Prosecutors, have a unique relationship when it comes to the cops . . . they rely on them to enforce laws on the streets, within the confines of the Constitution, using probable cause, to determine if a crime has been committed, detaining, and if necessary, arresting, gathering evidence of crimes, but while both are part of the executive branches of the government, they are separate and distinct, having very different jobs, responsibilities, duties, and they need to operate, independently of each other, while working together.  This morning, in an unexpected, press meeting, State's Attorney, Marilyn J. Mosby, only 4 months on the job, took the bull by the horns, and did her job, promoting justice for all, regardless of wealth, station, profession, race, ethnicity, in a system, that has long departed from the symbol of our legal system, that of Lady Justice, standing with a blindfold on, scales of justice in her hand, standing on the head of a snake, crushing injustice . . . at least that is like the statue, that I used to have, before, Hitler's SS men and women, dressed up like modern day, Washington County Sheriffs, and took everything I owned, without charges, without reason, without the law or the Constitution behind them . . . operating under Mormon Utah justice, trying to stop me from going to the 10th Circuit Court of Appeals, arguing my $357 million securities case against the state of Utah, and government officials for federal statutory and constitutional civil rights violations, committed by state officials, operating under color of law!

In one of the most professionally presented press conferences I have ever seen, Ms. Mosby, in an unemotional rendition of both the law, explaining to those less familiar with the process, took her stance for justice and the way it is suppose to operate, looking at all the facts of the case, going from A to Z, in a TOTALITY OF THE CIRCUMSTANCES!  She was flanked with police organizations and committees, other attorneys, who did the foot work, doing an amazing job, both professionally, unbiased, and prompt, knowing, that the people of Baltimore, who elected her to do this job, hard as it is at times, especially, against police officers that are both needed, depended on, and valued, in the community, making it in all cases, very difficult, taking into consideration for the community, the public image, walking a fine line between seeing that justice is meted out, and protecting the credibility of the rest of the police force, who risks their lives every day, which all of us, love, appreciate, dig, respect, as long as it is done within the confines of the rules of engagement . . . the U.S. and state Constitutions, Bill of Rights, legislative law, and JUSTICE in the law!

This morning, after the surprise press conference, that shocked everyone, the Fraternal Order of the Police, said they did not trust Ms. Mosby . . . really?  This is not a case of the cops vs. the community, and a win/lose situation; it is all about justice, in what happened to Freddie Gray, who merely made eye contact with three police officers, as best I recall, and without probably cause, then pursued him, after Gray took off running . . . PC is the condition and constitutional standard, under which, the prosecutors had to use, to determine if Mr. Gray, was legally, chased, arrested, shackled and chained, and thrown in the back of a van, without restraint, claiming he could not breath, which led to his death!  For too long, cops, have crossed over their professional duties, and tried to use the prosecutors as their hired guns, not only to prosecute those, whom they determine, think, or want to be considered to be criminals, but to exclude fellow officers, who are guilty of hideous crimes against humanity, like this one!  Basic human decency, would have dictated a different course, listening to cries for help, getting medical assistance, that could have come, at at least 5 stops, before processing or going to the jail . . . callous, disregard for the life of anyone, suspect, defendant, criminal, or incarcerated persons . . . does not justify police brutality, under any circumstances, or under the fucking most rare exceptions!  Remember, the 8th amendment, against, cruel and unusual punishment?  Yeah, that old dusty document, that Mosby just refreshed and applied!

Just by way of a reminder of other issues . . . the Fraternal Order of the Police, is not part of the executive branch of the government, charged with enforcing the law; there is no constitutional, statutory, or legislative provisions for you to call for an independent investigation of the facts surrounding the arrests of these 5 or 6 officers, involved in this case--you may know some of the laws, even understand it, but you are not an attorney, nor where you elected by the people to represent them in issues of JUSTICE!  Just as the branches of the government, executive, legislative and judicial, all have their separate and distinct responsibilities, as set forth in state and federal Constitutions, within the individual branches, especially, within the executive branch, responsible for enforcing the laws, that the legislative branch determines the PEOPLE need, or the laws that are interpreted by the judicial branch, as the constitutional interpretation, that through the plain language of the statute or constitution, the intent of the founding fathers, or what the legislative branch wanted, or looking back at the historical perspective, making clear, what was going on when that law was made, thus guiding the executive branch in enforcing the laws.

