Brett . . . just a thought?

The wonders of America, where Jews and Christians, occupy the same sidewalk, side by side, respect their individual religious and cultural choices . . . Got to Love This AMERICAN RIDE!  Oh, the word, Zion, in the New Testament, means to be of one heart and one mind!  That is a great and improved application of the Zionist movement, work for happiness, not ego!  There is a great book, and if I remember the name, it is called, The Generals Son . . . an Israeli Living in Palestine, the author, now an American, who was living in California, started to attend Israeli/Palestinian groups, working for peace in the Mid-East, when he learned of the reoccupation of the City of David, after 2000 year absence, and heard for the first time of the Zionist movement, to take back what they considered their homeland . . . not the same people, maybe reoccupy after a few years, but 2000?  Come on!  Take property, possessions, and kick out the Palestinians?  It is possible to have one state, under one set of rules or constitution!  Check out American civil rights, Ferguson, South Africa, Apartheid . . . a work, obviously still in progress, but obtainable!

Need I say more?  There is a time and a place for boys and their toys!  Go after the right targets!  Killing machines to killing machines . . . make it count!

County Attorney for Ferguson . . . No Shame in Recusal!

County attorneys are part of the executive branch of government in the county; they work very closely with police departments, enforcing the laws of the local, state, and federal legislative bodies; therefore, while you have been elected by the people to represent the state in criminal charges, going after one of your own, so to say, is too hard, opens too much room to speculate that there would be bias involved, and you don't normally go after cops, nor file charges against them, so, this is an area, you don't want to venture into, was your hands of it!  County attorneys and cops, are like a team, on the same side, running a rely race to protect the health, safety and welfare of the citizens in their respective areas; however, no one expects a shoplifter, to be gunned down on the streets of your city, even less, to be witnessed by members of the black community, already sensitive, regardless of your capacities for sympathy, to relate to them, you just, simply, cannot!

Your family history and cop connections aside, you have a record that is suspect, right or wrong, with a built in prejudice by the black community, who sees that there were several cases, you failed to exercise your prosecutorial, gate-keeping capacity to justice, through failure to charge and prosecute several DEA agents, who shocked the community by unloading 21 bullets into a car in the Jack in the Box parking lot, with one of the victims, being totally innocent and the other, entitled to DUE PROCESS & EQUAL PROTECTION!  

Retain the dignity of your office . . . your choice to impanel the grand jury, and allow the defendant, cop, Wilson, to actually present his side of the facts to the secret viewing, lacking transparency, so needed in this case, is already evidence of your lack of objectivity!  County attorneys have a hard job, and one must be ever vigilant, to protect that line of demarcation between the job of the fact finders, the cops, and the charging entity, the prosecutor, who is to decide, whether, based on the facts, the witnesses, and the evidence, whether to prosecute or decline to prosecute . . . even waiting 9 days, to release the cops name, combined with the release of the video tape, and the bogus leak of Joci, hearsay at best, and biased a worst, without having the guts to face the cameras, the press, and the community, is just in poor taste, if not, downright throwing a red herring into the credible, first hand witnesses, who have subjected themselves to FBI and press scrutiny, and have remained true to their statements of the facts!

Even Special Prosecutors in Trayvon Martin, Were Trashed by the  Cops!

I was shocked, disgusted, appalled, disenchanted, and furious at the prosecutors, the cops who clearly were supporting the wanna be cop, Zimmerman, and a judge who could not have been more biased in favor of Zimmerman, than if it had been her son, avoiding every scintilla of fairness, fucking ignoring his counsel, and referring directly to Zimmerman, handling him with kit gloves, preference, and deference, leaving an indelible mark on the minds of the jury, shockingly unconstitutional, aberrant and a breach of justice, totally, undeniably, etc.

The prosecutors charged too high, the whole thing was a crock, don't  make that mistake!  Got to go . . . 90 minutes up!

What are Self-Authenticating Legal Documents?

