United States Constitution, Bill of Rights, Fourth Amendment!

"The law should not be a 'toy' for the rich and powerful to play with."

I generally start out my introduction with the plain language of the law, or the Constitution, but, you are all pretty familiar with, the wording, and are somewhat familiar with the rights and protections, so I am going to, just, break down the major parts of this very short, but, powerful, protection from, unreasonable searches and seizures: (1) the amendment is to protect you, your house, papers, and affects, which, just recently, the U.S. Supreme Court, ruled, in U.S.A. vs. Jones, that, a car is within the class, of protected areas, where there is an expectation of privacy, the buzz phrase, for, the idea, that these areas, are particularly, gnarly, for cops to invade or penetrate, therefore, in order to search or seize, these classes of protected areas, including your person, and modern, extensions of the principles and concepts behind, each class, like, in my $357 million securities case, I extended the category of papers, to include my clients' computer files, where, we now store and contain our papers, so, (2) in order for the police or other government agents, officers, and regulators, if they want to search, particular items, they need to have probable cause, that there is something amiss, or there is possible criminal activity, taking place, and to prove to a magistrate, that, their is reason to obtain an warrant, the officers, must, list what it is they are looking for, or who they are looking for, and the items, or persons, papers, affects, house, apartment or tent, in the case of some homeless persons, that they intend to find this crime, or the criminal, and in written form, they need to describe those things, before they are granted the powers to violate, intrude, or look into, the personal property of this person or to seize or arrest them; and (3) this is to be done through oath or affirmation, or the writing and presented to a judge, to look over, make a determination, to grant, or to deny, based on the particular circumstances and substance of the alleged, probable cause!

A CITIZEN IS MOST LIKELY TO ENCOURTER A COP, IN THREE AREAS: (1) ON THE STREETS; (2) IN THEIR VEHICLE, OR (3) AT THEIR PLACE OF ABODE OR WHERE THEY LIVE, WHATEVER THAT IS, ALL ARE PROTECTED, AS A CASTLE, AS IN THE IDEA THAT A "MAN'S HOME IS HIS CASTLE" . . . WOMEN AND CHILDREN INCLUDED

SET FIRM, LINES IN THE SAND, OR DECLARE YOU INTENT TO EXERCISE YOUR RIGHTS!

This is a very wise thing to do, for several reasons, it establishes the fact, that you know, you have these rights, and you intend to keep them!  If the officer, crosses, those boundaries, or rights, that you have set, then, if you go back, or you are falsely, arrested, detained too long, or there was no warrant, nor any exigent circumstances . . . emergency, situations, like, screaming, destruction of evidence, or a witness to a crime being committed that allows the cops, to proceed without a warrant, which is the general rule, for, searches and seizures, and the officer does, violate the rights, you have made it clear, before hand, that you, fully demanded those rights, in a nice way!  Be firm but fair!  By way of comparison, and analogy, remember when, President Obama, drew a line in the sand, or said, if ISIS, or in Syria, if this or that, happened, or was committed by Assad, he was going to do this, or engage the United States powers, to stop . . . the complicated situation, changed, and he, in my mind, waited, and did the right thing, now, bombing, every three minutes, for the last year, but, keeping ground troops, out, while handling.  But, as you can see, many, due to the line, then, another line, then, another, created, issues and problems, some seeing that as weak, or whatever!  Keep that idea in mind, you need to declare your rights, don't threaten a lawsuit, just say, something like, "I am a very private person, officer, and, I don't allow searches without a warrant, to do so . . . so, no, you can't search my backpack, nor my car, nor my house!"  Clarify your boundaries, and Dave, ACLU, added, and rightly so, that, there are verbal boundaries, you need to set, but the physical openings you create, like opening the door, to your house, allowing for easy access, can, create, an opportunity, for entrance, even through, you never intended for the officers to come in and even said, so!

REMEMBER . . . YOU DON'T HAVE TO GIVE CONSENT!  YOU HAVE A RIGHT, TO STAND YOUR GROUND, TO QUESTION THE OFFICER'S ACTIONS, AND TO DEMAND, YOU GET THOSE CONSTITUTIONAL PROTECTIONS!