Once, cops have arrested a person, and find that there is sufficient evidence to detain them, the charges are to be determined by the prosecutors, who looks at the facts, the evidence, the elements of a crime, and determine, whether to proceed with prosecution, or to decline prosecution, due to not having sufficient evidence to charge, detain, or jail a person.  From the first day in law school, students, are taught, various acronyms to help them remember to take the facts, the evidence, the law, and apply those elements, to see if that particular law, statute, constitution, was violated, or there are all the elements of the law met . . . cops are not trained to do that, or do not have the authority to do that!  Law school is a grueling experience, you are on a learning curve from hell, put to the test, then you are tested on 22 areas of law, probably more in the last 20 years, and then tested in a two day bar exam.  Now does that mean that all attorneys are smart, or that all know the law, or that they get every aspect of the law, or that you or any Joe Blow, could do it . . . THEY JUST FUCKIN' DIDN'T DO IT!  PERIOD!  I have people ask me, if they could make it through law school . . . I told them there is nothing special about attorneys, they just had the discipline to do it!  When cops or others are on the golf course, or skiing, or hiking . . . law students, have their asses on a chair and their eyes in a book--that is what it takes!

I would venture a guess that Ms. Mosby, much like U.S. Attorney, Loretta Lynch, were exceptional, due to the fact that they both were able to not only make it through law school, but succeeded as attorneys, to the point that they ended up either being appointed to higher positions, or elected for their unique contributions to the legal field . . . you don't reach these levels of expertise and trust, without being exceptional!  While Ms. Mosby, is just 4 months on the job, doesn't mean that she is 4 months as an attorney . . . she most likely has years of experience or she has done great work, and is trusted by the PEOPLE! Much like cops expect the people to do, sit back and let the State of Maryland's elected top law enforcement officer in the state, do her job.  And I am sure, that if she needs help, support, or insight, Ms. Lynch, can step in and direct, inform and send backup.  They are following, due process and equal protection of the laws . . . there has to be these to deprive any citizen or cop of their right to life, liberty and property!  Nobody, can take these facts, and somehow, no matter how convoluted they make the facts, and to what point, can they twist them, to saying nothing was wrong, in this situation . . . a man looks at cops and ends up dead?

Ms. Mosby, Dedicated This Investigation & Press Conference to the Youth of Baltimore . . . You and Your Fellows are Started the Protest--YOU Led Your Elders, You are our FUTURE!  Thank YOU!

I don't know if you, dear and beloved readers, know that it was the youth of this city, of Baltimore, with no declared leader, no group or organization, no predetermined actions, and little direction, took it upon themselves, I would assume, through, social media, somehow connected with other youth, groups, friends, and colleagues, to start the marches and protests in several large cities . . . New York, Pennsylvania, Boston or wherever.  And what happened was amazing.  Geraldo Riviera, of Fox News, showed up and started to interview a black youth, who promptly, put him in his place, and said, where were you on Saturday night, when 4,000 peaceful demonstrators came together in solidarity and power to try to see that justice was served for Freddie Gray?  Why are you just showing up for the fires, or the looting, reporting that we are "thugs?"  We are here, for an intellectual pursuit of justice for Mr. Gray, to see that he is not forgotten and disappears into a grave without holding those responsible for his death accountable!  This young man was articulate, strong, intelligent, powerful, right, and took the media to task, for sensationalizing the event, focusing only on what makes for scandalous events, the bizarre, the bad, rather than what really happened . . . GOOD FOR YOU!

The news and media, have a social responsibility to cover the great things, the good, the noteworthy, the noble, not just the sensational, capitalizing on numbers, rather than truth . . . trust has to be re-established with both the cops and the media!  The youth of today, the Millenniums, as they are called, are smart, and are also very trusting in authority . . . but, if you don't maintain that trust, they are the worst group to deal with, because they trusted you so much.  Unlike their hippie parents, who threw off authority, these kids, were raised by helicopter parents, who coddled and raised them, with much more care, due to the world we are living in; however, on the flip side of that, comes, the total betrayal when authority figures, like police, politicians, banks, and others . . . creates vehement hatred, disdain, and revolt!  To these young people's credit, in light of all the death, violence, carnage, and brutality, have been idealistic enough to believe that they could change things, that they had a voice, and that things could get better . . . and the tides of injustice appear to be changing, we are returning to justice, and we can thank them from Occupation Wall Street to Baltimore Youth, who carried the day, and their elected States Attorney, recognized their contribution!  But for them, the youth, this news, the facts of the case, and the prosecutions, arrests, and bookings of the responsible cops, might not have happened!

AND THERE WILL BE, JUSTICE FOR ALL!

BALTIMORE . . . HAVE A CALM, SAFE, AND PEACEFUL WEEKEND, YOU ARE OUR HEROES!