There is something in the law, we call, self-authenticating evidence . . . like official government documents, like driver licenses, social security cards, marriage licenses, professional licenses, certifications, death certificates, birth certificates, living wills, wills, trusts, etc.  Just the other day, or since I have been in Las Vegas, Nevada, for roughly one month, the last remaining self-authentication, of any kind, just up and disappeared from my purse, with the one exception, that luckily, I had just forgot to put back into my purse, my Walmart Money Card . . . but, I have had to have several of those, due to theft too!  

So, tracing my life, lineage, travels, legal career, family life, living, and what not, have been sorely compromised, over the last few years, starting in the year 2000, when I either was poisoned, or got a terminal illness, and someone decided, that a cheap, down and dirty way to get a great legal career, complete with education, experience, jobs, honors, awards, good credit, and a great family, was much easier, stolen that worked for . . . so here is my story of identity theft, culminating, this week with the theft of my Social Security Card, that I have had since I was 16 years old, my Social Security Medicare Card, I have never used for medical treatment, but I have used as a self-authenticating document, after my driver license and Utah State Bar Cards were stolen, so here is goes . . . a warning to friend and foe, this could happen to you, even by those whom should be the nearest and dearest to you, family, friends, acquaintances, clients, and house guests.

Where is all Started--I Believe the Plan Was Well in Advance of 2000

Now, by way of family background information, that is helpful, my older sister, Shelley, Southwick, Anderson, Yeman, or whatever, has worked with my father, Richard Glenn Southwick, since she was in junior high.  I was always jealous, because, I was sure, when young, that my father, was Superman, looking much like the first, Clark Kent, working down around the Judge Building in Salt Lake City, Utah, a building that looked much like Superman's Office Building, and my father, who wore glasses in those days, and resembled the old actor, very much.  But, Shelley, seemed to have a way of working with my father, off and on, through the years, in and out, at various times.

In basically, 2000, I was either poisoned, or I was diagnosed with a terminal brain condition called PIX, that had the rare and strange, diagnosis of narcissistic personality disorder, really?  A deterioration of the frontal lobes, looking somewhat like dementia or early onset of Alzheimer's, so a brainless zombie, with a penchant for self-love, obsession and approval?  Wow, with now cure, would never work again, and with a guaranteed death sentence of 2 years . . . very interesting.  Now, how do you get rid of a smart . . . whooops, that narcissism, was not extricated out of me, during the witch hunt and burning, I guess, merely, due to the fact that I survived an unsurvivable, brain disease . . . LOL!  Nice try, but my father took over my life, sadly, and to my chagrin, now, that I even entertained the thought of trusting, a criminal, putting my stellar life, right diagnosis, at least on that narcissism part, in the hands of someone with my sister's best interest at stake, not my own, I signed a general power of attorney . . . dad must think is still in effect to this day, the holder can do with your life, property, money, I guess my children, my career, houses, cars, credit, as he will!  Even is it is against my best interest!  SCREEEEEEAAAMMMMM . . .

 The Placebo Effect!

Deep down in my heart of hearts, I never believed I would die . . . but, I did, however, give up on life, for about 8 years, waiting to die, leaving all my finances up to my father . . . bad move!  I can't describe to you, the stupid way, you live your life, when you are told you only have two years to live, will never work again, and there is no cure, almost worse diagnosis than cancer, and that no one has ever survived PIX Disease . . . except me, this narcissistic, disorderly, female, arrogant, bitch attorney, who is just too ornery to die!  This prognosis did take its toll on me, I had a bridge at the back of the right side of my mouth, that kept coming unglued, and I hated to bug my brother-in-law, dentist, Mark Nelson, and former boyfriend, in better times, now married, to my sister, Marcie, to glue it in again and again, so I tossed it, thinking, well I will be dead soon, so, what the hell, trash it!

Exercise, personal hygiene, hair, make-up, clothes, cars, houses, career, all thrown to the wind, for about 8 years, waiting to die, until, I realized that I had most likely been poisoned, with a man-made poison, that didn't work, or failed, some say, I had to have been given an antidote, or cure, but, then with 150 pounds to lose, I decided to start living again, easier said than done!  My father had sent my sister, both my driver's license, my state ID, and my Social Security Card!  And this is where the fraud and identity theft started, well, sort of, the cops, and attorney generals office, with two attorney generals participating, with two, a later one involved in the scheme to defraud me of my life, liberty and happiness, not to mention, my law degree, cases, children, etc., have just been indicted or charged with corruption, gifts, bribes, and all, so there is some validity, to their involvement in my identity theft, Mark Shurtleff, was a personal friend, collegue, and literally, asked me to run his campaign, but when I sued, after talking to him and the other guy, under indictment, he turned to my sister, who was a rat for the government, and just changed places, either threatening, pressuring, or killing those who were loyal to me, long and short of it.

