Rule 301. Presumptions in Civil Cases Generally

In a civil case, unless a federal statute or these rules provide otherwise, the party against whom a presumption is directed has the burden of producing evidence to rebut the presumption. But this rule does not shift the burden of persuasion, which remains on the party who had it originally.

FIERY JUDGES GRILL ATTORNEYS OVER TRAVEL BAN

• the government and it's attorney, are used to excusing everything from searching our bags at airports, to using body scanners, now, to putting a travel ban, on 7 Muslim countries, without any good reason, no statistics, as to actual, incidents that would qualify, these countries, to be banned, when, countries with known connections to extreme radicalized terrorists, with connections to other countries far worse, and they are not banned/ therefore, what was and is the criteria, on both Congress, President Obama, back in 2015/16, to create a list such as this, which, President Trump, and the  Department of Justice, or Injustice, with a very, arbitrary and capricious list of 7 countries? 
• due to using the same list from the Obama administration, which, seemed, like some type of power grab, or something the attorney, seemed to think, empowered the Trump administration, but, do two wrongs make a right?  President Obama, overstepped his powers the time, but to overcome that, they seemed right off the bat, the attorney, tried to connect Congress to the Powers of the President!  I believe that is, because, under the Constitution, it is the role of Congress to create, uniforms laws of naturalization, in this system of separation of powers, checks and balance, and an act of Congress NEVER overrules the balance or the checks the founding fathers, put into place, not to be easily, dismissed, ignored, or supplanted, and not to be ignored.
• I think, it was, very, evident, that, the judges, other than, the oldest judge, 85 years old, Camby, seasoned, more reserved, sitting back, taking in the arguments, and probably the tie breaker, Friedland, seemed more drawn and defensive of the state of Washington's arguments, standing, and more comfortable, with, the legitimacy and role of a state to step in, on behalf or, the citizens, of the state, whether it be for proprietary interests on behalf or state finances, from business, to tourism, to universities, and visiting, professors and scholars from those countries . . . an interesting statistic, that was not brought up by the state's attorney, was the fact, that, 17%, at least of some colleges and universities, maybe the ones who are bringing their own, challenge to the travel ban, but, stopping top scholars and professors, is a huge concern, not only for colleges, but for the business that, these students, feed into.
• Muslims, make up the largest community of Muslims, in the state, of Washington, I believe, west of the Mississippi, or, of Chicago, or whatever; therefore, giving, standing, as the government, on a standing principle of patri parens, or like a parent, standing in for an injured child, or in a similar role . . . but if that fails, the stronger, arguments in this bad ass con law chick, and in the minds of the judge(s), to me, they were almost saying, don't abandon your constitutional issues, that is the argument! 
• on the news, shows, after, CNN, Alan Dershowitz, fired up himself, went from, earlier, stating, that the ban was both, constitutional and unconstitutional, playing the politician, not the attorney, but the law professor, but, if part of it is, unconstitutional, then all of it is unconstitutional . . . some seemed to, and even before, the oral arguments, it was on the news, that the government was willing to meet in the middle, distinguishing between, citizens with absolutely, no connection or legal reason, visa, green card, from those who had a legal, reason to be in the country, already, vetted, some having waited YEARS, to come over to the U.S., going through the toughest, immigration procedures already!
• national security arguments, have been given, a carte blanche pass, when it came to stepping on both citizens, and travelers' constitutional rights!  The federal government, in general, is used to walking into court, and saying look, we are the big guys in the room, but, those days are over, states, people, as we see, in the 9th and 10th amendments, created the federal government, and gave, both the president, and Congress, certain, powers, and the rest are reserved, for the states, themselves, as sovereign states, and the people within those states, as if to say . . .
• this is an OLD argument, you better have hard core REASONS, for the ban, and Canby, even said, and jumped the DOJ attorney, when he stumbled over the very weak position of the governments, almost, like isn't is obvious, we win, with national security anytime we bring it up, so, what more do we need?
• Camby, jumped his ass, and said, when he couldn't come up with statistics of examples, for the reason behind, the particular 7 countries, when, there was no, goddamned reason, these countries were selected by either President O, or Congress . . . going back to the record, and the U.S. district judge, Robart, who, similarly, caught the government attorney off guard, saying there has to be a reason, evidence, terrorist threats, for me, to uphold, President Trump's ban, and if you can't show, some fact, not the typical, alternative facts, the White House, seems to rely on all the time, with no foundation, in fact or law, that seems to be a weakness in the GOP in general . . . with people, feeling, that President Obama is a Muslim, with a 20 year history of being a Christian!
• the federal judges, know the Constitution, know, the excuse for using national security, and seemed to be saying, not good enough any more!

• Judge Richard Clifton, one the other hand, seemed, prepared, and ready for bear, to try to debunk, the states, arguments, from standing, to the Constitutional arguments, that Trump and his administration were, caught, using, legal, or statutorily, supported, means, to cover-up, the real reason for the ban, which was to target countries, that were Muslim, but, he then, turned around and said, that these countries, were not, statistically, Muslim? and that all Muslims, have, attachments, to radical extreme terrorists?  I was unsatisfied with the judge's unsupported, statements, for the same reasons, with the state's attorney, arguing that, they had not even been in the stages of the lawsuit, to have done discovery, therefore, as the case progressed, there would be, evidence, that would substantiate, both, newspaper, video, and statements, made by candidate Trump, trying to separate, the candidate from the President, with, this guy, trying to shove through, his campaign promises, including a Muslim ban, in part or whole, to keep his campaign, promises . . . therefore, I thought the judge's argument was equally weak!
• the issue, is, that the national security rational, underlying, the ban, was, that they, the 7 targeted, countries, but if, there is not, threat, then there SHOULD BE NO THREAT, NOR BAN!