Most people, will dismiss their rights, thinking, I don't have anything to hide . . . so go ahead!  What you think, is okay, and what a law enforcement officer, thinks is okay, are world's apart, and you also have to control the spin control, or some slanted, interpretation of your compliance, or your refusal, so, it calls for a firm, grip on the situation!  This is not, evading the law, not acting, criminally, to ask for your rights!  Do, not be belligerent, or cops an attitude, believe me, I have done that, and it doesn't work, even though, I was justified, completely, with cops, different cops, stealing my truck, and personal property, to the tune of $20,000 . . . the incidents were somewhat connected, but, I was dealing with officers, not even of the same, jurisdiction, or powers, city cops, verses the sheriff's department, who committed the crimes, thefts, and criminal acts, against me, so be careful, being mouthy, especially when the cops are trying to cut you a deal or give you a warning!  Even if other cops, fried the fuses of my headlights, simultaneously, to keep me in the county, so they could, abuse their power and control!  LOL!  But, smart ass comments, never work very well . . . I got arrested, not for the headlights being out, but for my smart attitude with the cops, who had, finally had it, with two previous cops, not doing anything about the headlights out, even thought, cops put them out, or the NSA did.  Just be as courteous as possible, they are JUST DOING THEIR JOBS, UNLESS YOU ARE A CONSTITUTIONAL LAW ATTORNEY, WHO SUED THEM!  LOL . . . I AM AN EXCEPTION TO THE NORMAL, RUN OF THE MILL CITIZEN!

Be careful, to be fully aware of, your persons, purse, backpack, vehicle, house, tent, or apartment . . . like Dave said, you are responsible for, everything that happens under your CONTROL, like having a friend, who has meth, in your car and you don't know, and you tell the officers, sure, go ahead and search my vehicle, I have nothing to hide--you, may be clean but, your friend is not!  I had a situation, being a smart ass again, with cops, who were poking around my backyard, about 2:30 AM, and I was in my home office, watching flashlights, going, around to the back of my house, so, I surprised the cops, and opened my back door, and asked them what they were looking for?  We are looking for so and so, one of my clients, who was staying at my house, because, due to all his legal issues, they were fighting and looking at a divorce, he was, studying, criminal law, and wanted to be a private investigator for me, so, I told him, he could stay at my house, with several empty rooms.  At 9:00 PM, the last I saw my client, his wife and two of his daughters came over, and being the total optimist, I was sure, that they had worked out their marriage, and he was with her!  WRONG.  I told the cops, they could go straight up to his room and look, assuming he was long gone!  To my shock and horror, three burley officers, hauled my client, downstairs and arrested him, right in front of my face!  SCREAM, who needs, cops when you have a civil rights attorney, #2 in the nation, allowing a search of her home, with consent, and your sworn enemies, are manhandling, you right in front of her!  NOT LOL!  I immediately, reminded, the officers and their chief and the city prosecutor, whom I was friends with, that, your fucking officers, can't even serve a warrant for a misdemeanor, at that time of night, hours are 6 AM to 10 PM!  So, the officers, up and had the prosecutor, change the charges, up to felonies! 

I am a good attorney, and can get my clients out of everything, except, CORRUPTION IN THE SYSTEM!  I was furious, but that didn't help my client!  Never again, will I assume, that this person is here or there, and always, protect, their rights and my rights!  SHIT!  So, do not just give your consent, you may be surprised, what a cop can find in your purse!  Our attorney general, in Utah, said, that every man, woman and child, has committed three felonies before, noon!  There were so many fucking laws on the books, that, it is impossible for the attorneys, or the cops, to keep up on them, but there are organizations, like the one, I worked for at the Utah Attorney Generals Office, the Utah Prosecutor Council, as staff attorney, that it was my job, to keep, attorneys, prosecutors, informed on all the latest and greatest, new laws, that came about, as a result of this case or that, and one fact, new, can change the law, and believe me, SWAP or the State Wide Association of Prosecutors, was all over, all these new, twists, in the law, that some clever criminal defense attorney, or civil rights attorney comes up with!  Case in point . . . cops were using hi-tech, license plate scanners to check, insurance and registration of drivers, and hauling tons of asses to jail, at $1,000 per pop, bail, and impounding the vehicles!  Being the bright attorney, I am, I found a law, that stated that, cops could not, ask for proof of insurance, and registration, unless there was an accident, over $1500.  Ah, ha, I got those bastards . .  .  it just happened to be, during the legislative session, and fast as I could say, JACK FLASH, the law was changed, to cover the loop-hole in the law . .  . I did, however, get the arresting officer, to give my client back her $1000!  LOL!  LEGEND!  But, if this were a game, and sometimes, is seems like it, more like a war, your liberty, property and rights, would not be in jeopardy, but these guys are organized and we fuck you! so, don't count on, getting away with much, and be prepared to stop an illegal, search and seizure! BEFORE IT TAKES PLACE!