The Story of the Prince & the Pauper, or Lawyer & Biologist

Remember the story of the prince and the pauper, when the prince was kidnapped by those who opposed him being on the throne, or something like that, and they found a pauper, who looked just like the prince, and put him in the princes stead.  I remember, Leo DeCaprio, having a mask put on his face, while he was locked away in prison, and his twin, stepped in as the heir to the throne, someone whom they could control, manipulate, influence, because they were getting a better deal than being themselves!  That is much the same here . . . big sis had bad credit, a lousy non-existent career, people hounding her with law suits, judgements, etc., and they allowed her and others to step in and take my place . . . hell, two cops, came and told me that Shelley had my original driver license revoked, or suspended, WHAT?

She was to benefit, she had possession of my driver license, without a record, or driving history, I think I might have had one ticket, and that is it.  She has tried to steal or get my Social Security for years, even making up lies and trying to go before a judge, stating that I was raped by 8 Burmese men . . . crazy shit like that!  And who is aiding and abetting her . . . cops, prosecutors, and judges, so, hell, yeah, in the Michael Brown case, get them recused, dismissed, or replaced!  She got a sweet deal, and I got her shit life!  This is the big switch, but I threw a wrench in the game, and did a great come back, all the way to the U.S. Supreme Court!  But even that was not enough to protect me from this den of thieves, thick as thieves, not to mention, the same tactics being used against my son, Elliot, bass guitarist for God's Revolver and Maraloka bands . . . that is cousin, Isaacs!  Seriously . . . it was not enough to steal over $700 million worth of cases, my law practice, house, furniture, cars, kids .  . . CIA infiltration in family.

And now, my fucking Social Security Card, and Medicare Card?  They also took my proof of State Farm Insurance, connecting me to my Ford Truck, insured by Amy, someone, in Cedar City, covered at the time the sheriff deputies took my truck, and then claimed I was driving my client's car uninsured . . . they took proof that I was insured, up to September, falsely arrested me in June, after stealing my Ford Ranger, 4X4, extended cab, truck, plus, took the key to my apartment or room in a townhouse, in Missoula, at Tony Osthemieir's . . . all evidence, of any connection to anything has been stolen.

How They Do It . . . Offer Deals to Visitors, Friends, Clients to Take, When Trusted

Great Falls DMV either lost or stole my driver license, after I registered or paid to register, Mike Hall's car, which is was buying.  But, I didn't worry much, because I had my Utah State Bar Card, but last July 4th, 2013, while visiting Susan, a friend in Helena, she asked me, plan, to go with her on the 4th to honor the vets, at the VA Hospital, in Helena . . . gone for hours, new roomie, with a boyfriend who was arrested a day before, stayed at the house, I am sure that she was offered a deal to get him out of jail, if she took  my bar card, picture ID . . . gone after 4 years in possession after getting my law license reactivated!

I am sure that either a girlfriend, or one of my cousin's renters, whom, I guess, might be undercover, Ph.D. from Standford, allegedly dying of cancer, who has been in the house, while both me and my cousin have been gone, could have been paid, ordered, or assigned to take the ID!  There is a fine line between, love and hate . . . I have found, that there are those who admired you, but at the slightest provocation or rejection, either personally or professionally, by these alleged hot shots, the love turns immediately to hate, and it becomes a personal matter . . . this has happened over and over again.

I am leaving Las Vegas to return to Montana, tomorrow, on the 9 a.m., Greyhound Bus, if all goes well, arriving in Kalispell, sometime around early afternoon, on Thursday, if I am guessing right.  So, perhaps, this last ditch effort to stop me, may result in foul play, but I am not suicidal, always error on the side of safety, or I would have been long gone, and that is the reason for being here in the first place, left Beartooth Mountains, after double blood bath on highway at 3 a.m., took off to Helena, then to Great Falls, then to Vegas, by way of St. George, where assess to kids, blocked, or spouses, CIA, objected to . . . truth hurts fuckers!  Got to go!

Totality of the Circumstances in Fergeson--Racial Distrust

I am sitting at the University of Las Vegas Law School, 3rd Floor Library, on a school computer, giving me barely 90 minutes per session, having left my personal computer in Montana, almost a month ago, thus the lack of blog entries and postings--this, however, is an issue, I would be amiss to dismiss or fail to address . . . their are too many issues I feel strongly about, and might be able to shed some, somewhat educated light on, having formerly been, staff attorney for the Utah Prosecution Council, in the Criminal Enforcement Division of the Utah Attorney Generals Office, switching sides, being a constitutional law attorney, having not only done criminal defense work, but also done civil litigation, with civil rights, 1983 actions, not only against the state of Utah, Department of Commerce, Division of Securities, and state officials acting in their official capacities, under color of law, for violating federal and constitutionally protected civil rights, while working for the state, in addition to suing Iron County, Utah, narcotics task force, police, sheriffs, the county attorney, and the Division of Child and Family Services, for like civil rights violations, perpetrated by local and state officials, in their official capacities, while working allegedly under color of law . . . or with the force of law behind them; therefore, having somewhat of a bird's eye view, having worked on both sides of the fence!

They Say, The Most Powerful Person in the World is a Turn-Coat

Case in point, Edward Snowden, ratting out the NSA, as one of their own agents, privy to the programs, methods, and violations of constitutional rights . . . I fall into that same category with prosecutors, cops, and even judges, not lacking in credentials, up to an including a bar membership in the United States Supreme Court bar . . . character assassinations aside, they have done little to stop me from voicing my opinions and power punching cops and prosecutors of all levels, in addition to clocking a few judges on my way to the top of the legal world.  So, for what it is worth, here are a few of my comments and observations on the Fergeson, murder of Michael Brown and tangentially connected issues . . .

Smart Move on Gov. Jay Nixon's Part, Appointing Officer Ron Johnson, Home Town Boy

I have been totally impressed with Highway Patrol Officer, Ron Johnson, who has reached out to a grieving community, walked with those who morn, cried, not afraid to admit sorrow, sadness, apologize, and do all that he can in a professional, humanitarian, kind, rational, and sympathetic way, yet as manly as you can get, strong presence, voice, stature, command and willingness to work with the protestors and cops alike . . . someone who can stand as a role model for cops, nationwide.   

There are multiple levels of cops, agencies, and levels involved in this conflict, shooting, involving a white police officer and a black teen, with an already frustrated and mistrusting community, if not the state, other states, cities nationwide and the world watching . . . I think it wise to take the local police chief, who is too close to the situation out of the equation, as well as the county sheriff's department.  Many don't know that the highway patrol are state cops, police, are city, and sheriffs are county . . . FBI, of course is federal.

Often, there are jurisdictional issues, resentment from local and state law enforcement, when the federal agents step into the situation, with the state highway patrol, being, in my mind, the least conflicting, on those turf issues, with all the law enforcement agencies involved, and perhaps the least interested on an agency basis, having more to do with statewide issues, highways, protection of state officials, and working with state issues.  That is just my personal opinion . . . so a great move jurisdictionally, racially, professionally, locally, bringing in someone who knows many of the local leaders in this crisis and community.

I was most impressed with Officer Ron Johnson, when he said that after the church meeting yesterday, that he would go see if black son, who wore his pants baggy, baseball hat to the side, with tatoos, relaying to the parents, not only of Michael Brown, but those living with teens themselves, who are struggling with the anger, the aggression, the youthful invisibility, of teens who were not only Michael's friends, grieving his death, but worried about their own chances of survival with the deaths of Trayvon Martin, Sean Bell, Davis, Gardner, and another black teen shot after he and friends, were ordered off the BART subway system in San Francisco, to get up against a wall, when one youth demanded his rights, and he was wrestled to the ground, man-handled, cuffed, and then shot execution style, in front of his five friends, who were questioned after someone merely called in about a disturbance on the train . . . the four burly officers just assumed it must be this group of young black boys!