WE ARE "NOT" TALKING ABOUT, MERE TECHNICALITIES OF THE LAW, BUT YOUR GOD GIVEN, INALIENABLE, CONSTITUTIONAL RIGHTS!

Sure, there is something called the exclusionary rule . . . that, unconstitutionally, obtained, evidence against you, can be excluded and suppressed by a motion and hearing, but do you really want to pay another, couple of thousand dollars to your bottom feeding criminal defense attorney?  NO!  Do your best to avoid that one; however, I have been successful, at that, one too.  My client, allowed a search of his house, it produced, marijuana, hid in a coffee can, a pipe, he may or may not have used, smoking it, and three guns, that were inoperable, collectors items, keepsakes . . . I was able to suppress the gun charges, that carried a 30 year gun enhancement, 10 years in prison for each gun!  now, the client, could have stopped, all these charges, had he asked the cops to get a warrant to search his premises, he even gave the cops, the knife, his girlfriend, was slapping around on her knee, and actually, cut him with . . . lucky he had a great attorney, because, I noticed from the pictures the prosecutors gave me, that, it was my client who was cut, not the victim at the time he kicked her out of HIS HOUSE!  You could see it, but the cops, claimed, that there was blood all over his front room, and it was the victim's blood . . . no, she cut herself, on the first trip to the hospital, my client was locked up, for that, but, she got back into his house, while he was in jail, had a party the next night, had a grand maul, seizure, and tripped on barbed wire, that was sitting out the back door, coming to and blaming the client, who was in jail, and the cops and prosecutors, took off all self-authenticating evidence of dates, times, on the photos, to match her story!

So, when, my client, actually, gave the cops, the knife, they assumed that it was him, who cut her, not the other way around, and he was charged with ATTEMPTED HOMICIDE, from the cuts from the barbed wire!  If that is not horrifying, I don't know what is . . . I took him, from 45 years, in prison, to, 3 years probation, for the drug charges, all others dropped, but the attorney, before me, just visited once a month, to collect on his Social Security, and was doing nothing for him!  He was damned lucky to chance on me, as his attorney!  I CARED!  I WAS NOT PAID A DIME!  AFTER THE FACT, the prosecutors, cops, a judge, all blocked, me from having the house, he not only gave me, after the fact, but after we were married, the one in Parowan, Utah, I was just run out of, at Christmas!  Go figure . . . three traits of cops, they never vote Democrat, and they never forget . . . can't remember the third thing!  Many people will get, a public defender or pretender, who are appointed by the prosecutors, because of their penchant to settle!  the yare good at getting you a good deal, but, don't count on them, ever doing a suppression hearing of evidence, when they are paid a flat rate, getting paid the same for settling a case, or going to trial, and, a suppression hearing is separate from the trial!  Can you see why it is a big deal up front, to NOT GIVE YOUR CONCENT to search?  IF YOU DON'T PROTECT YOUR RIGHTS, WHO THE FUCK DO YOU THINK WILL?

YOU HAVE TO PRODUCE I.D. WHEN ASKED, UNLESS YOU DON'T HAVE IT--DO NOT MAKE UP, A FAKE I.D., THEN YOU ARE LOOKING AT FALSIFYING INFORMATION, OR WITH A FAKE I.D., FALSIFYING A GOVERNMENT DOCUMENT!