Remember What These Deaths Have Been the Result of . . .

Martin . . . walking home from the store, with all rights, privileges, property, and self defense, who thought Zimmerman was a sexual predator following him home!  Gardner, chocked to death for selling unwrapped, single cigarettes!  Subway youth for asking or even demanding his rights to be questioned . . . what happened to probable cause, my point, I guess their blackness was the PC that led the officers to believe they had been the ones who committed the disturbance!  And now, Officer Friendly, Wilson, going for broke after Michael and his friend didn't immediately get off the street, when ordered to!  Some of us, actually were watching from the first minutes after this murder was witnessed, while the eye witnesses, who not only pulled their cars over, stopped in their apartments, but took videos of the incident, being so out of the ordinary, during broad daylight, on a Saturday afternoon!

I don't care if Michael had robbed the convenience store, or had traces of marijuana in his toxicology report from the state medical examiner . . . in our system, he could have left a dead body in the store, and he is still entitled to due process and equal protection of the law!  Nothing justified the shooting, not attitude, not even walking toward him . . . which is not what any of the first hand witnesses said!  Nine days later, through a leak, by the officer's friend, it is coming out, that Michael "bum rushed" the officer, who was sitting in his cop car, with a gun for god sake!  Get real . . . in fear of his life?  A gun, is the ultimate equalizer, between men of differing sizes, men and women, cops and alleged assailants!  In fear of eminent danger, when you are protected by a squad car, with a gun in your holster?  REALLY?

What the hell are you doing being a cop?

By All Means . . . Dismiss the Prosecutor, Often Seen as Hired Gun of the Cops

One of the biggest complaints I have of prosecutors, is they are letting the tail wag the dog!  Too often, the cops will come to the prosecutor, and strong arm them into taking a case, when the prosecutor's job is to be the gateway to justice, not find a way to substantiate anything the cops tell them is a crime!  The prosecutor has gone to four years of college, in any field, and then to an additional 4 years of college to get to the point of understanding the law . . . while there are many officers with college degrees, in criminal justice, there are just as many with little training at all, and that is sad.  However, I have personally offered law enforcement agencies, free of charge, legal training on constitutional issues, that they often become tangled with in times of arrest, serving warrants, searching vehicles and homes . . . etc.

Many don't know, that most judges, come up through the ranks and files of the prosecutor offices, and there is nothing wrong with that; however, from being on both sides of the criminal justice system, there is a saying, and it is also in the defense attorneys' bible . . . you have prosecutor number one, the prosecutor, and prosecutor number two, the judge!  There is a certain mentality that goes with prosecutors and defense attorneys, and I am not sure that is good!  The prosecutors tend to wear their golf shirts and dockers to conferences, have an arrogant attitude, as if they have never done any wrong, and their shit doesn't stink . . . defense attorneys, wear shorts, flip flops, and Hawaiin shirts, and swear, much like I do.

Prosecutors have all the levels of cop agencies, plus the judge on their side, if you want to know the truth, and the defense attorneys, stand alone, armed only with the U.S. and state Constitutions, to protect their clients, and I have had jury instructions go from 9 the night before trial, to 23, throwing out not only the Constitutional protections of my client, but mine, or his own defense attorney's arguments, with unseen prosecutors, working on jury instructions, from behind the scenes, while the prosecutor I am in court with, and the judge, are with me, so who in the hell had time to write me and the Constitution out of the jury instructions . . . the 4 other prosecutors who are watching the trial from short circuit TV?

I have also had the county attorney, who has been recused from the case, even show up at a 1 a.m., not 1 p.m., jury deliberation, looking over the members, implying, you are next, if you dare let JoAnn win!  I have also had the press, point blank, while interviewing me on a hot case, being told by the prosecutor, if JoAnn wins, you can't publish it in the newspaper!  So hell, yes, get rid of the fucking prosecutor . . . who had a father, who was shot as a cop, who mentions his father at times, and failed to find anyone, cops, guilty of the killing of two black men in the community.  Even though the prosecutor has been elected, and around since 1991, doesn't mean he has been the gateway to justice, he may have run unopposed, people generally, don't know the prosecutor, or they fear, they may get someone worse!

Militarization of Cops & Protestors . . . Motives?

Militarization of the cops, a police state, armed with M-Raps, BearCats, riot gear, tear gas, etc., don't belong on the streets of America!  This is all Patriot Act, bull shit . . . many of said, of the trouble makers in the crowd of peaceful protestors, that they are outsiders, coming in from other states, or are they paid by the cops, or supporters of totalitarian governments, police states, tyranny, oppression, facism?  In both Israel, and the Ukraine, the trouble makers, those breaking the rules, shooting down planes, ignoring peace or times when both sides of agreed not to shoot, or no strike zones, or times, there have been members, who have stirred up trouble, but seem to be, not associated with either side, just causing trouble . . . remember, there is money to be made, Haliburton to get paid, government contractors, military complexes with interests in all of this, keeping the battle going!

There is a figure or a protestor, CNN often shows at the beginning of a parade, with a black shirt, that says, God before Money!  We are One Nation Under God . . . we need to focus on resolving the issues, with UNITY, LOVE, AND FREEDOM IN MIND!  Cops, as are attorneys, power hungry, and power driven, so a police state, tyranny, militarization, only feeds the egos of law enforcement, who literally freak out, when a jay walker, doesn't immediately hop to, and obey his command to get out of the street!  Is this really what we want in law enforcement?  Do we want to give them more power than they already have?  It is a sad day for law enforcement, peace officers, and their counterparts, of all levels, when people are more afraid of them, than the criminals, these public servants are hired to protect the citizens from . . . I am white, female, and I never, ever, think about a rapist, murderer, an assault, sexual assault, because, as a constitutional law attorney, who has sued cops, prosecutors and gone up against judges, all legally, constitutionally, and lawfully, it is the cops, who terrify me, why?  Because, they have the legal power, abused generally, to make my life a living hell . . . and they have.

Dreams of Two Presidential Candidates--Cat Cartoon

Yesterday, I spent a substantial part of my afternoon, talking to Obie, short for her Nigerian name, with about 20 characters in both the first and last names, that I could not pronounce, if my life depended on it, but our conversations went from a hit and run accident, she got into in her Mercedes with a man who took off after nearly totaling her car, while she was actually on her way to re-up her auto insurance, after being out of the state on a modelling gig, only to get hit a day before she could make it across LA, to make her payment, to a worker's comp claim, for being an extra, getting heat stroke or fainting while working as an extra in the movie, Fast & Furious, not to be confused with the government selling arms to third world countries, or drug lords in Mexico, being used against our border patrol and their own citizens, to talking to Obie, about her mother's 20 year struggle with INS, immigration and customs, to get her citizenship!

As we talked, the issue of her mother's fear of visiting her dying mother in Nigeria, after not seeing her for 20 years, and the fear of taking Obie with her, who had not been circumcised, being two years short of becoming a citizen herself, fearing her daughter would also become a victim of what happened to her as a child, being cut and sown up, which was the custom of her tribe or country, either for religious reasons, or those pesky social mores, making sure that girls, are virgins, until their marriage, when their new husband, gets the pleasure, to her pain, of ripping the hell out her stitched up vagina, ensuring he was getting the girl he bargained for!  I told her it was just her luck, that she got the only, female, attorney in the USA, and member of the United States Supreme Court Bar, to be female circumcised by pissed off males, after getting 9 federal agents and attorneys fired, with the feds getting the form of punishment for this female attorney, from a paper, a scholarly work, published, and awarded, having been written for an International Law class at BYU, 1993, with professor, Michael Goldsmith, on female circumcision!