• if you are pulled over for failure to signal, or speeding, still don't consent to a search of your vehicle, and if you have stuff in plain sight, and it is of a criminal nature, there is the plain view doctrine . . . that allows the cops to seize what he can see in plain view!
• cops are good a getting you to allow them to exceed, their powers or jurisdiction over your property, person, or areas of control; therefore, you are going to have to be, fairly, firm, but fair, avoid getting aggressive, you may get shot, in certain locations!
• but, intimidation, tricks, don't take away your rights, the Patriot Act, doesn't, deny you, of ANY CONSTITUTIONALLY PROTECTED RIGHTS . . . the cops may be trained to think that, they are King Cong of the streets, but they are not, and they are, finding that out, just ask, Chicago cops, if they are immune from, providing civil rights, and constitutional protections?
• this is a great time, to learn your rights, and exert those rights!
• call the cop on his bluff, and make him get a warrant, which takes more time, and is totally, inconvenient, unless, you are Iron County, Utah, and they have pre-stamped, warrants, prepared before hand!  Check that shit!  If they produce a boiler plate warrant, that is not specific to you, your car, your house, or your tent, don't allow them to skate on that!  They need to list with particularity, specificity and clarity, what is to be searched and seized, and there has to be PROBABLE CAUSE TO GET THIS WARRANT . . . NOT TO BE USED TO HARASS, INTIMIDATE, OR PISS YOU OFF!
• again, the cops are not going to take your lip, so, don't get too emotional and out of control, because, then they can get you, with obstruction of justice, interfering with an arrest, or disorderly conduct, and all that is going to cost you time and grief!
• you can't be arrested for asserting your rights
• don't use profanity, because, they can't arrest you for, asserting your rights, but, many cities, have ordinances, that allow them to arrest you for swearing, abusive treatment, or speech conduct, that, is offensive, as much, as the officer might deserve it!  LOL!
• that is where the law draws the line!  Swearing, is pretty well accepted by the younger generation, among friends, but, cops, are not going to think you are cool!  I have tried it!  LOL!
• FIRMLY STATE, I HAVE NOT DONE ANYTHING WRONG--GET A WARRANT!
• I want to be on my way, AM I FREE TO GO?  Watch for being DETAINED LONGER THEN NECESSARY!
• if you do NOT feel free to go, then you are UNDER ARREST!
• if the answer is NO, then, you have been seized!
• houses provide the greatest protections
• don't open the door
• step out onto the front porch
• be clear on the body language as well as verbally, to state this is not wanted! I am in control of my house1
• I AM SORRY OFFICER, I DON'T CONSENT TO SEARCHES!
• set perimeters, monitor the police, asking them questions . . . these are rights, your rights, and they have no power to take them away from you--think of them as god given rights, and that may make it easier to affirm and ask for those rights, the government didn't give those rights to you, WE THE PEOPLE, in a One Nation Under God, accented, to being governed, in return for the creating the government, to govern us, according to a set of agreed upon laws and rules, called the Constitution, or the Supreme Law of the Land, in this Union of States, formed to create the United States of America!
• you are free to record cop interaction with you, and preserve it for evidence . . . I have seen teens, back cops right up with their cell phones!  Cops used to say, you can't video me . . . oh, yes, you can, they are public officers in public places, there are no protections for them, to not be videoed!  This is the idea behind, dash cams, or body cams, that protect, both the cop and the person, that is involved!
• again watch, obstruction of justice, stand back, and video . . . you may want to tell the officer, you are prepared to use your cell phone, and even say, to protect you, and my rights! they will get the hint, and if all is done by the book, the cops, has nothing to worry about!
• on the streets, the 1st and 14th amendments, allow for freedom of assembly, free speech, and redressing grievances with your government, plus you liberty rights, due process and equal protection!
• don't let the officer, spin it into, "obstruction of justice" it  is he or she who is "obstructing justice" by refusing you your rights!
• you can ask for badge numbers, and details, don't operate in the dark!  Good officers, have no problem granting or respecting your rights, they are all about, enforcing the laws, and doing their jobs well, and it is magic when they do!
• large police organizations like Seattle, Washington, have separate departments of offices, like the Office of Professional Investigation, who are cops, specifically, given the responsibility to monitor police conduct and complaints, they are not the same as Internal Affairs, who, are cops, within the same department, investigating their buddies, which is fraught with issues and conflict of interests, corruption, and some cop shops are outsourcing to other cops shops, like going to, the sheriffs department to look into, city cop complaints, or the opposite, I know that there are times when, the CIA has looked into FBI complaints and the reverse is true too!  AVOID THE VERY APPEARANCE OF EVIL OR CONFLICT!
• with privately paid, security officers, treat them the same as cops, even though, they do not have the same powers, because, they will have to eventually, call the cops, but it is a good rule of thumb, to, behave in much the same way!
• in most security circumstances, they are there to put the fear of god into you!
• they may stop you, question you, but if they find out there is a problem, they have to call the normal cops!
• they can't detain you longer than to ask you some questions, they may, take actions that are policy, for shoplifting, the private owner, may just kick you out of the store and not let you return without trespassing you for coming back, or they may turn you over to the cops!
• they can't detain you for too long, but, they can keep you until the real cops come!
• I have people all the time, who approach me for a civil rights suit, and yes, your rights, in many circumstances have been violated, but law suits are, timely, costly, and all of them, are not created equal!  I have had some really gnarly, ugly, very dirty, civil rights suits, so, most of yours, and you will get offended, and have, on a scale of 1 to 100, are a 5!  All things are relative, there is good, bad and ugly, or good, better, best . . . I only take the best!

DON'T GIVE UP ANYTHING, UNLESS YOU GIVE UP AUTHORITY!

YOU HAVE A 1ST AND 14TH AMENDMENT RIGHT TO WANDER THE STREETS!

YOU HAVE MANY MORE RIGHTS THAN THE 4TH AMENDMENT!