I also, informed her, that just this week, President Obama, was meeting with I believe, 50 or so, big business heads, from various countries, throughout the African continent, and asking them to help eradicate the barbaric practice of female circumcision!  He wisely, went on to say, as these business leaders seek to improve the economy and standing of Africa, in the world, that a good indication of the character of a nation is the way they treat their women!  Thank God for men, like President Obama, who have not only spoken out about this disgusting practice, but others that America also needs to remedy, like domestic violence and sexual assault . . . out sexist shit stinks too!  So I am sure as I sang the praises of this act of chivalry and valor by our President, seeing it every bet as important, to use he respected reputation and world popularity, to end wars in Iraq and Afghanistan, to make an impact, to help women worldwide, with archaic and backward customs and social controls, that benefit men, but sorely hurt, scare, control, and batter women, but it is within this context that I had the somewhat amusing dream, I had last night, with no connection to reality, decorum, rationality, and credence!  But, just for your entertainment, purely intended.

REM Sleep Center to President Obama

I will admit, I have more than one news source, and unlike Sarah Palin, I can tell you what news sources I read, and where I got my information.  But I have long respected the Obama's as a married couple, and I guarantee you Michelle, you have nothing to worry about, from this inane dream, so no implication or intent, just the deranged mind of this women, very appreciative of what your husband is trying to do for women.  Now, I have long thought President Obama was and is hot, a bit too thin, for this beef cake chick, who has come to the realization, that I don't need to lose weight, I just need a bigger man!  But, take a dream, for what a dream is worth, this one just funny.  But I have read the reports of divorce, Michelle's tell all book, much like those of the Clinton's and the Bush's marriages on the rocks, by the Big Foot and Elvis believer's crowd, so I think my moments, grabbing a National Enquirer, with as much interest as I do a Wall Street Journal or Salt Lake Tribune, or one on that level, the Mormon owned, Deseret News, you have to just consider the source!

So, last night, Edward, my cousin, not to be confused with Edward Snowden, I just wrote about, an hour ago, took Obie to the Bellagio Hotel, and to other social events around Vegas, for a night of dancing, drinking and whatever follows that, I feel asleep, but my early morning dream was just as entertaining and full of surprises.  For I had a visit from the President of the United States, not dressed in his normal office and running the country attire, but wearing a red golf shirt, and khaki shorts, with sandals on, and he was sitting with me in his car . . . no secret service.  So as my sleepy brain, becomes cognitive of me sitting with the President in this casual setting of his car, me, of course, in a white, symbolic of pure, summer dress . . . haven't worn white, nor a dress for 14 years, but, nonetheless, that is what I was wearing, and I am sitting in the passenger side of the front seat, while both of us are listening to the news, although, I admit, I was more worried what to do with a President, than listening to the news!

So, I scoot across the seat, old style car, no bucket or hidden chambers in the middle, but I move next to the Barack, we will use a more familiar term, due to the circumstances in the dream, and kind of cozy up to him, with not response from him.  No return of affection, just a question, to see if I had a take on the news that just came on the radio . . . what, the radio, I hadn't listened to what was being said, I was too busy, trying to figure out why I was with the President, why he was so casually dressed and what might bring about a meeting with him, or the events that were taking place, just taking clues as I saw them . . . the news you ask . . . I didn't get a BS degree, in English and communications for nothing, so I play, stump the President and bull shit my way through a semblance of a response.

I don't think he bought it, but he was his normal cool self, and was wise enough not to start an argument with me, President or no President, I don't like to be questioned on my knowledge or my interpretation . . . that is why, when given a chance on this blog to receive comments, I declined, I don't care to hear your critique, nor value your response . . . just kidding, but not really.  So there is a long silent, pregnant pause in our conversation, and I am still wondering why I am sitting, now awkwardly next to the President, in a car, thinking of a plan to scoot back across the seat, unnoticed.  Finally, I said, so, Prez., why are we here?  After some time, he said, I am a play boy . . . that most likely came from me watching the news the other night, or it came from Rachel Maddow or Jon Stewart, making fun of Fox News, making fun of the President playing golf with the head of some state or nation . . . Barack was wearing a blue shirt and shorts in the segment, so I believe I was influenced by that, but my mind put him in a red shirt . . . a far more powerful color, symbolically!

My Dream of Mitt Romney, Just Days Before the 2012 Presidential Elections

Now, anyone who has followed this blog for any substantial time, knows, that I believe their was foul play in my $357M securities case, Brock et al v. Herbert et al, with me suspecting for good reason and with some supporting circumstantial evidence that my contingency fee of $118M ended up going to Mitt's campaign, given the players involved, the close connection between my family and Romney, through church sources, the overly representative percentage of Mormon CIA, FBI and NSA being Mormon, and a hotly contested and battled campaign, with me pulling for President Obama.  So taken in that context, you have to just consider the source . . .

This dream, of Mitt, is just as uncharacteristic of Mitt, as the one about, Barack . . . with a slim chance of either one of them ever being with me in reality, or in person, or in the situation presented in the dreams.  But, there is one caveat, for Mitt, and that is that every Mormon male, in his heart of hearts, believes that he will have more than one wife, about 10 virgins, if he lives well in this life, and at the time I had this dream, I was actually visiting a friend, who's father, while not a polygamist, was living in a sort of compound, just outside the top security area of the mysterious area 51, where there have been claims of UFO's and other worldly visitations by scientists who have been chased and tainted reputation wise, as I have, for revealing the truth about government secrets, no matter how bizarre they seem to be . . . so, that also may have influenced this dream, as did the last thing my friends father said, after we watched Russian news, from his self sustaining compound just outside of the Shevowitz Indian Reservation, 17 miles west of St. George.

I Didn't Even Want You For President!

I am sure, the somewhat justified, psycho-sexual analysis of both of these dreams will be, for this sexually repressed attorney, with no clitoris, that I have a latent desire to have sex with powerful men, I even entertained, a tryst with Putin, in my grandeous delusions, of actually finding a man, that is my equal, watch, the free YouTube movie, My Fake Fiance . . . Harvard grad, totally my personality . . . but here goes this somewhat humorous and interesting to say the least dream.

Okay, so you all know, that Governor Romney, or Mitt to me, in this compromising dream, has perfect hair, seldom do you ever see it messed up, but in this compromising dream, and Anne, due to the Mormon belief, in a similarly barbaric custom of polygamy, you might have a bit more to worry about . . . seeing that the twin relics of barbarism are slavery and polygamy, with Mormon males, and their co-partners, who are little more advanced than Africa, in custom and belief towards women, with many similarities, between Mormons and Muslims, who in some countries practice female circumcision, through Islam, and seeing that the punishment of choice for me, in Utah, also have polygamy in common.  Although Allah gives those who strap bombs on themselves, 70 virgins, rather than the allotted 10 virgins, in current Mormon scripture!

So, in the dream, Mitt is laying naked over me, with his hair, falling forward, only a sheet over he and I, I don't recall what I was wearing, but I am sure the shock of the dream, made me hopefully, wearing at least a nightgown, being overly prudish and modest.  But Mitt is up on his arms, on top of my body, with this sheet over me, and I get this thought, much like when I asked a rapist, in reality, laying on top of me, what are you doing . . . breaking the spell of fantasy, but I just look up at Mitt, again, in shock, but calm and secure in my comment . . . I didn't even want you for president!   

With the thought, that what the hell are you thinking, dude?  But, as I analyzed the dream, I thought, maybe, had he listened to me, read the same emails, I was sending to President Obama, or after the interception, to Senator Testers Staff in Montana, giving valuable critiques, comments, and thoughts about the election, the debates, comments I heard from the Mormon underground, like the fact that Mitt was building his 5th home, this one in California, with an elevator, going from the basement to the front door, bringing he car of the day, to the main level of the house, at a time when millions of Americans were losing their only home, with Obama's having only one home, besides the White House, if I recall, but stuff like that, with former President Clinton, joking about that house, or fact, he might have done better than listen to his staff, who were in fighting and leading him astray through false statements of fact and fiction!  

And in that context, I could see him wanting to be with ME!  Much more objective a source!

Anyway, we need to end all barbaric means of treating women, slavery, polygamy and female circumcision . . . plus, follow the 14th amendment of equal protection, how can one couple, with the INS, claiming her marriage was fraudulent, stopping Obie's mother from obtaining citizenship for 20 years, while granting the other partner to the marriage, citizenship years ago . . . denying her, even after finding the marriage to be valid, and irrelevant to the INS proceedings, but still used against this noble, honorable, Nurse, from Pennsylvania! We are better than this!
